2024 Boston Red Sox Ticket Terms and Conditions

The holder of this ticket, on their own behalf and on behalf of any accompanying minor (collectively, "Holder") agrees to the terms and conditions on this ticket and the rules and policies of the Boston Red Sox Baseball Club LP ("Club").

This ticket is a revocable license and does not confer any property rights or interests on the Holder. The Club reserves the right to revoke the license granted by this ticket at any time and for any reason in its sole discretion, including if any attempted transfer or resale of the ticket does not comply with Club policies. Holder agrees that any failure to abide by Club policies, including any resale price restrictions, provides an appropriate basis for the Club's revocation of this ticket (and all season tickets, where applicable) without notice or refund. In addition, the Club may refuse admission to, or eject from Fenway Park or JetBlue Park (collectively, and together with surrounding areas, including parking lots, referred to hereinafter as the "Ballpark"), any Holder without refund if the Holder fails to comply with any applicable Club policies applicable to conduct at the Ballpark or is deemed to be disorderly. Inappropriate behavior, abusive language, or interference with the play of the game may result in ejection from the Ballpark (without refund), arrest, forfeiture of ticket privileges and other legal action.

Holder voluntarily assumes all risk and danger of property loss and personal injury incidental to the game of baseball and related activities at the Ballpark, including specifically (but not exclusively) those relating to the structure and conditions of the Ballpark, and the danger of being injured by thrown or flying objects including bats and balls. To the extent permitted by law, the Holder irrevocably waives all claims of any nature against the Released Parties (as defined below), and releases and discharges the Released Parties from all claims, liability, costs, expenses, damages or losses (whether direct or consequential and whether arising under statute, from negligence, personal injury, death, property damage or otherwise) arising from or in connection with the game or event for which this ticket grants admission (collectively, "Event"), Fenway Park, JetBlue Park or any service provided or anything sold there, notwithstanding that it may have been caused by the negligent act or omission on the part of such Released Party or parties.

COVID-19 and Other Infectious and/or Communicable Diseases, Viruses, Bacteria or Illnesses:

COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES, AGREES TO (1) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF THE CLUB AND THE BALLPARK OWNER/OPERATOR.

Holder, on their behalf and on behalf of any Accompanying Parties (as defined below), acknowledges and agrees to comply with (1) all relevant policies and protocols issued by the Club and/or the Ballpark owner/operator, including, without limitation, any policies and protocols regarding security, bags, fan conduct and health and safety, currently available at WWW.REDSOX.COM/HEALTHANDSAFETY, all of which, due to the evolving nature of the COVID-19 pandemic, may continue to be updated from time to time between purchase of this ticket and the Event date, and (2) all current guidance of the Centers for Disease Control and Prevention and all applicable laws and policies of federal, state, city and local authorities. "Accompanying Parties" are used herein is any accompanying party for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable ticket terms).

FAN HEALTH PROMISE

Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder nor any Accompanying Party will attend the Event if within fourteen (14) days preceding the Event, they have:

(1) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR

(2) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR

(3) been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease.

A "Communicable Disease" as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.

RESALE TERMS AND POD INTEGRITY

Holder, on their behalf and on behalf of any Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase not specifically enumerated herein, including without limitation (1) terms that mandate or prescribe the quantity of tickets available to be purchased, (2) additional requirements regarding Accompanying Parties, and (3) terms regarding the resale or transfer of tickets.

ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES

Holder, on their behalf and on behalf of any Accompanying Parties, acknowledges and expressly assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Ballpark. By using this ticket, Holder is acknowledging and confirming, both now and in the future, that Holder understands and expressly assumes the risk that Holder and any Accompanying Party may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands that any interaction with the general public poses an elevated, inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19, that it cannot be guaranteed that Holder or any Accompanying Party will not be exposed, and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket that cannot be eliminated.

RELEASE OF LIABILITY AND COVENANT NOT TO SUE

HOLDER, ON BEHALF OF HOLDER, ANY ACCOMPANYING PARTY AND THEIR PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, NEXT OF KIN AND ANY OTHER PERSON OR ENTITY THAT MAY BE ENTITLED TO MAKE A CLAIM ON THEIR BEHALF, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, (A) USE OF THIS TICKET, (B) PRESENCE AT THE BALLPARK OR (C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (1) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (2) THE INHERENT RISKS ASSOCIATED WITH VISITING THE BALLPARK, INCLUDING, WITHOUT LIMITATION (X) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTY OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTY; AND (Y) ALL CLAIMS IN CONNECTION WITH THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO HOLDER OR ANY ACCOMPANYING PARTY. The "Released Parties" shall include (a) the Club and the other Major League Baseball Clubs ("Clubs"), MLB Advanced Media, L.P., the Office of the Commissioner of Baseball ("BOC"), Major League Baseball Properties, Inc., The MLB Network, LLC, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities (collectively the "MLB Parties"); (b) the owners and operators of the Ballpark, and event sponsors, contractors, vendors, operators, agencies and advertisers of the MLB Parties and Ballpark; (c) licensees, and retail, concession, broadcast and media partners of the MLB Parties; (d) press and other media; (e) vendors that may provide testing or medical services; (f) entities and individuals providing accommodation and transportation to or from the Ballpark; (g) other entities and individuals who enter the Ballpark; and (h) the respective parent, subsidiary, affiliated and related companies and officers, directors, employees, agents, licensees, contractors, sub-contractors, insurers, representatives, successors, assigns of each of the foregoing entities and persons.

[FOR CALIFORNIA RESIDENTS] YOU FURTHER ACKNOWLEDGE AND AGREE THAT YOU ARE FAMILIAR WITH AND DO HEREBY WAIVE THE PROVISIONS OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE (AND SIMILAR PROVISIONS OF OTHER JURISDICTIONS) WHICH PROVIDES AS FOLLOWS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."]

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of these terms shall not be affected thereby and shall remain valid and fully enforceable.

Holder is subject to the Ballpark rules and regulations including smoking prohibitions and restrictions on entry. Items that are prohibited upon entry at the Ballpark are listed at redsox.com. All patrons and their belongings are subject to search by Club security personnel prior to gaining entry to the Ballpark, and by tendering this ticket for entry into the Ballpark, the Holder consents to such search. Prohibited items may be confiscated. Failure to consent to such search will result in denial of entry into the Ballpark. Reentry is not permitted at any gate.

This ticket may not be used for advertising, promotion (including contests and sweepstakes), or other trade or commercial purposes without the express written consent of the Club. The Holder shall not transmit or aid in transmitting any information about the game to which it grants admission, including but not limited to any account, description, picture, video, audio, reproduction or other information concerning the game (the "Game Information"). The Club is the exclusive owner of all copyright and other proprietary rights in the game and the Game Information. The MLB Parties shall have the unrestricted right and license to use the Holder's likeness as included in any broadcast (live or recorded), telecast or photograph taken in connection with the game. The Holder grants permission to the MLB Parties to utilize the Holder's image or likeness incidental to any live or recorded video display or other transmission or reproduction, in whole or in part, of the game to which this ticket grants admission, for any purpose whatsoever including commercial purposes.

All sales are final. The Club's game schedule is subject to change for any reason at any time (including game dates, times, and opponents). If the game specified on this ticket is rescheduled for any reason including due to a rain-out, this ticket will be valid for the rescheduled game date and time, and the Holder will not be entitled to a ticket exchange or refund for any reason. Handling charges, convenience fees and other service charges are not refundable. If the game specified on this ticket is suspended for any reason, including due to weather conditions, and play is continued on a later date, this ticket will only be valid for the portion of the game played prior to the suspension in play, and the Holder will not be entitled to a ticket exchange or refund for any reason. The Club will not provide a ticket exchange or refund for any counterfeit tickets purchased in the secondary market, or for any lost or stolen tickets.

This ticket ("Ticket") evidences a revocable license ("License") to attend the event ("Event") described on the face hereof. The promoter or sponsoring organization ("Promoter") of the Event retains outright ownership of this Ticket. Physical possession of this Ticket is being temporarily provided to the holder ("Holder") to merely serve as evidence of the existence of the License.

RESALE OF THIS TICKET AT A PRICE GREATER THAN THE FACE VALUE IS ABSOLUTELY PROHIBITED. Holder agrees that violation of such restriction on resale shall result irreparable harm to Promoter for which damages shall be difficult or impossible to ascertain. Holder further agrees that a violation of such restriction is conclusive proof that there is an immediate danger that Holder will conceal or dispose of this Ticket and all other tickets for the Event or any of Promoter's other events in Holder's possession. Accordingly, in the event of a violation of such restriction on resale, Promoter shall have the right to obtain (i) an order of sequestration to reclaim possession of this Ticket and all other tickets for the Event or any of Promoter's other events which are then in the possession of the person(s) who so violated such restriction ("Violators") and (ii) an injunction or other equitable relief restraining Violators from subsequently violating such restriction on resale for any of the Promoter's events.

The License may be revoked with denial of admission to the Event (i) for any reason, at the Promoter's or facility's discretion, upon refund of the face value of this Ticket and (ii) for "cause" with no compensation or refund. As used in the preceding sentence, "cause" shall include, but is not limited to, disorderly conduct at the Event, engaging in description, photography or reproduction of any kind of the Event, violation of any of the Promoter's or facility's rules and regulation and selling or purchasing this Ticket at a price greater than the Face Value.

Tickets obtained from unauthorized sources may be lost, stolen or counterfeit and if so are void.

Holder voluntarily, assumes all risk and danger incidental to the Event whether occurring prior to, during or after same, including, without limitation, injury from any thrown objects, acts or omissions of others (including performers and participants), and actions or omissions of third parties over which Promoter has no right of control. Holder agrees that the facility, Promoter agents, and/or related persons are neither responsible, nor liable for any injuries expenses, claims or liabilities resulting from or related to such causes.

HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES, AGREES TO (1) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF THE PROMOTER AND THE FACILITY.

Holder grants permission to the facility and Promoter and their designees to utilize Holder's image or likeness in connection with any broadcast or other reproduction of this Event.

Additional convenience, handling and transaction fees may be added to ticket price. In case of cancellation of the Event, you must return this Ticket to the place of purchase within 30 days from the date of the Event for refund of ticket price only. This Ticket cannot be replaced if lost, stolen or destroyed. Tickets can be damaged by exposure to heat and sunlight. Valid only for the Event and seat for which it is issued. NO REFUNDS, NO EXCHANGES. EVENT DATE, SUPPORT ACTS AND TIME SUBJECT TO CHANGE. Not responsible for damage to, or articles left in, vehicles.
