Beat the Streak 2024 Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPACT YOUR OPPORTUNITY TO WIN. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT. THESE OFFICIAL RULES ARE A CONTRACT BETWEEN YOU AND THE CONTEST SPONSOR, SO READ CAREFULLY BEFORE PARTICIPATING.

The Grand Prize will be awarded only if an eligible entrant achieves a Streak of fifty-seven (57). The Top Streak Prize will be awarded only if the Grand Prize is not awarded and an eligible entrant achieves a Streak of at least twenty (20). If no eligible entrant achieves a Streak of at least twenty (20), no prize will be awarded.

Introduction

The Beat the Streak contest ("BTS") invites participants to compete by submitting predictions concerning the hitting success of MLB players. The object of BTS is to establish and build a virtual "hitting streak" by making correct consecutive predictions regarding which MLB players will record a hit for a particular gameday. To enter, you must register for BTS via the Contest Page or App (as defined below) and then, for a particular MLB gameday and match-up, select one (1) or two (2) players that you predict will record a hit (each such player prediction, a "Pick"). Your BTS score ("Streak") is measured as described in Section 6 below. BTS is subject to all applicable laws, rules, and regulations. Void in the Province of Quebec and where prohibited or restricted by law, rule, or regulation.

Eligibility

BTS is open only to legal residents of the United States, including its commonwealths, territories, and possessions, and Canada (excluding Quebec) who are, as of the date of BTS registration, registered users of MLB.com, legal age of majority in their jurisdiction of residence and at least twenty-one (21) years old, and not otherwise ineligible per the terms of this Section 2. Excluded individuals may play, but WILL NOT be eligible to receive any prize. Employees, officers, and directors and their immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and members of the same household (whether or not related) of MLB Advanced Media, L.P. ("Sponsor"), the other MLB Entities (as defined below), each of their respective parent companies, subsidiaries, affiliates, governors, related entities, partners, partnerships, principals, licensees, sponsors, and advertising/promotion agencies, Genius Sports Group, any contest prize provider or commercial sponsor, and any other entity associated with BTS, and all of their respective officers, directors, employees, agents, representatives, successors, and assigns (collectively, "Promotion Parties") are not eligible to participate or win. The "MLB Entities" shall mean Sponsor, the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Properties, Inc., The MLB Network, LLC, the MLB Clubs ("Clubs"), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities.

Entry Period and Lock Time

The entry period for BTS will begin on or about 12:00 p.m. Eastern Standard Time (“ET”) on March 26, 2024 (“BTS Start Time”) and end upon the conclusion of the final game of the 2024 MLB regular season (the “BTS Entry Period”). For purposes of this Contest, the 2024 MLB regular season will begin with the MLB games scheduled for March 28, 2024 and includes all potential MLB tiebreaker games played prior to the commencement of the 2024 MLB Postseason, if any. Your Picks for a particular gameday must be recorded before Lock Time (as defined below). If you do not timely submit a Pick for any particular gameday, your Streak will not end and revert to zero. Instead, your Streak will hold at its then-current number, until it either grows or reverts to zero as described in Section 6 below. For purposes of BTS, “Lock Time” means five (5) minutes prior to the scheduled start of the MLB game in which your Pick is scheduled to participate. For example, if a Club is scheduled to begin a game at 1:05 p.m. ET on a particular gameday, the Lock Time by which any prediction for a player from such Club must be recorded is 1:00 p.m. ET of such gameday, regardless of whether the game actually begins at such time or later. You can submit your Picks as early as five (5) days prior to the relevant gameday, provided that if the BTS Start Time is less than five (5) days before any gameday, you can submit your Picks for such gameday as early as the BTS Start Time.

Regarding Changes to Roster: The menu from which you select a player for your Pick is specific to both gameday and match-up. If there are any official active roster changes such that your Pick does not play on the gameday or in the match-up that was designated in the selection menu, for example because of an injury or a trade to different team, your Pick will not automatically update or change. If you want to revise a Pick in light of an official active roster change, you must access the player selection menu and update your Pick before the applicable Lock Time. If you do not update your Pick before the applicable Lock Time and your Pick of a player who was removed from designated match-up stays in place, your Pick will be deemed a Pass, as described in Section 6 below. For example, if your Pick is for “Player X” in the MIL @ NYM match-up scheduled for March 30, 2024, and “Player X” does not play in such match-up or plays in a different match-up, your Pick is deemed a Pass. For purposes of making or revising a Pick in light of a roster change, note that the player selection menu will be updated only after changes have been made official. For example, if there is announcement that “Player Y” will be traded to a new team, the player selection menu will show Player Y as an option for his new team’s match-ups only after he has been officially added to the new team’s active roster.

Regarding Double-Headers: In the event that, at the time you submitted your Pick, the designated match-up for such Pick was not part of a double-header and is later re-scheduled to be part of a double-header (“New DH”), your pre-existing Pick will be treated as follows:

  • If the New DH takes place on the same date as your Pick was originally scheduled, your Pick will apply to the New DH (regardless of whether the New DH is the first or second game of the day) and scored as described in Section 6 below.
  • If the New DH is scheduled to take place on any future date, your Pick will be deemed a Pass, as described in section 6 below.

Also, note that, if you desire to make a Double Down Pick (as defined below) you may predict the same player for each game of a double-header.

BTS Registration

To enter BTS, you must (a) be a registered user of MLB.com and (b) register for the contest at mlb.com/play (the "Contest Page") or via the MLB mobile app ("App"). On the Contest Page, click on the web banners, buttons, and/or links for BTS to log-in to your MLB.com account and then complete and submit the BTS registration form. Alternatively, you may download and install the App on your smartphone or other mobile device and log-in to your MLB.com account and register for BTS via the App. By fully completing and submitting all information required for BTS registration, including your date of birth, and confirming your agreement to these Official Rules, you will be registered as a BTS entrant. MLB.com account and BTS registration are both free. Data and usage rates may apply to download, installation, and use of the App or of a mobile phone or other web-enabled device; check with your service provider for details on these and other charges. Wireless service is not available in all areas. Throughout the BTS Entry Period, Sponsor may release updates to the App and notify you of the availability of such updates via in-App messaging or other means. Be sure to install these updates to participate in BTS via the App. If you do not install updates to the App when they are available, you may not be able to participate in BTS via the App. Incomplete BTS registrations are void. Participants are responsible for ensuring all their contact information is up-to-date and accurate.

BTS Entry; Entry Limit

One (1) BTS entry is comprised of an initial Pick submitted when your Streak is at zero and all subsequent consecutive Picks, until you submit an incorrect Pick and your Streak reverts to zero (or BTS concludes). Limit one (1) BTS registration per person and per email address for the duration of the BTS Entry Period. Additional BTS registrations received from any person/email address will be void. There is no limit to how often you can attempt to build a new Streak after reverting to zero, and therefore no limit on the number of entries you can submit in BTS. You cannot, however, submit or manage simultaneous entries. The use of a script, macro, or any other device to automate or subvert the contest registration or entry process is prohibited and all such registrations and entries will be void. Sponsor reserves the right to permanently disqualify any person it believes has intentionally violated these Official Rules.

Establishing and Maintaining a Streak; Scoring:

Your Streak is measured by the number of correct predictions you make, subject to the following:

You will achieve a Streak of one (1) upon your first correct Pick (i.e., your Pick is credited with a hit), so long as your Pick had at least one (1) official at-bat or one (1) sacrifice fly. Such a correct Pick is referred to as a "Hit."

Your Streak will increase by (a) one (1) with each next Hit or (b) two (2) as described in "Double Down Feature" below.

Your Streak will hold at its then current-number under any of the following scenarios (each such scenario, a "Pass"):

A. your Pick does not make an official at-bat appearance, does not make a sacrifice fly, or does not play (in the match-up that was specified for your Pick) for any reason;

B. all of your Pick's at-bat appearances resulted in a base on balls, hit batsman, defensive interference or obstruction, a sacrifice bunt, or a walk (intentional or not);

C. the game in which your Pick is scheduled to make an at-bat appearance is suspended and, at the time of suspension, the player has not yet recorded a hit;

D. you do not timely submit a Pick; or

E. Streak Saver saves your Streak, as described below.

If your Pick is neither a Hit nor Pass, your Pick is considered incorrect, also referred to as a "No Hit." In such case, your Streak will end and revert to zero. In such event, you may establish a new Streak and compete again by submitting further Picks.

Double Down Feature: BTS will allow entrants to make two (2) Picks for a particular gameday ("Double Down Pick"), and potentially increase a Streak by two (2), as described below.

You may submit a Double Down Pick for any gameday, so long as both of your Picks are recorded prior to their applicable Lock Times. In other words, if you submit one (1) Pick and wish to submit a second prediction for a Double Down Pick, you may only do so if the Lock Time for your first Pick has not yet passed. You may not add a second prediction for a Double Down Pick after the Lock Time of your first prediction has passed. You cannot change either of your Double Down Pick predictions after the earliest applicable Lock Time. In other words, after you submit a Double Down Pick and the Lock Time for the first relevant game has passed, you cannot change the second of your predictions. The outcomes of your Double Down Pick will be scored and impact your Streak as shown in the below table.

Streak Saver Feature: BTS includes a one-time feature which automatically preserves an entrant's Streak when it would otherwise end and revert to zero as described below ("Streak Saver"). If Streak Saver "saves" your Streak, your Streak is preserved and maintained at your then-current number. Streak Saver does not increase your Streak. Streak Saver is automatically applied to your BTS account the first time you achieve No Hit, provided that your Streak, at the time of the "save," is ten (10) or more but does not exceed fifteen (15). Streak Saver will only "save" your Streak once throughout the entire BTS Entry Period and it will

  • The first time you achieve a Streak of ten (10), Streak Saver is applied to your BTS account. If your next Pick is deemed a No Hit, your Streak of ten (10) will be preserved. Because Streak Saver "saved" your Streak once, Streak Saver is not available for additional use. Your Streak will be lost and revert to zero if and when a subsequent prediction you submit is deemed a No Hit and Streak Saver will not be made available to any future BTS entry or Streak.
  • The first time you achieve a Streak of ten (10), Streak Saver is applied to your BTS account. If your next six (6) Picks are all deemed Hits, you will have increased your Streak to sixteen (16) and Streak Saver will be unused. Your Streak will be lost and revert to zero if and when a subsequent prediction you submit is deemed a No Hit. In this scenario, the unused Streak

Regarding Suspended Games: For the avoidance of doubt, a Pick is considered a Hit only if the predicted player records a hit on the specific gameday for which the prediction was made and provided that the hit was recorded before any game suspension. Under no circumstances will the activity of the resumed or re-scheduled portion of a suspended MLB game be evaluated for BTS purposes. In other words, if your Pick is involved in a suspended game, your Pick will be deemed a Hit, Pass, or No Hit based on game activity only up until the time of suspension.

Regarding Official Changes to MLB Game Statistics: Sponsor will tabulate Streak scores as soon as practicable by 8:00am ET on the day following each MLB gameday. Streak scores will take into account official MLB statistics changes or corrections made prior to such time and be adjusted as shown in the table below. Streak scores will not be revised or recalculated to reflect official MLB statistics changes or corrections that occur after 8:00 a.m. ET the day following the impacted game. If an official MLB statistic is changed or corrected after such time, there will be no impact to your previously calculated Streak.

Sponsor reserves the right, but assumes no obligation, to correct and update Streak scores based on errors or irregularities in the tabulation or transmission of entries or Streaks. The decisions of Sponsor are final and binding with respect to BTS scoring and in all other BTS matters.

Prize; Prize Terms

BTS features one (1) Grand Prize or one (1) Top Streak Prize, as set forth below. Only one (1) prize will be awarded, subject to the below Streak requirements. No prize will be awarded if no entrant achieves a Streak of at least twenty (20).

The "Grand Prize" is five million six hundred thousand U.S. dollars. GRAND PRIZE WILL ONLY BE AWARDED IF AN ELIGIBLE ENTRANT ACHIEVES A BTS STREAK OF FIFTY-SEVEN (57) OR GREATER, AS DETERMINED BY SPONSOR, IN ACCORDANCE WITH THESE CONTEST TERMS. IF NO ELIGIBLE ENTRANT ACHIEVES A STREAK OF FIFTY-SEVEN (57) OR GREATER, THE GRAND PRIZE WILL NOT BE AWARDED. The Grand Prize will be awarded in one (1) of the following formats, as selected by the verified winner: (a) a thirty (30) year annuity that pays out one hundred eighty-six thousand six hundred sixty-seven U.S. dollars (US $186,667) per year for thirty (30) years without interest; or (b) one (1) lump sum payment representing the estimated present value of the foregoing which, as of February 7, 2024, equals three million one hundred thirty thousand four hundred U.S. dollars (US $3,130,400) (and for purposes of these Official Rules, shall be three million one hundred thirty thousand four hundred U.S. dollars (US $3,130,400) at the time of the award).

The "Top Streak Prize" is ten thousand U.S. dollars ($10,000). THE TOP STREAK PRIZE WILL ONLY BE AWARDED IF (A) NO ENTRANT ACHIEVES A STREAK OF FIFTY-SEVEN (57) OR GREATER AND (B) AN ELIGIBLE ENTRANT ACHIEVES A STREAK OF AT LEAST TWENTY (20), AS DETERMINED BY SPONSOR. IF NO ELIGIBLE PARTICIPANT ACHIEVES A STREAK OF TWENTY (20) OR GREATER, NO PRIZE WILL BE AWARDED. The Top Streak Prize will be awarded in the form of a check as one (1) lump sum payment.

Winner is fully responsible for any and all applicable taxes (including income and withholding taxes). All costs and expenses associated with acceptance and use of any prize which are not specifically described as being provided by Sponsor are the sole responsibility of the winner. All prize details are at Sponsor's sole discretion.

Determining the Winner; Notification

Subject to verification of eligibility and compliance with these Official Rules, (a) the eligible entrant who first achieves a Streak of fifty-seven (57) (if any) will win the Grand Prize, provided that a tie will be declared if multiple entrants make such achievement on the same gameday; and (b) if no entrant wins the Grand Prize, the eligible entrant (if any) who, as of the close of the BTS Entry Period, has achieved the highest Streak among all entries and provided such Streak twenty (20) or more, will win the Top Streak Prize. In the event of a tie (i.e., two (2) or more eligible entrants achieve a Streak of fifty- seven (57) on the same gameday or the highest scoring Streak of twenty (20) or more is achieved by multiple players), the Grand Prize or Top Streak Prize, as applicable, will be divided equally among the tied, eligible participants.

For the avoidance of doubt:

  • If two (2) or more entrants achieve a Streak of fifty-seven (57) on the same gameday, a tie will be declared even if one (1) such entrant’s Streak reaches fifty-eight (58) by the end of such gameday by virtue of a Double Down Pick.
  • If two (2) or more entrants achieve a Streak of fifty-seven (57) on the same gameday, a tie will be declared even the tied entrants achieved fifty-seven (57) at different times of the day. For example, if an entrant achieves a Streak of fifty-seven (57) at 3:00 p.m. ET and another entrant achieves a Streak of fifty-seven (57) at 10:00 p.m. ET, a tie will be declared.
  • If an entrant has a Streak of fifty-six (56) and makes a Double Down Pick, the outcome of which includes a No Hit, such entrant’s Streak would end and revert to zero.
  • The winner of the Top Streak Prize does not have to have an active Streak at the close of the BTS Entry Period. In other words, if the highest scoring Streak over the course of the BTS Entry Period is thirty (30), the entrant who recorded such Streak is eligible to win the Top Streak Prize regardless of whether or not the Streak ended with a No Hit prior to the close of the Entry Period.

The potential winner will be notified by email and/or telephone (as determined by Sponsor in its sole discretion) within approximately three (3) business days following the conclusion of BTS. Entrants are solely responsible for monitoring their email and voice message systems for BTS-related notifications. Sponsor will have the right, in its discretion, to require proof of identity and/or eligibility in a form acceptable to Sponsor (for example, government-issued photo identification) for winner verification purposes. In order to receive a prize, the potential winners may be required to execute and return an Affidavit of Eligibility & Liability Release (or, if a resident of Canada, a declaration) and (where legal) Publicity Release, and any other documents required by Sponsor, within five (5) business days of date of issuance. The potential winner will be required to submit his/her valid social security number and will receive an IRS Form 1099 for any prize valued at $600 or greater. If any prize or prize notification is returned as undeliverable or is declined, if Sponsor is unable to contact a potential winner, if the potential winner does not timely respond to prize notification or document requirements, or if a potential winner is not in compliance with these Official Rules, such potential winner will be disqualified and the prize in question will go unawarded, provided however that in the event of a tie, the prize may be awarded to the remaining, non-disqualified potential winner(s). The prize will be awarded only to the Authorized Account Holder of the email address used for BTS registration (subject to verification of eligibility and compliance with these Official Rules). The “Authorized Account Holder” is the natural person to whom the applicable ISP or other organization (such as a business or educational institution) has assigned the submitted email address for the domain associated with such email address.

Publicity

Except where prohibited by law, by registering for the BTS, each entrant grants permission to the Promotion Parties for the use of his/her name, photograph, likeness, statements, biographical information, voice, address (city and state), and prize information (if any) worldwide and in all forms of media worldwide, in perpetuity, without further compensation or notice, for any and all purposes, including promotional and advertising purposes and for inclusion on a winners list.

Promotion Conditions

By registering for the BTS, each entrant accepts and agrees (a) to be bound by these Official Rules, including all eligibility requirements, the MLB website Privacy Policy (available at mlb.com/privacy) and Terms of Use (available at mlb.com/tou), and the decisions of the Sponsor, which shall be final and binding in all respects and (b) gives his/her express permission to be contacted by Sponsor and/or its representatives for administration purposes. Sponsor's computer will be the official clock of the BTS. By registering for BTS, each entrant also agrees to refrain from conduct or communications which may harm the image or reputation of Sponsor or the other Promotion Parties, as determined in Sponsor's sole discretion. No transfer, assignment, cash redemption, or substitution of a prize (or portion thereof) is permitted except by Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value as determined by Sponsor. Participation in BTS is at participant's own risk. MLB game dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. Please be advised that previously-implemented MLB rules regarding seven-inning doubleheaders and modified extra- innings are no longer in effect. The Promotion Parties and Apple, Inc. (collectively, "Released Parties") are not responsible for lost, incomplete, inaccurate, garbled, late, delayed, undelivered, or misdirected registrations, predictions, entries, transmissions, or email; theft, destruction, or unauthorized access to, or alteration of, entries or email; computer hardware or software malfunctions or failures or malfunctions of phones/mobile devices (including wireless phones/handsets or other wireless devices), phone lines, or telephone systems; interrupted or unavailable network, server, cable, satellite, Internet service provider, or other connections; any error, omission, interruption, defect, or delay in any transmission or communication; network traffic congestion or for any technical problem, including, but not limited to, any injury or damage to participant's or any other person's computer or mobile device related to or resulting from participation in BTS; errors or ambiguity in these Official Rules, any BTS-related advertisements, or other materials; the selection or announcement of the potential winner or the distribution of the prize; the cancellation, suspension, or preemption of MLB games, scoring tabulation, or timing errors; injuries or unavailability of MLB players; or other problems or errors of any kind whether mechanical, human, electronic, typographical, printing, or otherwise. Entrants are responsible for any charges of online or Internet service providers or wireless carriers. Sponsor reserves the right, in its sole discretion, to disqualify any participant and void any his/her entries if Sponsor believes such participant has attempted to tamper with or impair the administration, security, fairness, or proper play of BTS or is in violation of these Official Rules or the MLB website Terms of Use. Sponsor, in its sole discretion, reserves the right to modify, suspend, extend, terminate, or cancel BTS (or any portion thereof) at any time and for any reason, including, but not limited to, to ensure the fairness and integrity of BTS or in the event Sponsor is prevented from executing BTS (or any portion thereof) as contemplated herein by any event beyond their control, including but not limited to: fire; flood; earthquake; explosion; public health epidemic or crisis; labor dispute or strike; act of God or public enemy; network or equipment failure; riot or civil disturbance; terrorist threat or activity; war (declared or undeclared); court order; or federal, state, or local government law, order, or regulation. Sponsor also reserves the right, in their sole discretion, to modify, suspend, extend, terminate, or cancel BTS (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes or events corrupt administration, security, fairness, integrity, or proper operation of BTS.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR APP ASSOCIATED WITH THIS CONTEST IN ANY WAY, OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS CONTEST, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ITS AGENTS WILL DISQUALIFY ANY PARTICIPANT RESPONSIBLE FOR THE ATTEMPT AND SPONSOR AND ITS AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor reserves the right, in their sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the contest. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event that BTS is challenged by any legal or regulatory authority, Sponsor reserve the right to discontinue or modify BTS, or to disqualify participants residing in the affected geographic areas. In such event, the Sponsor shall have no liability to any participants who are disqualified due to such action.

Waiver/Release, Limitation of Liability and Disclaimer of Warranties

By registering for BTS, each participant agrees (a) to waive any right to claim any ambiguity or error in these Official Rules, the contest webpages, or the App and (b) to indemnify, hold harmless, and fully release the Released Parties from any claim, action, demand, liability, loss, injury, or damage caused, directly or indirectly, in whole or in part, by participation in BTS, any BTS-related activity, and the acceptance, possession, quality, use, or misuse of any prize, including any travel or activity related thereto and any and all taxes and other fees applicable thereto. IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND PARTICIPATION IN THE CONTEST. IN NO EVENT SHALL THE RELEASED PARTIES' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $100. Arbitration; Class Action Waiver

Except where prohibited by law, as a condition of participating in this contest, each participant agrees that (a) any and all disputes and causes of action arising out of or connected with this contest, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of JAMS and held in New York County, New York; (b) the Federal Arbitration Act shall govern the interpretation, enforcement, and all proceedings at such arbitration; and (c) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will any participant be permitted to obtain awards for, and each participant hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in BTS), and each participant further waives all rights to have damages multiplied or increased. For New Jersey residents, the limitations set forth above are inapplicable where attorneys' fees, court costs, or other damages are mandated by statute.

Choice of Law

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with BTS, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.

Privacy

All information submitted by participants is subject to, and will be treated in a manner consistent with, MLB's website Privacy Policy, accessible at mlb.com/privacy. Participants may be given the option to receive (a) commercial email from MLB, its affiliates and/or partners (including commercial sponsors of BTS) and/or (b) mobile text messages and updates from MLB; however, eligibility to participate in the contest is not dependent upon consent to receive such emails and/or mobile text messages and updates and consenting to receive such emails and/or mobile text messages and updates will not impact any participant's opportunity to win. Certain of your BTS registration information and activity may be shared with BTS sponsors, as disclosed to you when you first register.
