NO PURCHASE NECESSARY TO ENTER OR WIN

The object of this skill contest is to establish a virtual "home run streak" and keep it going for as long as possible. You'll do this by selecting one Major League Baseball ("MLB") player each game day, from a list displayed on MLB.com of MLB players who are on a MLB Club's active roster on that day. If the player you select for that day hits at least one home run in that day's games, your streak continues. If the player you select does not hit a home run, you can still participate, but your streak is reset to zero. You must select a player each game day; however, you can make your player selections for up to seven (7) days in the future. If you fail to select a player for any game day, your streak will automatically reset to zero. You can select any player as many times as you want over the course of the Contest Period (as defined below).

Eligibility

MLB.com Beat the Streak: Home Run Edition (the "Contest") is open only to legal residents of the fifty (50) United States and Washington D.C. (excluding residents of Louisiana), and Canada (excluding residents of the Province of Quebec) who are of legal age of majority in their jurisdictions of residence as of the date of entry. Void outside the fifty (50) United States and Washington D.C., in Louisiana, the Providence of Quebec and where prohibited by law.

Employees or consultants of the MLB Entities or their respective parents, affiliates, subsidiaries, or advertising and promotion agencies, or the immediate family (parent, sibling, child or spouse) or any person residing in the same household as any such employee or consultant of the above, whether or not related, are not eligible to participate or win a prize. The "MLB Entities" shall mean MLB Advanced Media, L.P. ("MLBAM"), the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions), Baseball Television, Inc. (d/b/a Major League Baseball International), the Major League Baseball Clubs, or any of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, or the directors, officers, employees or agents of the above entities.

Contest Period
The Contest begins on April 2, 2006 and ends following the conclusion of the final game of the 2006 MLB regular season (the "Contest Period").

How to Register

You may register to participate in the Contest from 5:00 p.m. Eastern Time ("ET") on March 27, 2006 through 11:59 p.m. ET on September 22, 2006 (the "Registration Period"). Limit one (1) registration per unique email address. To register to participate during the Registration Period visit www.mlb.com and follow the banners, buttons and/or links for the Contest registration page. If you are not already a member of the site, you must become one before you can register to participate in the Contest (membership of the site is free). Registrations must be received by 11:59 p.m. ET on September 22, 2006. Please note that all information submitted by online entrants is subject to, and will be treated in a manner consistent with, MLB.com's Privacy Policy accessible at: www.mlb.com/mlb/help/mlb_help_about_privacy.jsp.

Game Administration

By participating, participants agree that MLBAM will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by MLBAM regarding the Contest shall be final and binding in all respects. If you have any questions, please send an e-mail to MLB.com customer support.

Selecting Your Players

Each day on which an MLB game is played during the Contest Period, you must select one (1) player from a list displayed on MLB.com. If you fail to select a player for any day of the Contest Period on which a game is played, your streak will reset to zero. The list of available players may change as a result of injury or other roster changes, so be alert. You will be able to select any player from the list who is on a MLB Club's active roster on that day. You will have until five (5) minutes prior to the start of the first MLB game being played on that day to make your player selection for that day; however, you can make your daily player selection up to seven (7)-days prior to any game day of the Contest Period.

Establishing and Maintaining a Streak

All participants start at zero. Your streak is measured by the number of consecutive days the player(s) you select are credited with a home run during the 2006 MLB regular season.

If you select a player for any day who does not hit a home run during the day for which you selected him, your streak ends and must start to build your streak again from zero.

If a player you select does not play during the day for which you selected him for any reason, your streak will NOT end. A home run streak will also NOT end if all the selected player's plate appearances (one or more) result in a base on balls, hit batsman, defensive interference or a sacrifice bunt. A home run streak will end if the player has a sacrifice fly and no home run. Your streak will remain intact in the event of a cancelled or postponed game.

In the event that a player you select plays in a double-header, your streak will continue as long as the player hits at least one home run in either of the two games.

NOTE: Only home runs officially scored as home runs in 2006 MLB regular season games will be counted in MLB.com Beat the Streak: Home Run Edition.

PRIZES

Cash prizes will be awarded in the form of a check. Gift certificates may be subject to certain terms and conditions. Prizes are non-transferable and non-assignable, with no cash redemptions or substitutions except by MLBAM, who reserves the right to substitute a prize of comparable or greater value at its sole discretion. NO PRIZES WILL BE AWARDED IF NO PARTICIPANT ACHIEVES A HOME RUN STREAK OF AT LEAST SEVEN (7) GAMES.

Top Streak Prize

The eligible participant with the longest streak, greater or equal to nine (9), at the end of the 2006 Major League Baseball regular season, as determined by MLBAM in its sole discretion, will win ten thousand dollars (US$10,000) ("Top Streak Prize"). If two or more people finish the season tied with the longest streak, tiebreakers (see below) will be used to determine a winner.

NOTE: Top Streak Prize will only be awarded if an eligible participant achieves a home run streak greater than or equal to nine (9).

Grand Prize

If no participant achieves a nine-game home run streak or greater during the Contest Period, the eligible participant with the longest home run streak greater than or equal to seven (7) will win two (2) tickets to the 2007 All-Star game in San Francisco, CA (the "Grand Prize") (Estimated retail price of Grand Prize: US$300).

NOTE: Grand Prize will only be awarded if (i) no eligible participant achieves at least a nine-game home run streak and (ii) an eligible participant achieves a home run streak greater than or equal to seven (7).

Seat locations at the 2007 All-Star game shall be selected by MLBAM at its sole and absolute discretion. The Grand Prize winner is fully responsible for any and all applicable federal, state, provincial and local taxes. Transportation is not included. All costs and expenses not specified herein related to the acceptance and use of the Grand Prize including, but not limited to, lodging, all transportation costs, meals, gratuities and souvenirs, are the sole responsibility of the winner. 2007 All-Star Game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event the 2007 All-Star game is not played due to weather, an act of God, an act of terrorism, civil disturbances or any other reason. Winner agrees to comply with all applicable stadium regulations in connection with the Grand Prize. MLBAM reserves the right remove or to deny entry to winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game. The MLB Entities, and each of their respective parent companies, trustees, subsidiaries, franchisees, affiliates, licensees, agents, independent contractors and advertising and promotional agencies, and each of their respective officers, directors, agents and employees (collectively, the "Released Parties") will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control, that may cause the cancellation of the 2007 MLB All-Star game.

Tiebreakers for Top Streak Prize or Grand Prize

In the event of a tie, tiebreakers will be used among the remaining tied participants in the following order:

  1. Total number of home runs during the streak of all the players the participant selected.
  2. Total number of RBIs during the streak of all the players the participant selected.
  3. Total number of hits during the streak of all the players the participant selected.
  4. Total number of RBIs by the player the participant selected on the most recent day of the streak, going back one day at a time until the tie is broken.
  5. Total number of hits by the player the participant selected on the most recent day of the streak, going back one day at a time until the tie is broken.
  6. MLBAM will administer a timed baseball trivia quiz, testing the tied participants' knowledge of Major League Baseball, until the tie is broken.

LEGAL DISCLAIMERS

General Conditions

By participating, each participant accepts and agrees to be bound by these Official Rules, the MLB.com Privacy Policy and Website Terms of Use, and by the decision(s) of MLBAM which shall be final and binding in all respects.

Each winner will be notified by e-mail and may (in MLBAM's discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). In the event that the winner does not respond to any such notification within ten (10) days, a disqualification will result and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up. Each winner may be required to submit his/her valid social security number card and/or other identification to MLBAM and may also be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, where legal, Publicity within ten (10) days following issuance. Failure to submit any identification required by MLBAM or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of any prize or prize notification as undeliverable may result in disqualification and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up.

Participants agree to allow the MLB Entities and their designees to use their names and likenesses in any and all mediums now or hereafter known for advertising and publicity purposes throughout the world in perpetuity, without any compensation, notification or permission, unless prohibited by law.

All applicable federal, state, provincial and local laws and regulations apply. This Contest and these Official Rules will be governed by the laws of the State of New York. Any court of competent jurisdiction sitting within the State of New York, New York County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these Official Rules.

Released Parties are not responsible for lost, late, stolen, garbled, delayed, undelivered, misdirected entries, for incorrect, inaccurate or incomplete entry information whether caused by a participant, equipment, or technical malfunction or for any human error, technical error or malfunctions.

Released Parties are not responsible for any technical, computer, network, typographical, printing, human or other errors relating to or in connection with this Contest, including, without limitation, errors or problems which may occur in connection with the offer or administration of this Contest, the processing of entries, selections or registrations, the tabulation of streaks, the cancellation of games or any errors appearing in any Contest related-materials, including, but not limited to, errors in advertising, the Official Rules, the selection and announcement of the Contest Prize winners or the distribution of the prizes. MLBAM reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.

The Released Parties make no warranties, express or implied, relative to the use or enjoyment of any prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. By entering the Contest, participants agree to hold harmless and fully release the Released Parties from any and all liability for any injuries, losses, death, or damages of any kind caused by participation in the Contest or resulting from the acceptance, possession, quality, use or misuse of the Contest Prize, or any portion of any prize, including any travel or activity related hereto.

MLB.com Beat the Streak: Home Run Edition is a skill contest designed to increase consumer awareness of and interest in Major League Baseball and MLB.com, the Official Site of Major League Baseball. This Contest may not be used for any form of gambling.

Specify "Rules" or "Winner List." Requests must be received by September 30, 2007). Residents of VT may omit return postage on rules requests.

Internet

If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, cancellation of games or any other causes beyond the control of MLBAM which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, MLBAM reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. In event of termination, MLBAM further reserves the right to award the prizes to the players with the most points, as determined by MLBAM in its sole discretion, as of the termination date.

The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.

CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE MLB ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute as to the identity of a participant, an entry will be declared made by the Authorized Account Holder of the e-mail address submitted at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

In the event that the Contest is challenged by any legal or regulatory authority, MLBAM reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, the MLB Entities shall have no liability to any participants who are disqualified due to such an action.
