Eligibility: The Clean Up and Win Sweepstakes ("Sweepstakes") is open to legal residents of the United States including its commonwealths, territories and possessions (collectively referred to herein as "states"), who are eighteen (18) years of age or older (or of the legal age of majority in their state/territory of residence, whichever is older) as of the date of entry. Employees, officers and directors of MLB Advanced Media, L.P. ("MLBAM," or "Sponsor"), the other MLB Entities (as defined below), Church & Dwight Co., Inc. ("Church & Dwight"), teamDigital Promotions, Inc. ("Administrator"), and each of their respective parent companies, subsidiaries, affiliates, governors, related entities, partners, partnerships, principals, licensees, sponsors, and advertising/promotion agencies and all of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, "Released Parties"), and the immediate family members (parent, spouse, sibling, or child, and their respective spouses, regardless of where they reside) and those living in the same household of each (whether or not related) are not eligible to participate or win. The "MLB Entities" shall mean MLBAM, the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs ("Clubs"), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. This Sweepstakes is subject to all applicable federal, state, and local rules and regulations. Void where prohibited or restricted by law, rule or regulation.
Sweepstakes Period: Sweepstakes begins at 9:00:00 AM Eastern Time ("ET") on 3/28/19 and ends at 6:00:00PM ET on 8/31/19 ("Sweepstakes Period").
How To Enter: There are the two (2) following methods of entry: the Online Method of Entry and the Alternate, Mail-In Method of Entry outlined below.
- ONLINE: During the Sweepstakes Period, visit www.mlb.com/cleanupandwin on your computer or mobile device, click on the applicable Sweepstakes banners, buttons and/or links to access the online Sweepstakes registration page and then fully complete and submit the online entry form to receive one (1) entry. Entries must be received by 6:00:00PM ET on 8/31/19 to be eligible. If you choose to enter using your mobile device, standard data rates apply. Each wireless carrier's data rate plan may vary, and you should contact your wireless carrier for information on data rate plans and charges relating to your participation in this Sweepstakes; or 2)
- ALTERNATE, MAIL-IN METHOD OF ENTRY: To enter via mail-in method of entry instead of the online method described above and receive one (1) entry in the Sweepstakes, hand write your first and last name, street address, city, state, zip, daytime telephone number (area codes included), email address, and date of birth on a plain 3" x 5" piece of paper, and mail entry in a properly stamped #10 envelope to: Clean Up and Win Sweepstakes, MLB Advanced Media, L.P., 75 Ninth Avenue - 3rd Floor, New York, NY 10011. All mail-in entries must be post-marked by 8/31/19, and received by 9/7/19, to be eligible. Photocopied, computer generated facsimiles, mechanically reproduced, automated, mass entries and entries by any means which subvert the entry process will be void. Entries become property of the Sponsor and will not be acknowledged or returned.
Grand Prize and First Prize Winner Selection: One (1) potential First Prize winner will be selected in a random drawing on/about 6/17/19, from among all eligible entries received as of 11:59:59 PM ET on 6/15/19 and one (1) potential Grand Prize winner will be selected in a random drawing on/about 9/8/19, from among all eligible entries received. The random drawings will be conducted by Administrator, an independent sweepstakes management company. Subject to verification of eligibility and compliance with these Official Rules, the potential winners will be declared the official winners of the Sweepstakes. In the event that a potential winner declines the Prize, is not eligible to accept the Prize, does not comply with the terms of these Official Rules or is not available for any reason when called, his/her prize opportunity will be forfeited and Administrator, at its sole discretion and time permitting, may randomly select an alternate potential winner from among all remaining eligible entries received for the drawing at issue. Odds of winning will depend on the total number of eligible entries received for the applicable drawing. The decisions of MLBAM and/or Administrator, as applicable, will be final and binding in all matters relating to this Sweepstakes. Limit one (1) Prize per person, family or household. All non-winning eligible entries from one drawing will automatically carry-over to and remain eligible for the subsequent drawing.
Winner Notification: By entering, entrants agree to be bound by these Official Rules and to the decisions of the Sponsor and Administrator, which will be final and binding in all respects. The potential winners will be notified by telephone and/or email and/or mail and/or overnight mail and will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release within five (5) days of the date of issuance of notification. The potential winners will be required to complete an IRS Form W9 and provide their Social Security number for tax reporting purposes. The guest(s) of the winners (or such guest(s) parent/legal guardian if guest is under the age of majority in his/her state of legal residence) may be required to execute and return a Liability Release and (unless prohibited by law) Publicity Release prior to the issuance of travel documents. Non-compliance with the foregoing or with these Official Rules in any way, the inability to contact any potential winner (as specified above), any potential winner's rejection of his or her Prize or return of Prize or prize notification as non-deliverable may result in disqualification and, at Sponsor's discretion, the selecting of an alternate potential winner for the applicable Prize by random drawing from among all remaining eligible entries received for the drawing at issue.
Prizes: Two (2) Prizes will be awarded as follows:
One (1) Grand Prize: The Grand Prize drawing winner will receive a prize package consisting of round-trip coach class air transportation for winner and three (3) guests between a major U.S. airport nearest Grand Prize winner's residence in the U.S. and the host city of the World Series Game ("WS Host City"); two (2) night hotel accommodations (i.e. two (2) standard, double occupancy rooms) in the WS Host City at a hotel to be determined by Sponsor at its sole discretion; four (4) tickets for the Grand Prize winner and his/her three (3) guests for Game 1 of the 2019 World Series ("World Series Game"); admission to the World Series Game 1 pregame batting practice for Winner and his/her three (3) guests; and ground transportation in the WS Host City to/from the airport and the applicable hotel (collectively, the "Grand Prize"). (Approximate Retail Value ("ARV") of Grand Prize: $14,500.) Actual value of Grand Prize will vary depending on Grand Prize winner's city of departure and WS Host City (and no additional compensation or substitution will be awarded for difference in prize value). The exact nature and duration of the pregame batting practice viewing experience is in the sole discretion of Administrator and/or MLBAM and subject to availability. Tickets are subject to certain terms and conditions specified thereon. Seat locations at the World Series Game shall be determined in the sole and absolute discretion of Administrator and/or MLBAM, as applicable. Sponsor and Administrator, in their sole discretion, reserve the right to provide ground transportation in lieu of air transportation if Grand Prize winner resides within one-hundred (100) miles of the WS Host City (and no additional compensation or substitution will be awarded for difference in prize value). Trip must be taken on dates specified by Administrator or Grand Prize will be forfeited and, at Administrator's discretion and time permitting, an alternate potential winner may be randomly selected from among all remaining eligible entries received. If the designated World Series Game or any other Grand Prize-related activity(s) is canceled or postponed for any reason, the travel portion of the Grand Prize will be awarded less applicable canceled or postponed Grand Prize-related activity(s) and Administrator will substitute that activity(s) with an item(s)/activity(s) of comparable or greater value as determined solely by Administrator. Travel and hotel accommodation restrictions apply. Travel arrangements must be made through Administrator's agent and on a carrier of Administrator's choice. Grand Prize winner and his/her guests are responsible for obtaining all required travel documents prior to travel and must have no impediment to entering the WS Host City. Grand Prize winner and his/her guests must travel together on the same itinerary. The guests of the Grand Prize winner must be of legal age of majority in their states of residence (and at least eighteen (18) years of age) unless accompanied by a parent or legal guardian. Grand Prize winner may take a minor guest if he/she is the parent or legal guardian of such child or legal ward. All Grand Prize details are at Sponsor's and Administrator's sole discretion.
One (1) First Prize: The First Prize drawing winner will receive a prize package consisting of the following: round-trip coach class air transportation for winner and three (3) guests between a major U.S. airport nearest First Prize winner's residence in the U.S. and Cleveland, OH ("ASG Host City"); two (2) night hotel accommodations (i.e. two (2) standard, double occupancy rooms) in the ASG Host City at a hotel to be determined by Sponsor at its sole discretion; four (4) tickets for the First Prize winner and his/her three (3) guests for the 2019 MLB All-Star Game presented by Mastercard played in the ASG Host City at Progressive Field on 7/9/19 (the "All-Star Game"); a stadium tour for winner and his/her three (3) guests; and ground transportation in the ASG Host City to/from the airport and the applicable hotel (collectively, the "First Prize" and together with the Grand Prize, the "Prizes"). (ARV of First Prize: $10,500). Actual value of First Prize will vary depending on First Prize Winner's city of departure and ASG Host City (and no additional compensation or substitution will be awarded for difference in prize value). The exact nature and duration of the stadium tour is in the sole discretion of Administrator and/or MLBAM and subject to availability. Tickets are subject to certain terms and conditions specified thereon. Seat locations at the All-Star Game shall be determined in the sole and absolute discretion of Administrator and/or MLBAM, as applicable. Sponsor and Administrator, in their sole discretion, reserve the right to provide ground transportation in lieu of air transportation if First Prize winner resides within one-hundred (100) miles of the ASG Host City (and no additional compensation or substitution will be awarded for difference in prize value). Trip must be taken on dates specified by Administrator or First Prize will be forfeited and, at Administrator's discretion and time permitting, an alternate potential winner may be randomly selected from among all remaining eligible entries received for the First Prize drawing. The First Prize does not include tickets to any event or exhibition during the 2019 MLB All-Star Week other than as specifically set forth herein. If the designated All-Star Game or any other First Prize-related activity(s) is canceled or postponed for any reason, travel portion of the First Prize will be awarded less applicable canceled or postponed First Prize-related activity(s) and Administrator will substitute that activity(s) with an item(s)/activity(s) of comparable or greater value as determined solely by Administrator. Total ARV of all Prizes to be awarded: $25,000. Game Ticket Details: Major League Baseball games, events and exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as part of any Prize will govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played or held, as applicable, due to weather conditions, an act of God, an act of terrorism, civil disturbance or any other reason. Each winner and his/her guests agree to comply with all applicable ballpark and venue, as applicable, regulations in connection with the Prize. Sponsor and the applicable MLB Entities reserve the right to remove or to deny entry to any winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Released Parties will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition. Major League Baseball game, event and exhibition tickets awarded as prizes may not be resold or offered for resale or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and Prize forfeiture, and may invalidate the license granted by the game, event or exhibition ticket(s).
Miscellaneous: Unless permitted by Sponsor, no transfer, assignment, cash redemption, or substitution of Prize permitted; provided, however, Administrator may substitute any Prize (or any portion thereof) with a prize of comparable or greater value. Each winner is responsible for all income, federal, state and local taxes as well as any other costs or expenses associated with prize acceptance and use not specified herein as being provided, including, but not limited to, any/all transportation, passport (if applicable), baggage fees, meals, gratuities, travel insurance, and souvenirs. By participating, each entrant agrees to be bound by these Official Rules and agrees that (1) Sponsor, Administrator, Church & Dwight and each of their respective designees shall have the right and permission to use (unless prohibited by law) entrant's name, address (city and state of residence), photograph, voice and/or other likeness and prize information for advertising, promotional and/or trade and/or any other purpose in any and all media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation or consideration, permission or notification to entrants or any third parties; and (2) Released Parties, and each of their respective designees and assigns shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damages of any kind to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of participation in this Sweepstakes and/or the acceptance, possession, use or misuse of any Prize (or any portion thereof) and/or any travel or activity related thereto (including attendance at the game). Administrator and MLBAM reserve the right, in their sole discretion, to modify, terminate or suspend this Sweepstakes (or any portion thereof) for any reason including in the event viruses, worms, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Sweepstakes (or any portion thereof) or for any other reason and, in the event of termination at its discretion, select winners from those eligible, non-suspect entries received prior to event requiring such termination.
Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that 1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; 2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and 3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.
Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES IN ANY WAY, OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR, MLBAM AND THEIR RESPECTIVE AGENTS WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT AND RESERVE THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMISSIBLE BY LAW.
