Faces of Freedom Official Contest Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPACT YOUR OPPORTUNITY TO WIN. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.
The object of the Contest is to submit an original essay (the “Submission”) most strongly conveying how an eligible* active or retired service person you know (“Nominee”) has shown, or is showing, tremendous courage, strength, and patriotism in the line of duty. Staff members of Texas Rangers Baseball Foundation (the “Judges”) will select the eighteen (18) highest scoring Submissions (i.e., three (3) per Judging Date) in accordance with these Official Rules and based upon criteria set forth in the Judging section below to determine the Winners (defined below).
ELIGIBILITY
The Contest is open only to legal residents of Texas who are nineteen (19) years of age or older and have a valid email address at the time of entry. Employees, officers and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of the Texas Rangers Baseball Foundation (“Sponsor”), Rangers Baseball LLC, the other MLB Entities (as defined below), American Airlines (“American") and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other entities associated with the Contest (collectively, “Ineligible Individuals”) are not eligible to participate or win a Prize (as defined below). “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, the Major League Baseball Clubs (“Clubs”), MLB Advanced Media, L.P. (“MLB”), Major League Baseball Properties, Inc., The MLB Network, LLC, each of their parent, subsidiary, affiliated, and related entities, any entity which, now or in the future, controls, is controlled by or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities. The Contest is subject to all applicable laws, rules, and regulations. Void outside Texas and where prohibited or restricted by law, rule or regulation.
ENTRY PERIOD
The Contest will be divided into multiple entry periods (each, an “Entry Period”) as set forth in the table below. All Entry Period times are based on Central Time (“CT”). All non-winning eligible entries from one Judging Date will automatically carry-over to, and remain eligible for, subsequent Judging Date(s), if any.

HOW TO ENTER
During an Entry Period, go to http://texasrangers.com and click on the Contest banners, buttons and/or links to access the entry form for the Contest. Participants must read and consent to these Official Rules during the Contest entry process. Participants must also provide their complete name, date of birth, address, city, state, ZIP/postal code, telephone number, email address, the Submission in accordance with the Submission Requirements (set forth below), and the Content Restrictions (set forth below), and any other required information noted as such on the entry form. All Submissions become the property of Sponsor and will not be acknowledged or returned.
Self-nominations will be accepted. To be eligible, the Nominee must (a) be a legal resident of Texas; (b) be at least nineteen (19) years of age; (c) be currently living; (d) not be an Ineligible Individual; and (e) if the Nominee is not a self-nomination, be someone the person submitting the Submission (“*Nominator**”) personally knows. In order to submit a Submission and any personally identifiable information of Nominee in connection with the Contest entry process, Nominator must have permission from the Nominee. Sponsor, in its sole discretion, may require Nominator to verify such permission before awarding a Prize.
By fully completing and submitting all required information as directed, you will be entered in the Contest and be a “Participant.” Participants may be given the option to receive (a) commercial emails from American, Sponsor, and/or MLB and/or (b) mobile text messages and updates from American, Sponsor and/or MLB; however, eligibility to participate in the Contest is not dependent upon Participant’s consent to receive such emails and/or mobile text messages and updates and consenting to receive such emails and/or mobile text messages and updates will not impact Participant's opportunity to win. Standard messaging rates apply to mobile text messages and updates. Check with your mobile service provider for more information. All information submitted online by Participants is subject to, and will be treated in a manner consistent with, MLB’s Terms of Use (accessible at: mlb.com/tou) and Privacy Policy (accessible at mlb.com/privacy). Further, information shared with American pursuant to a Participant’s exercise of the option to receive commercial emails and/or text messages from American is subject to, and will be treated in a manner consistent with, American’s Privacy Policy accessible at https://www.aa.com/i18n/customer-service/support/privacypolicy.jsp.
SUBMISSION REQUIREMENTS
Participants must submit their Submission as directed during the Contest entry process. By submitting a Submission, each Participant represents and warrants that his/her Submission is an original work of authorship and that, as of the date of Submission, he/she owns all right, title, and interest in the Submission, and has all necessary rights in the Submission in order to submit it in accordance with these Official Rules, including, without limitation, permission from the Nominee when applicable. Submissions must be in the English language and must not exceed one thousand (1000) words in length.
Online entry only. No other method of entry will be accepted. Participants are solely responsible for Internet connectivity, software and/or hardware that may be required in order to create and/or submit any Submission.
All entries must include a valid email address for the Participant. Participants must fully complete and submit all non-optional data requested on the online entry form to be eligible. Incomplete and/or inaccurate entries are void. Limit one (1) entry per person/email address/household. In case of multiple entries received from any person or email address or household, only the first entry received from such person or email address, or household will be considered. Participants who do not indicate their agreement to these Official Rules will not have their Submissions reviewed. Submissions that do not comply with the Submission Requirements, the Content Restrictions or otherwise with these Official Rules will be void, eliminated and not eligible for consideration.
JUDGING
The Judges will judge all eligible Submissions received as of the Judging Date Deadline (as outlined above) to determine the three (3) most compelling Submissions for such Judging Date based on the following judging criteria: Conveyance of Nominee’s strength, courage and patriotism in the line of duty (60%); originality/creativity (20%); and quality of writing (20%). On or about the Judging Date set forth in the table above, the three (3) highest scoring Submissions for the applicable Judging Date as determined by the Judges in their sole discretion will each be deemed a winning Submission (each, a “Winning Submission” and collectively, the “Winning Submissions”). Subject to verification of eligibility and compliance with the terms of these Official Rules, each eligible Participant who submitted a Winning Submission, as determined by the Judges, will be declared an official winner of the Contest (each, a “Winner” and collectively, the “Winners”). In the event of a tie, the score for conveyance of Nominee’s strength, courage and patriotism in the line of duty will be used as the tiebreaker. In the event one of the three (3) most compelling Submissions for a given Judging Date is submitted on behalf of a Nominee (or by a Nominee in the case of a self-nomination) who was the subject of a Winning Submission in a previous Entry Period, the Participant who submitted such Submission will not be eligible to be named a Winner and the next highest scoring Submission will be named one of the Winning Submissions (subject to verification of eligibility and compliance of these Official Rules) for that current Entry Period. If an insufficient number of Submissions, as determined by Sponsor in its sole discretion, have been received by any given Judging Date, no Winning Submission will be chosen during such Entry Period, all Submissions eligible for Judging in such Entry Period will roll over into the next Entry Period, and the Prizes applicable to such Entry Period will likewise roll over to the next Entry Period.
PRIZES
Up to eighteen (18) Prizes To Be Awarded (i.e., three (3) per Judging Date, subject to sufficient Submissions being entered and further subject to roll over to the next Judging Date if an insufficient number of Submissions are received at the end of an Entry Period, as set forth above). Each Winner will receive (i) four (4) tickets for such Winner, Nominee and two (2) guests (or if such Winner’s Submission included a self-nomination, three (3) guests) (whether two (2) or three (3), collectively referred to herein as, the “Guests”) for one (1) of the following Texas Rangers 2024 regular season home games played at Globe Life Field in Arlington as determined by Sponsor (April 7, April 27, April 28, May 18, May 19, June 8, June 9, June 22, June 23, July 6, July 7, July 20, August 4, August 17, August 18, September 1, September 8, September 21, each in calendar year 2023 and subject to change) (the “Game”), (ii) the opportunity for such Winner to be recognized in-park during the Game by the public address announcer and on the video board, in the Texas Rangers game program, if applicable, and online at texasrangers.com/freedom, (iii) one (1) goody bag for such Winner containing Texas Rangers items determined by Sponsor at its sole discretion ((i), (ii), and (iii) collectively, the “Globe Life Field Experience”), and (iv) the opportunity for such Winner and one (1) guest to go on a trip to Washington D.C. on a to be determined date in the calendar year 2024 to be selected by Rangers for the Faces of Freedom recognition event (exact details of the event to be determined by Sponsor and American at their sole discretion) (the “DC Trip”) (the Globe Life Field Experience and the DC Trip collectively, the “Prize(s)”) (Approximate Retail Value of each Globe Life Field Experience: $200; Approximate Retail Value of each DC Trip: $2,100.00; collectively, $2,300.00.) DC Trip is a three (3) day, two (2) night trip and includes (a) 50,000 AAdvantage Miles to cover roundtrip coach air travel on American Airlines® between Dallas/Fort Worth International Airport (“DFW”) and Ronald Reagan Washington National Airport (subject to Air Travel Restrictions set forth below) for such Winner and Nominee (or if such Winner’s Submission included a self-nomination, one (1) guest); (b) two (2) night hotel stay in Washington, D.C. (one (1) standard, room; double occupancy), to be arranged by Sponsor; (c) entry for such Winner and Nominee (or if such Winner’s Submission included a self-nomination, his/her one (1) guest to select D.C. attractions determined by Sponsor in Sponsor’s sole discretion, (d) two (2) meals valued up to a maximum of $75.00 each for such Winner and Nominee (or if such Winner’s Submission included a self-nomination, his/her one (1) guest, (e) a $300 stipend, and (f) a “Departure Dinner” prior to the DC Trip at a location to be determined by Sponsor in its sole discretion. TRANSPORTATION TO/FROM DFW FOR DEPARTURE FOR AND UPON ARRIVAL FROM DC TRIP IS NOT INCLUDED. TRANSPORTATION TO/FROM THE DEPARTURE DINNER IS NOT INCLUDED. Sponsor and American shall determine the travel dates at their sole discretion. Travel and hotel accommodation restrictions apply. The exact nature and duration of the behind-the-scenes tour and in-park (and/or online) recognition shall be determined by Sponsor in its sole discretion and subject to availability.
Air Travel Restrictions: Note that AAdvantage account is required to claim this portion of the Prize. If a Winner is not an AAdvantage® member, they may join at no cost online at www.aa.com/loyalty/enrollment/enroll or by calling the AAdvantage® membership desk at 1-800-882-8880. AAdvantage® terms and conditions apply.
If AAdvantage® miles are redeemed for air transportation, the following additional terms and conditions apply. Each Winner is responsible for the full cost of transportation to and from their departure and arrival city. Each Winner is responsible for any and all applicable fees, service charges, surcharges or passenger facility charges and all insurance costs, federal, state, local and foreign taxes, if any, gratuities, meals, incidentals and any other unspecified expenses associated with acceptance or use of the Grand Prize. AAdvantage® flight awards are subject to, and the Sponsor will be responsible for, the September 11th Security Fee of $5.60 per one-way trip, per passenger, applicable departure taxes, federal inspection fees, passenger facility charges of up to $18.00, depending on itinerary, and any other taxes and fees imposed by a government entity (U.S. or foreign) of up to $240 based on destination; total may vary slightly based upon currency exchange rate at time of purchase, as well as any fees or surcharges (including fuel surcharges) imposed by the carrier. U.S. government excise tax is a user tax to pay for airport construction and airway safety and operations. If ticketing is less than 21 days prior to departure, Sponsor will be responsible for a $75.00 expedite charge will apply (waived for AAdvantage® Executive Platinum, AAdvantage® Platinum and AAdvantage® Gold members using miles from their account). The Sponsor will also be responsible for a ticketing service charge of up to $40.00 will apply when ticketing via Reservations, American Airlines Travel Center or an Airport Ticket Office. (The ticketing service charge is waived for involuntary changes, reissued tickets, AAdvantage® award tickets issued within 21 days of travel and an expedite charge has been collected, AAirpass® tickets, Government/military fare tickets, and prepaid tickets.) Some of these taxes, fees and other amounts may be due upon booking/ticketing the AAdvantage® award travel.
American Airlines AAdvantage® miles will be credited to the AAdvantage® account of each Winner or may be provided in the form of a Certificate as set forth below, who must provide a valid AAdvantage® membership number in order to receive the mileage credit. American Airlines AAdvantage® miles awarded in this Contest will not count toward elite status qualification, AAdvantage Million Milersm status or any other promotional benefit that American Airlines may offer in the AAdvantage® program. Winners who are not AAdvantage® members may join at no cost online at www.aa.com and click on AAdvantage® or by calling the AAdvantage® membership desk at 1-800-882-8880. The credited miles may thereafter be redeemed in any manner consistent with the AAdvantage® program Terms and Conditions, which are subject to change at any time without notice and can be found at www.aa.com/aadvantage when you click on Program Details and then click on AAdvantage® Terms and Conditions. Determination of income tax liability on AAdvantage® travel awards is the responsibility of each Winner. American Airlines may, among other things, (i) withdraw, limit, modify, or cancel any award; (ii) change program benefits, mileage levels, participant affiliations, conditions of participation, rules for earning, redeeming, retaining or forfeiting mileage credit, or rules for the use of travel awards; or (iii) add travel embargo dates, limit the number of seats available for award travel (including, but not limited to, allocating no seats on certain flights) or otherwise restrict the continued availability of travel awards or special offers. American Airlines reserves the right to change the AAdvantage® program and its terms and conditions at any time without notice, and to end the AAdvantage® program with six months notice. Neither Sponsor nor American Airlines or its Airline Associates are liable for any expense incurred as a consequence of a flight cancellation or flight delay. Travel is subject to availability and certain other restrictions, which are subject to change in the sole discretion of Sponsor. Flight schedules subject to change without notice. If AAdvantage® miles are sent to a Winner in the form of a Certificate: Certificate is not redeemable for cash. Certificate may not be transferred, purchased, sold or bartered. Only original Certificates will be honored. Certificate is void if reproduced, altered, counterfeited, obtained or used improperly. Lost, stolen, damaged or destroyed Certificates will not be replaced by American Airlines. Determination of income tax liability on mileage Certificates and AAdvantage® travel awards is the responsibility of the holder. The holder of the Certificate has only the limited right to surrender same to American Airlines in accordance with rules and conditions stated herein for crediting of mileage by American Airlines and subject to all AAdvantage® Terms and Conditions. Certificate must be deposited online at www.depositAAmiles.com to the AAdvantage® account of the applicable Winner. Mileage credit can be deposited only once on or before the expiration date. SPECIAL CAUTION: COVID-19: Each Winner understands and agrees that travel is inherently dangerous due to the COVID-19/Coronavirus pandemic which is a highly contagious and communicable disease; and, to the fullest extent permitted by law, each assumes all risks of illness or injury which may arise directly or indirectly, in whole or in part, from prize related travel and activities. Additionally, each Winner understands and agrees that, in response to economic and/or social conditions caused by COVID-19/Coronavirus, Sponsor and/or prize provider may be compelled to cancel the trip and/or the Sweepstakes with little (if any) advanced notice.
NOTIFICATION
Each potential winner will be notified by email and/or telephone by Sponsor and/or MLB and may (in Sponsor’s discretion) be confirmed by postal mail, return receipt (the “Prize Notification”). In the event that any potential winner does not respond to such Prize Notification within three (3) days of the date of issuance or declines the Prize for any reason, a disqualification will result, the Prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate potential winner may be chosen based on the judging criteria from among all remaining eligible Submissions received as of the applicable Judging Date Deadline. Each potential winner may be required to submit his/her valid social security number and/or other identification to Sponsor and each potential winner and, if the Submission was not a self-nomination, the Nominee nominated by such potential winner’s Submission, may be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability, and, unless prohibited by law, Publicity, within three (3) days of the date of issuance. Failure to submit any identification required by Sponsor or to return any required documents within the specified time period, the return of such documents, the Prize (or any portion thereof) or Prize Notification as undeliverable, or noncompliance with these Official Rules may result in disqualification, Prize forfeiture and, at Sponsor’s sole discretion and time permitting, may cause an alternate potential winner to be chosen based on the judging criteria from among all remaining eligible Submissions received as of the applicable Judging Date Deadline.
PRIZE CONDITIONS
All Prize details, including, without limitation, the exact nature and duration of the tour, each Winner’s in-park/website/program recognition and Faces of Freedom recognition event, shall be determined in the sole and absolute discretion of Sponsor and subject to availability. Payments of all federal, state, and local taxes (including income and withholding taxes) are solely the responsibility of each individual Winner. Each Winner will be required to sign an IRS Form W-9 with such Winner’s full social security number or the equivalent. Failure to submit a Form W-9 upon request will result in forfeiture of the Prize. Winnings of $600 or more will be reported by Sponsor to the IRS. All costs and expenses associated with the Prize acceptance and use not specified herein as being provided including, but not limited to, lodging (except with respect to the DC Trip), transportation costs (or in the case of the DC Trip, ground transportation costs), additional meals, insurance, gratuities and other expenses incurred by accepting the Prize are the sole responsibility of each individual Winner. The Prizes are non-transferable and non-assignable, with no cash redemptions except at Sponsor's sole and absolute discretion. Sponsor reserves the right to substitute any Prize (or any portion thereof) with a prize of comparable or greater value at its sole and absolute discretion. Limit one (1) Prize per person, family, or household. TRANSPORTATION TO/FROM THE GAME AND LODGING NOT INCLUDED; TRANSPORTATION TO/FROM THE DEPARTURE DINNER IS NOT INCLUDED; Transportation to and from DFW AIRPORT for DEPARTURE FOR, AND UPON ARRIVAL FROM, the DC trip is not included. Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see texasrangers.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Each Winner’s guest(s) must be of legal age of majority in his/her(their) jurisdiction(s) of residence unless accompanied by a parent or legal guardian. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Each Winner and his/her guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the prize; see texasrangers.com/ballpark for details. Sponsor and the MLB Entities reserve the right to remove or to deny entry to any Winner and/or his/her guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Released Parties (as defined below) will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture and may invalidate the license granted by the game/event/exhibition ticket. Participation in the prize event is subject to each Winner’s (and guest’s) consent to and compliance with all health and safety policies of the MLB Entities.
CONTEST ADMINISTRATION
Sponsor will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by Sponsor regarding the Contest shall be final and binding in all respects.
CONSENT, LICENSE AND RELEASE
In exchange for the opportunity to participate in this Contest, and the possible use of Participant’s Submission and/or the possible appearance of Participant’s in an audio, visual and/or multimedia production, the receipt of which opportunities shall be sufficient consideration for this Consent, License, and Release, each Participant does hereby:
- consent to the collection by Sponsor and MLB (or their designees) of his/her personal information, including without limitation name, date of birth, address, telephone number(s) and email address(es) (the “Personal Information”) in connection with the Submission;
- grant to Sponsor, MLB and each of their respective designees the perpetual and unlimited right and license to use, edit, modify, duplicate and/or create derivative works from his/her Submission throughout the world via any media now known or hereafter developed, without limitation and without notice or payment of any compensation to the Participant or his/her heirs and successors, except where prohibited by law, including, but not limited to, the right for Sponsor and/or MLB to publish, display, broadcast, distribute, reproduce, perform, create derivative works from and otherwise use and exploit the Submission via the Internet or any other interactive media, in stadium, on television, and in print, (i) on its own or as part of any audiovisual or other production; (ii) to advertise any products, programming or services of the MLB Entities or for any other advertising, marketing, publicity and promotional purposes; and (iii) for any other purpose whatsoever;
- agree that the foregoing license includes without limitation the right (i) to use his/her name (and any other Personal Information that may be incorporated into the Submission), likeness, image, voice, statements, appearance, and performance as embodied in the Submission in whole or in part, for advertising, promotional, and trade purposes in conjunction with this and similar promotions in any and all media now known or hereafter developed, worldwide, in perpetuity, without notice and without further consideration or compensation, except where prohibited by law; (ii) to edit, alter, distort, add to, rearrange, and otherwise modify the Submission, and use the Submission in whole or in part or in combination with other materials; and (iii) to assign and/or license others to use the Submission for all of the purposes hereunder;
- acknowledge and agree, with respect to the Personal Information, that Sponsor and the MLB Entities shall have the right (subject to applicable law) to (i) incorporate certain of the Personal Information into the Submission and use such Personal Information as incorporated therein; (ii) analyze and use the Personal Information for any and all purposes, including without limitation sending the Participant advertising and promotional materials and for any other advertising, marketing, and promotional purposes; and (iii) to share the Personal Information with third parties for their advertising, marketing and promotional purposes or for any other purposes;
- acknowledge that Participant shall have no right of approval of any use of the Submission and the Personal Information as permitted hereunder;
- agree that Participant shall use any copy of the Submission that he/she obtains solely for his/her personal, non-public, non-commercial use; and
- indemnify, hold harmless, and fully release the Released Parties (as defined below) from any and all claims, demands, losses, promises, causes of action, and/or liabilities for any injuries, losses, death, or damages of any kind caused, directly or indirectly, in whole or in part, by participation in, or preparation for, the Contest, Contest-related activity, Participant’s Submission, or resulting from the acceptance, possession, quality, or use or misuse of the Prize (or any portion thereof, including any travel or activity related thereto), including, but not limited to, claims of copyright or trademark infringement, false endorsement, libel, slander, defamation, or infringement of rights of publicity or privacy.
Nothing herein will obligate Sponsor or the MLB Entities to make any use of any of the rights set forth herein. In the event that any individual(s) is referenced in the Submission but does not submit a separate Consent, License, and Release, the Participant hereby represents and warrants (i) that such individual(s) has authorized Participant to agree to this Consent, License, and Release on his/her behalf (or, with respect to any individual under the legal age of majority in his/her jurisdiction of residence, that Participant is the parent and/or legal guardian of such individual(s) with legal authority to act on behalf of such individual), and (ii) that Participant agrees to this Consent, License, and Release on behalf of such individual(s).
CONTENT RESTRICTIONS
Participants must not include any of the following content (the “Content Restrictions”) in any Submission: (i) vulgarity, profanity, nudity, or material which is adult-oriented content, sexually-explicit, indecent, or inappropriate; (ii) materials relating to lotteries or gambling; (iii) explicit language or content, images of violence, or promotion of illegal activities; (iv) content in violation of intellectual property rights or laws; (v) false, libelous, defamatory, disparaging, tortious, or slanderous materials; (vi) content that denigrates, disparages, or reflects negatively on the MLB Entities, their owners and employees, or the game of baseball; (vii) tobacco, e-cigarettes, alcohol, or drugs; (viii) dangerous stunts; (ix) real weapons of any kind including, but not limited to, guns, knives, or projectiles; (x) material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age, or any other basis protected by law, ordinance, or regulation; (xi) any individual under legal age of majority without providing a signed release from his/her parent or legal guardian; (xii) audio, visual and/or multimedia content owned by any third party (e.g., recorded music; pre-produced video, etc.); and (xiii) material that is unlawful, or otherwise in violation of or contrary to the laws or regulations in any jurisdiction where the Submission is created, including but not limited to laws relating to rights of privacy or publicity. Any Submission that does not comply with the foregoing, in the sole discretion of Sponsor, will be disqualified and eliminated from consideration.
GENERAL CONDITIONS
By participating in the Contest, each Participant (a) accepts and agrees to be bound by these Official Rules, including all entry and eligibility requirements, MLB’s Privacy Policy and Terms of Use; and (b) gives his/her express permission to be contacted by Sponsor and/or its representatives for Contest administration purposes.
All applicable federal, state and local laws and regulations apply. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
The MLB Entities, Sponsor, Apple, Inc., Facebook, Inc. (“Facebook”), Twitter, Inc. (“Twitter”), Instagram, Inc. (“Instagram”), American and each of their respective parent companies, trustees, subsidiaries, franchisees, assignees, affiliates, licensees, agents, independent contractors, telecasters, sponsors, licensees and advertising and promotional agencies, and each of their respective general and limited partners, members, shareholders, officers, directors, agents, employees, representatives and contractors (collectively, the “Released Parties”) are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due, or garbled entries, transmissions, email, or mail; lost, interrupted, or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections; availability, accessibility, miscommunications, or failures of computer, satellite, telephone, cable, or wireless transmissions or lines; computer hardware or software malfunctions, failures, or difficulties; wireless service congestion; failures or malfunctions of phones, phone lines, telephone systems, wireless towers, or cellular tower equipment; any error, omission, interruption, defect, or delay in wireless or other transmission, processing, or communication; printing, typographical, or other errors appearing within these Official Rules, in any Contest-related advertisements, or other materials; cancellation or postponement of any Major League Baseball game/event/exhibition; or any other errors, problems, or difficulties of any kind, whether human, mechanical, electronic, or other, relating to the Contest, including, without limitation, errors or difficulties which may occur in connection with administration of the Contest, processing of entries, announcement of the Winners, or any Contest -related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users (e.g., hacking) or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to entrant’s or to any other person's computer and/or wireless device related to or resulting from participating in this Contest or downloading materials from or use of the Contest website. Persons who tamper with or abuse any aspect of the Contest or website; attempt to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices; intend to annoy, abuse, threaten, or harass any other entrant or any representative of Sponsor and/or MLB; or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Contest and to resolve all disputes in its sole discretion. Released Parties (a) make no warranty, guaranty, or representation of any kind concerning any prize (or any portion thereof) and (b) disclaim any implied warranty.
Released Parties make no warranties, express or implied, relative to the use or enjoyment of the Prize (or any portion thereof) including, without limitation, its quality, merchantability, or fitness for a particular purpose. By entering the Contest, each Participant agrees to indemnify, hold harmless and fully release the Released Parties from any and all claims, demands, losses, promises, causes of action and/or liabilities for any injuries, losses, death, or damages of any kind caused, directly or indirectly, in whole or in part, by participation in, or preparation for, the Contest, Contest-related activity, Participant’s Submission, or resulting from the acceptance, possession, quality, use or misuse of the Prize (or any portion thereof) including any travel or activity related thereto.
Sponsor and MLB reserve the right, in their sole discretion, to modify, suspend, extend, or cancel the Contest (or any portion thereof) in the event Sponsor is prevented from executing the Contest as contemplated herein by any event beyond Sponsor’s control, including but not limited to: fire; flood; earthquake; explosion; public health epidemic or crisis; labor dispute or strike; act of God or public enemy; network or equipment failure; riot or civil disturbance; terrorist threat or activity; war (declared or undeclared); court order; or federal, state, or local government law, order, or regulation. Sponsor and MLB also reserve the right, in their sole discretion, to modify, suspend, extend, or cancel the Contest (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes or events corrupt administration, security, fairness, integrity, or proper operation of the Contest. In the event of cancellation, Sponsor may elect to identify the Winners and award the prizes by judging all non-suspect, eligible entries received up to the time of cancellation. Sponsor also reserves the right, in its sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY PARTICIPANT RESPONSIBLE FOR THE ATTEMPT, AND SPONSOR, MLB AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Entries generated by a script, macro, or other mechanical or automated means will be disqualified. In the event of dispute as to the identity or eligibility of any potential winner based on an email address, the winning Submission will be declared made by the Authorized Account Holder of the email address submitted at the time of entry provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is defined as the natural person to whom the applicable ISP or other organization (such as a business or educational institution) has assigned the submitted email address for the domain associated with such email address.
In the event that the Contest is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Contest, or to disqualify Participants residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any Participants who are disqualified due to such an action.
ARBITRATION; CLASS ACTION WAIVER
As a condition of entering this Contest, each entrant agrees that (A) any and all disputes, claims, controversies or causes of action arising out of or relating to this Contest, or any prizes awarded (each, a "Claim"), shall be (1) arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party, and (2) settled by binding arbitration in New York County, New York before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (B) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses. These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of New York, U.S.A, applicable to contracts entered into and performed exclusively in that State.
The Contest is a skill contest designed to increase consumer awareness of and interest in Major League Baseball. This Contest may not be used for, or in connection with, any form of gambling. This Contest is in no way sponsored, endorsed, administered by, or associated with Facebook, Inc. Apple is not a participant in or sponsor of this promotion.
