2023 T-Mobile Home Run Derby Bracket Challenge ("Contest")

Official Rules

NO PURCHASE, PAYMENT OR MOBILE DEVICE NECESSARY TO ENTER OR WIN. A PURCHASE, PAYMENT OR MOBILE DEVICE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

Eligibility: The Contest is open to legal residents of the United States including the District of Columbia and the US commonwealths, territories, and possessions (collectively referred to herein as "states"), and Canada (excluding Quebec) who are eighteen (18) years of age or older (or of the legal age of majority in their state/territory/province of residence, whichever is older) as of 7/05/23. Employees, officers and directors of MLB Advanced Media, L.P. ( “Sponsor”), the other MLB Entities (as defined below), T-Mobile USA, Inc. (“T-Mobile”), teamDigital Promotions, Inc. ("Administrator"), and each of their respective parent companies, subsidiaries, affiliates, governors, related entities, partners, partnerships, principals, licensees, sponsors, and advertising/promotion agencies and all of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, "Released Parties"), and the immediate family members (parent, spouse, sibling, or child, and their respective spouses, regardless of where they reside) and those living in the same household of each (whether or not related) are not eligible to participate or win. The "MLB Entities" shall mean Sponsor, the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities. T-Mobile is not responsible for the collection, submission or processing of entries, the administration or execution of the Contest, the selection of the winners, or any other aspect of this Contest. This Contest is subject to all applicable federal, state, territory, provincial and rules and regulations. Void in the Province of Quebec and where prohibited or restricted by law, rule or regulation.

Entry Period: Contest entry period begins approximately at 8:00:00 PM Eastern Time (“ET”) on 7/05/23 and ends at 8:00:00 PM ET on 7/10/23 (“Contest Entry Period”).

Player Replacements: Eight (8) MLB players will initially be selected by MLB to participate in the 2023 T-Mobile Home Run Derby (the “Home Run Derby”). In the event an MLB player drops out of the Home Run Derby prior to the start of the event, a replacement MLB player will be named by MLB. As soon as the replacement MLB player is named, he will also be inserted into the Contest, replacing the MLB player that dropped out. It is your responsibility to resubmit a new bracket if you believe any MLB player replacement will impact your selections for any matchup, so be alert! By way of example only, if you select Player A to win his first round matchup and then lose his second round matchup, and Player A is replaced by Player J prior to the start of the Home Run Derby, Player J will automatically replace Player A as your first round selection. You may resubmit a new bracket at any time prior to the end of the Contest Entry Period.

How To Enter: During the Contest Entry Period, visit www.mlb.com/bracketchallenge on your computer or mobile device, click on the applicable Contest banners, buttons and/or links to access the online Contest registration page and do all of the following to receive one (1) entry: (i) follow the instructions to complete the entry form (“Entry Form”) inclusive of registering to participate in the Contest; (ii) follow the instructions provided to complete the bracket by making your selections for which players will win each round of the Home Run Derby; (iii) pick the player who will hit the longest home run in the Home Run Derby, as measured by Statcast; (iv) pick the distance of the longest home run hit in the Home Run Derby, as measured by Statcast; and (v) select an answer to each of the following tiebreaker questions: (a) the total number of home runs hit in the entire Home Run Derby by all 8 MLB players (“Tiebreaker 1”); and (b) the total number of home runs hit by the winning MLB player in the entire Home Run Derby (i.e. all three rounds combined) (“Tiebreaker 2” and with “Tiebreaker 1” collectively, the “Tiebreakers”) ((i) through ((v) hereafter, each, an “Entry”). Entries must be received by 8:00:00 PM ET on 7/10/23 to be eligible. If you choose to enter using your mobile device, standard data rates apply. Each wireless carrier’s data rate plan may vary, and you should contact your wireless carrier for information on data rate plans and charges relating to your participation in this Contest.

Limit one (1) entry per person and per valid e-mail address. Additional entries submitted later in time by any person or e-mail address during the Contest Entry Period will void and replace any existing entry previously submitted by such person or e-mail address. In other words, the last entry you submit is the only valid entry for the Contest – all other entry(ies) you submit are void.

All information submitted by participants is subject to MLB’s Terms of Use (accessible at mlb.com/tou and Privacy Policy (accessible at: mlb.com/privacy). Participants must fully complete and submit all non-optional data requested on the Entry Form to be eligible. Incomplete entries are void. Participants will be given the option to receive (a) commercial e-mails from Sponsor and/or (b) mobile text messages and updates from Sponsor; however, eligibility to participate in the Contest is not dependent upon entrant’s consent to receive such e-mails and/or mobile text messages and updates and consenting to receive such e-mails and/or mobile text messages and updates does not impact entrant’s chances of winning. By participating in this Contest, each entrant gives their express permission to be contacted by the Administrator and/or Sponsor by telephone, e-mail and/or postal mail for Contest administration purposes. Released Parties are not responsible for lost, incomplete, late, delayed, inaccurate, illegible, misdirected, stolen, undelivered, postage due, or garbled entries, mail, or email; failures or malfunctions of phones, phone lines or telephone systems; lost entries, or transmissions; any error, omission, interruption, defect or delay in transmission, or communication; interrupted or unavailable network, server, Internet Service Provider (ISP), cable, satellite or other connections including those through and/or by any website; miscommunications, failed computer hardware or software or technical failures; non-delivery; misdirected, blocked, or delayed e-mail notifications; garbled, misrouted, jumbled, scrambled, delayed or misdirected transmissions; printing, typographical or other errors appearing within these Official Rules, in any Contest-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, telephone, electronic, mail or otherwise relating to or in connection with the Contest, or downloading of materials from or use of the website, including, without limitation, the cancellation or postponement of any Major League Baseball game, errors or problems which may occur in connection with the administration of the Contest, the processing of entries, or email or the announcement of the prize. Administrator and/or Sponsor, as applicable, reserve(s) the right, in their sole discretion, to void any and all entries of an entrant who Administrator and/or Sponsor, as applicable, believe has attempted to tamper with, corrupt, or impair the administration, security, fairness or proper play of this Contest or who is otherwise not in compliance with these Official Rules. The use of automated entry or similar devices to participate or subvert the entry process is prohibited and all entries through such devices are void. In the event of a dispute as to the identity of any entrant, such entrant will be deemed, as the person named on the applicable Entry Form.

Scoring: Scoring in the Contest is as follows: you will receive points ("Points") based on official results, as determined by Sponsor in its sole discretion, as follows:

  • Round 1 correct choice: Five (5) Points for each correct Round 1 choice.
  • Round 2 correct choice: Ten (10) Points for each correct Round 2 choice
  • Home Run Derby Champion correct choice: Fifteen (15) Points for the correct Home Run Derby champion choice
  • Correct choice of the player who will hit the longest home run in the Home Run Derby, as measured by Statcast: Ten (10) Points
  • Correct choice of the distance of the longest home run hit in the Home Run Derby, as measured by Statcast: Thirty-five (35) Points

A perfect score would be one hundred (100) Points if you correctly select (a) the finish in all three (3) rounds of the Home Run Derby, (b) the player who will hit the longest home run in the Home Run Derby, as measured by Statcast, and (c) the distance of the longest home run hit in the Home Run Derby, as measured by Statcast.

NOTE: Only home runs officially scored as home runs in the Home Run Derby will be counted for purposes of this Contest.

Grand Prize Winner Selection: The eligible participant, if any, to accumulate one hundred (100) Points, as determined and verified by Sponsor in its sole and absolute discretion, will be deemed the potential winner of the Grand Prize (as defined below). In the event of a tie for the Grand Prize, the Tiebreakers will be used among the remaining tied participants to determine one (1) Grand Prize winner (as explained in the “Tiebreakers” section below). Subject to verification of eligibility and compliance with these Official Rules, the potential Grand Prize winner will be declared the official winner of the Grand Prize. In the event that the selected potential Grand Prize winner declines the Grand Prize, is not eligible to accept the Grand Prize, does not comply with the terms of these Official Rules or is not available for any reason when called, their Grand Prize opportunity will be forfeited and Administrator, at its sole discretion, may notify an alternate potential Grand Prize winner, if any, that accumulated one hundred (100) Points, as determined and verified by Sponsor in its sole and absolute discretion.

First Prize Winner Selection: If no participant accumulates one hundred (100) Points, as determined and verified by Sponsor in its sole and absolute discretion, the eligible participant, if any, who accumulates the most Points as determined by Sponsor in its sole and absolute discretion will be deemed the potential winner of the First Prize (as defined below). In the event of a tie for the First Prize, the Tiebreakers will be used among the remaining tied participants to determine one (1) First Prize winner (as explained in the “Tiebreakers” section below). Subject to verification of eligibility and compliance with these Official Rules, the potential First Prize Winner will be declared the official winner of the First Prize. In the event that the selected potential First Prize winner declines the First Prize, is not eligible to accept the First Prize, does not comply with the terms of these Official Rules or is not available for any reason when called, their First Prize opportunity will be forfeited and Administrator, at its sole discretion and time permitting, may select and notify an alternate potential First Prize winner, if any, in accordance with these Official Rules.

Tiebreakers: In the event of a tie for the Grand Prize or First Prize, the Tiebreakers will be used among the remaining tied participants in the following order:

  1. Tiebreaker 1 will be applied first. The entrant coming closest to picking the total number of home runs hit in the entire Home Run Derby will be deemed the winner of Tiebreaker 1. For the avoidance of doubt, (a) all home runs hit in any tiebreaking “swing-off” rounds will count toward this final total number of home runs; and (b) it does not matter if the pick is above or below the total number of home runs hit. For example, if 200 home runs are hit in the entire Home Run Derby by all 8 MLB players, and one tied participant picks 198 and another tied participant selects 201 home runs, the participant who picked 201 home runs would be deemed the winner of Tiebreaker 1.
  2. If there is still a tie after Tiebreaker 1 is applied, Tiebreaker 2 will be applied. The participant coming closest to picking the total number of home runs hit by the winning MLB player in the entire Home Run Derby will be deemed the winner of Tiebreaker 2. For the avoidance of doubt, (a) all home runs hit in any tiebreaking “swing-off” rounds will count toward this final total number of home runs; and (b) it does not matter if the pick is above or below the total number of home runs hit. For example, if 50 home runs are hit by the winning MLB player in the entire Home Run Derby, and one tied participant selects 49 home runs and another tied participant selects 53 home runs, the participant who picked 49 home runs would be deemed the winner of Tiebreaker 2.
  3. In the event that the tie for the Grand Prize is still not broken after applying the Tiebreakers above, the Grand Prize will be divided evenly among all remaining tied, eligible entrants.
  4. In the event that the tie for the First Prize is still not broken after applying the tiebreakers above, Sponsor will administer a timed baseball trivia quiz, testing the tied participants' knowledge of Major League Baseball, without assistance of any kind, until the tie is broken.

Winner Notification: By entering, participants agree to be bound by these Official Rules and to the decisions of the Sponsor and Administrator, which will be final and binding in all respects. The potential winner will be notified by telephone and/or email and/or mail and/or overnight mail and will be required to execute and return an Affidavit of Eligibility (or, if a resident of Canada, a Declaration of Eligibility), Release of Liability and (where legal) Publicity within two (2) days of date of issuance of notification. The potential Grand Prize winner will be required to complete an IRS Form W9 and provide his or her Social Security number for tax reporting purposes and/or other identification to Sponsor. The potential First Prize winner may be required to complete an IRS Form W9 and provide his or her Social Security number for tax reporting purposes and/or other identification to Sponsor. Non-compliance with the foregoing or with these Official Rules in any way, the inability to contact any potential winner (as specified above), any potential winner’s rejection of his or her prize or return of the prize or prize notification as non-deliverable may result in disqualification and, at Sponsor’s discretion, the awarding of the applicable prize to an alternate potential winner as set forth above.

Prizes: One (1) Grand Prize: The Grand Prize winner, if any, will receive $100,000 USD (the "Grand Prize"). Approximate Retail Value ("ARV") of the Grand Prize: one hundred thousand U.S. dollars (USD $100,000). All Grand Prize details are at Sponsor’s sole discretion. IN NO EVENT WILL MORE THAN ONE (1) GRAND PRIZE BE AWARDED.

NOTE: GRAND PRIZE WILL ONLY BE AWARDED IF AN ELIGIBLE PARTICIPANT ACCUMULATES ONE HUNDRED (100) POINTS, AS DETERMINED BY SPONSOR, IN ACCORDANCE WITH THESE OFFICIAL RULES.

One (1) First Prize: One (1) First Prize winner, if any, will receive a prize package consisting of round-trip coach class air transportation for winner and one (1) guest between a major airport nearest First Prize winner’s residence in the U.S. and the host city of the World Series Game (defined below) (“WS Host City”); two (2) night hotel accommodations (i.e. one (1) standard, double occupancy rooms) in the WS Host City at a hotel to be determined by Sponsor at its sole discretion; and two (2) tickets for the First Prize winner and their guest for Game 1 of the 2023 World Series (“World Series Game”) (collectively, the “First Prize”). (Approximate Retail Value (“ARV”) of First Prize: $6,500.) Actual value of First Prize will vary depending on First Prize winner’s city of departure and WS Host City (and no additional compensation or substitution will be awarded for difference in prize value). The exact nature and duration of the pregame batting practice viewing experience is in the sole discretion of Sponsor and subject to availability. Tickets are subject to certain terms and conditions specified thereon. Seat locations at the World Series Game shall be determined in the sole and absolute discretion of Sponsor. Sponsor and Administrator, in their sole discretion, reserve the right to provide ground transportation in lieu of air transportation if First Prize winner resides within one hundred (100) miles of the WS Host City (and no additional compensation or substitution will be awarded for difference in prize value). Trip must be taken on dates specified by Administrator or First Prize will be forfeited and, at Administrator’s discretion and time permitting, an alternate potential winner may be randomly selected from among all remaining eligible entries received. If the designated World Series Game or any other First Prize-related activity(s) is canceled or postponed for any reason, the travel portion of the First Prize may be awarded less applicable canceled or postponed First Prize-related activity(s) at Sponsor’s sole discretion and if possible, Administrator will substitute that activity(s) with an item(s)/activity(s) or cash equivalent of comparable or greater value as determined solely by Administrator. Travel and hotel accommodation restrictions apply. Travel arrangements must be made through Administrator’s agent and on a carrier of Administrator’s choice. First Prize winner and their guest are responsible for obtaining all required travel documents prior to travel and must have no impediment to entering the WS Host City. First Prize winner and their guest must travel together on the same itinerary. First Prize winner may take a minor guest if he/she is the parent or legal guardian of such child or legal ward.

All First Prize details are at Sponsor’s and Administrator’s sole discretion. IN NO EVENT WILL MORE THAN ONE (1) FIRST PRIZE BE AWARDED.

NOTE: THE FIRST PRIZE WILL ONLY BE AWARDED IF (A) NO PARTICIPANT ACCUMULATES ONE HUNDRED (100) POINTS, AND (B) AN ELIGIBLE PARTICIPANT ACCUMULATES FIFTY-FIVE (55) OR MORE POINTS.

Prize Conditions: No transfer, assignment, cash redemption, or substitution of prize permitted except at Sponsor's sole and absolute discretion. The winner is fully responsible for any and all applicable federal, state, territory, provincial and local taxes (including income and withholding taxes) as well as any other costs or expenses associated with First Prize acceptance and use not specified herein as being provided, including, but not limited to, lodging, transportation costs, meals, gratuities and any and all expenses incurred by accepting the prize. The Grand Prize will be awarded in the form of checks in U.S. dollars as one (1) lump sum. Odds of winning depend on the actual number of eligible entries received as of the conclusion of the Contest Entry Period.

Additional Conditions for First Prize: Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see mlb.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Winner’s guest must be of legal age of majority in their jurisdiction of residence unless accompanied by a parent or legal guardian. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Winner and their guest agree to comply with all applicable ballpark and venue regulations in connection with the prize. Sponsor and the other MLB Entities reserve the right to remove or to deny entry to the winner and/or their guest who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Released Parties will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game/event/exhibition ticket.

Miscellaneous: The decisions of Sponsor and/or Administrator, as applicable, will be final and binding in all matters relating to this Contest. By participating, each entrant agrees to be bound by these Official Rules, including all entry requirements, and MLB’s Privacy Policy and Terms of Use; and agrees that (1) Sponsor, Administrator, and each of their respective designees shall have the right and permission to use (unless prohibited by law) entrant’s name, address (city and state/territory/province of residence), photograph, voice and/or other likeness and prize information for advertising, promotional and/or trade and/or any other purpose in any and all media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation or consideration, permission or notification to participants or any third parties; and (2) Released Parties, Apple, Inc., Facebook, Inc., and each of their respective designees and assigns shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damages of any kind to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of participation in this Contest and/or the acceptance, possession, use or misuse of the Grand Prize (or any portion thereof) and/or any travel or activity related thereto (including attendance at the World Series Game). Administrator and Sponsor reserve the right, in their sole discretion, to modify, terminate or suspend this Contest (or any portion thereof) for any reason including in the event viruses, worms, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Contest (or any portion thereof) or for any other reason and, in the event of termination at its discretion, select the potential winner from among those eligible, non-suspect entries received prior to event requiring such termination.

Arbitration: As a condition of participating in this Contest, each entrant agrees that (1) any and all disputes, claims, controversies, or causes of action arising out of or relating to this Contest or any prizes awarded (each, a "Claim") shall be (a) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party and (b) settled by binding arbitration in New York County, New York before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (2) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses. For New Jersey residents, the limitations set forth above may be inapplicable where attorneys' fees, court costs, or other damages are mandated by statute. These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of New York, U.S.A, applicable to contracts entered into and performed exclusively in that State.

Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST IN ANY WAY, OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS CONTEST, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR, SPONSOR AND/OR THEIR RESPECTIVE AGENTS WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT AND ADMINISTRATOR, SPONSOR AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMISSIBLE BY LAW.
