ELIGIBILITY: To participate in the Promotion a person must be a legal resident of the United States (including its commonwealths, territories and possessions but excluding Florida, New York and Rhode Island) (collectively referred to herein as “states”), and Canada (excluding the Province of Quebec) (the “Eligible Territory”) who is twenty-one (21) years of age or older at the time of the Promotion and physically located within fifty (50) miles of Gallagher Way during the Entry Window (defined below). Employees, officers, and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of Chicago Cubs Baseball Club, LLC (“Sponsor”), the other MLB Entities, Anheuser-Busch, LLC (“AB”), Everest Indemnity Insurance Company (the “Insurer”), any advertising or promotional agencies or employees or agents of media companies and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Promotion are not eligible to participate in the Promotion or win a Prize (defined below). Current or former professional baseball or softball players, which includes individuals who are or were on the roster of a Major League, minor league, or independent league team at any time; current baseball or softball coaches; and current collegiate or high school baseball or softball players or coaches, which includes individuals who are or were on the roster or coaching staff of a collegiate team (at any level) in 2023 are not eligible to participate in the Promotion or win a Prize. The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (“MLB”), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. The Promotion is subject to all applicable federal, state, territory, provincial and local laws, rules and regulations. Void in Florida, New York, Rhode Island, the Province of Quebec, and where prohibited or restricted by law, rule or regulation.

HOW TO ENTER: Each individual that arrives at Gallagher Way (the plaza located outside of Wrigley Field (“Ballpark”) in Chicago, IL) on March 27, 2023, between 12:00 p.m. Central Daylight Time (“CT”) and 1:00 p.m. CT (“Entry Window”) will receive one (1) no purchase scratch-off card as one (1) entry into the Promotion. Limit one (1) entry per person. Additional entries beyond the specified limit will be void.

RANDOM AT-BAT PARTICIPANT SELECTION: Fifty (50) entrants will be selected by random decision based off the results of the scratch-off card on March 27, 2023, prior to, at, or around 1:20 p.m. CT for an At-Bat (as defined below) from among all eligible entries received. Subject to verification of eligibility and compliance with the terms of these Official Rules, the potential At-Bat participants will be declared the official At-Bat participants of the Promotion (the “Participants”). In the event the selected Participant is unable to physically participate in the At Bat opportunity as described below, that Participant will have the opportunity to designate a proxy (“Proxy”) to participate on their behalf. If applicable, the Proxy must be twenty-one (21) years of age or older and agree they are eligible in accordance with these Official Rules and adhere to these Official Rules and, for the At Bat opportunity as described below, will also be referred to as a Participant; however, if a Proxy “wins” as described in the Winners section below, the Participant who designated the Proxy will be deemed the Winner (as defined below) and the Proxy will not receive a prize in connection with the Promotion. The decisions of Sponsor are final and binding on all matters relating to this Promotion. Odds of being selected as a Participant depend on the total number of eligible entries received. Limit of one (1) At-Bat per participant.

AT-BAT OPPORTUNITY: From 1:20 p.m. CT to 3:00 p.m. CT on March 27, 2023, each Participant will have the opportunity to step into the batter's box at Ballpark for one (1) At-Bat. Sponsor, in its sole discretion, shall determine the exact time of the At-Bat. An "At-Bat" means a maximum of three (3) pitched baseballs to Participant, regardless of whether such Participant swings at any or all such pitches.

AT-BAT CONDITIONS: Participants must present valid identification on the day of the Promotion in order to participate. All Participants must sign a waiver and an Affidavit of eligibility prior to entering the batter's box and must use a baseball and baseball bat provided by Sponsor, or an unaltered aluminum bat provided by Participant provided that Sponsor reviews and approves prior to the At-Bat. The exact time, order, nature, and duration of the At-Bats shall be determined by Sponsor, in its sole and absolute discretion. Transportation to/from the Ballpark, parking, and lodging are not included and are the responsibility of each Participant. Each Participant agrees to comply with all applicable Sponsor and Ballpark regulations in connection with the Promotion. Participation in the Promotion at the Ballpark is subject to Participant’s (and guests’) consent to and compliance with all health and safety policies of the MLB Entities. Sponsor and the other MLB Entities reserve the right to remove or to deny entry to any Participant who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person at the Promotion event. Sponsor and the other MLB Entities will not be responsible for Participants missing their At-Bat, or cancelling, rescheduling, modifying, or postponing the Promotion, or any portion thereof for any reason or for weather conditions, acts of God, acts of terrorism, civil disturbances, work stoppage, pandemic, epidemic, or any other natural disaster outside their control that may cause the cancellation or postponement of the At-Bat or Promotion. Sponsor, in its sole and absolute discretion, shall determine whether conditions (weather or otherwise) at Ballpark on the date the Promotion is held are suitable for the Promotion to begin and/or continue to its conclusion and may modify the Official Rules of the Promotion including, but not limited to, moving to an indoor location at the Ballpark, providing substitute prizes, removal of prizes, and modifying rules to fit the new location.

WINNERS:

1. Grand Prize Winner. The first Participant , if applicable, who hits a pitched ball and strikes the Budweiser target in the Budweiser bleachers at Ballpark, without first bouncing on a surface, the field, or foul territory during his/her At-Bat and without aid of or interference by any person or object (“Grand Prize Action”) (“Grand Prize Winner”). If no Participant completes the Grand Prize Action, a Grand Prize will not be awarded.

   Participants must clearly hit the Budweiser target (any hit ball going over the target, will not be considered a successful attempt). Participants must use the baseball(s) and bat(s) provided by Sponsor. Participants that alter or tamper with the bats or balls will be disqualified. Additionally, any At-Bat that occurs while using any other baseball and/or bat will be deemed an illegal attempt and Participant will be disqualified from the Promotion.

2. #HitTheBuds Target Winner(s). Sponsor shall place #HitTheBuds targets on the Ballpark playing field (“#HitTheBuds Targets”). The size and placement of the #HitTheBuds Targets shall be determined by Sponsor in its sole and absolute discretion. A Participant who hits a pitched ball, without first bouncing on a surface, the field, or foul territory, during his/her At-Bat to a #HitTheBuds Target in the infield without aid of or interference by any person or object (“Target Action”) will be considered a “#HitTheBuds Target Winner”. If no Participant completes the Target Action, no #HitTheBuds Target prizes will be awarded.

Participants must clearly hit the #HitTheBud Targets and have the ball land in front of the target (any hit ball going over or through the targets, whether on the fly or making contact with another person, object, or surface prior to reaching the target, will not be considered a successful attempt). Participants must use the baseball(s) and bat(s) provided by Sponsor. Participants that alter or tamper with the bats or balls will be disqualified. Additionally, any At-Bat that occurs while using any other baseball and/or bat will be deemed an illegal attempt and Participant will be disqualified from the Promotion.

If applicable, the Grand Prize Winner and #HitTheBuds Target Winner(s) are each referred to herein as a “Winner”. The ultimate determination of whether a Participant qualifies as a Winner shall be made by Sponsor in its sole and absolute discretion.

PRIZES:

1. Grand Prize. If applicable, one (1) Grand Prize Winner will receive One Million Dollars ($1,000,000) (“Grand Prize”). One (1) Grand Prize will be awarded to the first person declared the Grand Prize Winner. Approximate Retail Value (“ARV”) of the Grand Prize: $1,000,000.]

2. #HitTheBuds Target Prize. If applicable, each #HitTheBuds Target Winner will receive one (1) of the following prizes (each a “#HitTheBuds Target Prize”) based on the prize associated with what is shown on the Target hit: one (1) Budweiser-branded item at Sponsor’s sole discretion or one (1) Traeger Grill. Total maximum ARV of the #HitTheBuds Target Prizes: $4,300. Actual value may vary depending on the actual targets hit by Participants and the value of each respective prize.

3. Participation Prize. Each Participant, regardless of if they are a Winner, will win two (2) tickets for Participant and one (1) guest for the Chicago Cubs 2023 Opening Day game scheduled to be held on March 30, 2023, vs. the Milwaukee Brewers (“Home Opener”) (“Participation Prize”) (ARV: $200).

TRANSPORTATION AND LODGING NOT INCLUDED AS PART OF ANY PRIZE.

The Grand Prize and each #HitTheBuds Target Prize are each referred to herein as a “Prize”. Limit one (1) Prize per Participant. Maximum ARV of all Prizes and Participation Prize: $1,014,300.

PRIZE CONDITIONS (INCLUDING PARTICIPATION PRIZE): All Prize details shall be determined in the sole and absolute discretion of Sponsor. Each Winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use not specified herein as being provided, including but not limited to lodging, transportation costs, meals, gratuities and any and all other expenses incurred by accepting the Prize are the sole responsibility of each individual Winner. Prizes are non-transferable and non-assignable, with no cash redemptions. Game tickets shall be provided to each Winner via the MLB Ballpark app. See mlb.com/apps/ballpark for instructions on how to download the app. Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see cubs.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the applicable prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Each winner’s guest(s) must be twenty-one (21) years of age or older. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of any prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played, or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Each winner and his/her guest(s) agree to comply with all applicable Ballpark and venue regulations in connection with the Prize; see cubs.com/ballpark for details. Sponsor and the other MLB Entities reserve the right to remove or to deny entry to any Winner and/or his/her guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Released Parties (as defined below) will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture and may invalidate the license granted by the game/event/exhibition ticket.

WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Promotion and taking an At-Bat, each Participant agrees to (a) be bound by these Official Rules, including all entry requirements; and (b) waive any and all claims against Sponsor, the other MLB Entities, AB, the Insurer and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Promotion, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any death, injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Promotion or from the receipt or use of the Prize (or any portion thereof), or any travel or activity related to the receipt or use of the Prize (or any portion thereof) (collectively, “Claims”). By entering the Promotion, each Participant gives his/her express permission to be contacted by Sponsor by telephone, e-mail and/or postal mail for Promotion purposes. By participating in the Promotion, each Winner grants to Sponsor, the other MLB Entities, and their designees the right to publicize such Winner’s name, address (city and state of residence), photograph, voice, statements and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission, or notification, unless prohibited by law.

GENERAL CONDITIONS: Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due or garbled entries, transmissions, email or mail; or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections including those through and/or by any website, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; wireless service congestion; failures or malfunctions of phones, phone lines or telephone systems, wireless towers or cellular tower equipment; any error, omission, interruption, defect or delay in wireless or other transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed email notifications; printing, typographical or other errors appearing within these Official Rules, in any Promotion-related advertisements or other materials; or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, wireless service, mail, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of the Prize or in any Promotion-related materials, or the cancellation or postponement of any Major League Baseball game, event or exhibition. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to entrants' or to any other person's computer and/or wireless device related to or resulting from participating in this Promotion or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Promotion or website or attempt to undermine the legitimate operation of the Promotion by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any representative of Sponsor and/or the other MLB Entities or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Promotion is unlawful and subject to legal action by Sponsor, MLB and/or their respective agents. Sponsor and MLB shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Promotion, and to resolve all disputes in its sole discretion. Released Parties (a) make no warranty, guaranty or representation of any kind concerning the Prize (or any portion thereof), and (b) disclaim any implied warranty. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

By entering the Promotion, each entrant agrees to indemnify, hold harmless and fully release the Released Parties from any and all Claims. For the avoidance of any doubt, by participating in the Promotion, each entrant agrees to indemnify and hold harmless and fully release the Released Parties from any and all liability for any injuries, losses, death, damages, fees, expenses, and costs (including reasonable attorneys’ fees and expenses) resulting from any actual or alleged Claim made, or action or suit instituted, by any entrant arising out of or related to any right of publicity, right of privacy, or other proprietary right of entrant.

Sponsor and MLB reserve the right, in their sole discretion, to cancel or suspend the Promotion (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Promotion (or any portion thereof). In the event of cancellation, Sponsor may elect to identify the Winner and award the applicable Prize by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation. Sponsor and MLB also reserve the right, in their sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Promotion.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT, AND SPONSOR, MLB AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

As a condition of entering this Promotion, each entrant agrees that all Claims shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party and (ii) settled by binding arbitration in Chicago, Illinois before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (b) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses. For New Jersey residents, the limitations set forth above may be inapplicable where attorneys' fees, court costs, or other damages are mandated by statute. These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of Illinois, U.S.A, applicable to contracts entered into and performed exclusively in that State.
