Ticket Back Terms and Conditions

GENERAL NOTICE: Game time subject to change without notice. No refunds or exchanges will be made on this ticket except as provided hereon. Lost, stolen or counterfeit tickets will not be honored. This ticket is a revocable license and may be terminated in the sole discretion of Minnesota Twins, LLC (the “Club”) or Twins Ballpark, LLC by tendering the purchase price to the ticketholder (“Holder”). The Club reserves the right, without refund of any portion of the purchase price, to revoke the license granted by this ticket and refuse admission to or eject any Holder from Target Field or Hammond Stadium, as applicable, and surrounding areas, including parking lots (the “Ballpark”) for any reason, including conduct deemed improper by the Club. This ticket may not be used for advertising, promotions (contests, sweepstakes, giveaways) or other commercial or trade purposes without express written consent of the Club. This ticket may not be resold in a manner or at a price that violates any Federal, State or Local laws or regulations.

RAIN CHECK: Rules regulating cancellation or rescheduling of games and use of RAIN CHECKS will be posted on www.twins.com. If the game numbered hereon does not progress to or beyond a point of play constituting an MLB regulation game, this ticket must be retained and used as a RAIN CHECK. Premium ticket location RAIN CHECK policies may vary from those above and such ticketholders should retain this ticket and contact the Ticket Sales and Service department. This ticket is good only for this particular game and no part of the purchase price will be refunded by reason of failure of Holder to use it for this game. These policies may be amended by the Club at any time without notice.

WARNING: Holder assumes, for themselves as well as for each minor in the charge of such Holder (“Minors”), all risk and danger incidental to the game of baseball, whether occurring prior to, during, or subsequent to the playing of the game, including but not limited to the risk of injury by thrown or broken bats or fragments thereof, thrown or batted balls, or items thrown or injuries otherwise caused by other spectators, and other hazardous or potentially harmful activities incident to a sports event. Holder further agrees, for him/herself and Minors, that the Club, Twins Ballpark, LLC, the Minnesota Ballpark Authority, the Office of the Commissioner of Baseball, Major League Baseball Properties, Inc., MLB Advanced Media, L.P., The MLB Network, LLC, each of the Major League Baseball Clubs, and each of their respective subsidiaries, affiliates, agents, officers, employees and owners (collectively, the Club’s “Baseball Affiliates”), are not liable for any personal injuries (including death), property damage or any other loss resulting from such causes or as a result of attendance at the game. All persons and items entering the Ballpark are subject to inspection for security purposes. Certain items are not allowed into the Ballpark and may be confiscated by Club or Ballpark personnel. Holder consents, on behalf of both Holder and Minors, to an inspection of their person and any bags, clothing, or other articles for security purposes. No smoking is allowed at the Ballpark. Any Holder entering the playing field, disrupting a game or attempting physical contact with a game participant will be prosecuted to the full extent of the law.

IMPORTANT: By use of this ticket, Holder agrees on behalf of both Holder and Minors that: (a) they shall not transmit or aid in transmitting any information about the game to which it grants admission, including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the game (the “Game Information”); (b) the Club is the exclusive owner of all copyrights and other proprietary rights in the game and Game Information; and (c) the Club, the visiting club, the Baseball Affiliates, and each of their respective affiliates, players, coaches, officers, employees, owners, licensees and agents shall have the unrestricted right and license to use without compensation Holder’s and/or Minor’s name, likeness, image, voice, comments or other proprietary or public rights as included in any broadcast, telecast, photograph, video and/or sound recording taken in connection with or other transmission or reproduction of the game, in any and all media, worldwide, in perpetuity, in any subsequent commercial or promotional activity.

COVID-19 and Other Infectious and/or Communicable Diseases, Viruses, Bacteria or Illnesses:

AN INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER COMMUNICABLE DISEASES EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY MINORS AND OTHER ACCOMPANYING PARTIES, AGREES TO (1) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF THE CLUB AND THE BALLPARK OWNER/OPERATOR.

Holder, on their behalf and on behalf of any Minors and any other accompanying party for whom Holder retains a ticket to attend the Event (as defined below) with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable ticket terms) (“Accompanying Parties”), acknowledges and agrees to comply with (1) all relevant policies and protocols issued by the Club and/or the Ballpark owner/operator, including, without limitation, any policies and protocols regarding security, bags, mask and vaccination requirements, fan conduct and health and safety, currently available at www.twins.com/playitsafe all of which may continue to be updated from time to time between purchase of this ticket and the Event date, and (2) all current guidance of the Centers for Disease Control and Prevention and all applicable laws and policies of federal, state, city and local authorities (subsections (1) and (2) are, collectively, “Health and Safety Rules”).

“Event” as used herein is the game or event governed by these terms.

FAN HEALTH PROMISE

Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder, Minors and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder, Minors nor any Accompanying Party will attend the Event if, on the date of the Event, they are required or recommended by Health and Safety Rules to stay at home, quarantine and/or isolate (e.g., as a result of testing positive for, experiencing symptoms of, or being in direct contact with someone who tested positive for, COVID-19 or other Communicable Disease).

A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.

ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES

Holder, on their behalf and on behalf of any Minors and Accompanying Parties, acknowledges and expressly assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Ballpark. By using this ticket, Holder is acknowledging and confirming, both now and in the future, that Holder understands and expressly assumes the risk that Holder, Minors and any Accompanying Party may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands that any interaction with the general public poses an elevated, inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19, that it cannot be guaranteed that Holder, Minors or any Accompanying Party will not be exposed, and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket that cannot be eliminated.

RELEASE OF LIABILITY AND COVENANT NOT TO SUE

HOLDER, ON BEHALF OF HOLDER, MINORS, ANY ACCOMPANYING PARTY AND THEIR PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, NEXT OF KIN AND ANY OTHER PERSON OR ENTITY THAT MAY BE ENTITLED TO MAKE A CLAIM ON THEIR BEHALF, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES (AS DEFINED BELOW) WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, (A) USE OF THIS TICKET, (B) PRESENCE AT THE BALLPARK OR (C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (1) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (2) THE INHERENT RISKS ASSOCIATED WITH VISITING THE BALLPARK, INCLUDING, WITHOUT LIMITATION (X) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, MINORS, ANY ACCOMPANYING PARTY OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, MINORS OR ANY ACCOMPANYING PARTY; AND (Y) ALL CLAIMS IN CONNECTION WITH THE APPLICATION OF ANY HEALTH AND SAFETY RULES TO HOLDER, MINORS OR ANY ACCOMPANYING PARTY.

The “Released Parties” shall include (a) the Club and Club’s Baseball Affiliates (collectively, the “MLB Parties”); (b) the owners and operators of the Ballpark, and event sponsors, contractors, vendors, operators, agencies and advertisers of the MLB Parties and Ballpark; (c) licensees, and retail, concession, broadcast and media partners of the MLB Parties; (d) press and other media; (e) vendors that may provide testing or medical services; (f) entities and individuals providing accommodation and transportation to or from the Ballpark; (g) other entities and individuals who enter the Ballpark; and (h) the respective parent, subsidiary, affiliated and related companies and officers, directors, employees, agents, licensees, contractors, sub-contractors, insurers, representatives, successors, assigns of each of the foregoing entities and persons.

HOLDER FURTHER ACKNOWLEDGE AND AGREES THAT HOLDER IS FAMILIAR WITH AND DOES HEREBY WAIVE THE PROVISIONS OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE (AND SIMILAR PROVISIONS OF OTHER JURISDICTIONS) WHICH PROVIDES AS FOLLOWS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of these terms shall not be affected thereby and shall remain valid and fully enforceable.
