PAYMENT & DEPOSIT
Full payment is due upon reservation, 90% of your package price is refundable up until 60 days prior to your scheduled trip. Packages booked within 60 days of scheduled trip require full payment upon reservation and are non-refundable. All payments are final and non-refundable within 60 days of a scheduled trip. Payments must be made in the form of cashier's check, MasterCard, Visa, American Express, or Discover. Buyer's authorization to use credit card number for deposit and/or final payments indicates Buyer's complete compliance with these Terms and Conditions, whether or not you have actually signed the appropriate draft. Verbal authorization of your credit card confirms the reservation. If payments are not received by the due dates, the event services to be provided may be considered null and void at the sole discretion of Indians Destinations and any payments to date will be forfeited.
TRAVEL DOCUMENTS & MERCHANDISE
A personalized itinerary will be emailed to you no later than one (1) week prior to your trip. The itinerary will include confirmation numbers, timing for the scheduled events and other important information for the trip. If you are staying at one of the designated Indians Destinations hotels, you will receive your game tickets and VIP Credentials at the hotel upon check-in. If you choose not to stay at one of the Indians Destinations designated hotels, you will receive your game tickets and VIP credentials via FedEx one (1) week prior to your trip departure. If you live international, the tickets and credentials will be in your gift bag at the hotel or you can coordinate a time to pick them up with an Indians Staff Member when you arrive for the trip. We do not accept P.O. Boxes as shipping address, please provide a valid address during your registration that will accept FedEx packages.
On behalf of myself and my minor child(ren) (if applicable), I hereby grant the Released Parties the worldwide and perpetual right and authority to use, reproduce, distribute, broadcast or otherwise transmit, publish and display in whole or in part, my/our name(s), photograph(s), - or any other likeness and/or biographical information I may provide and, if applicable, any statement I have made or may make concerning the "ID Trip" in any and all media now known or hereafter invented, in perpetuity, for any purpose, without notification, compensation or additional consideration, unless prohibited by law.
Hotels generally require a credit card or cash deposit upon check-in to cover incidental hotel charges. Participants are individually responsible for all incidental charges. All incidental charges are to be paid directly to the hotel by the participant upon check-out. Guest requests for specific room types, including smoking, non-smoking, or specific bedding, are subject to availability at time of check-in and cannot be guaranteed.
Included are all presently known government and local taxes on included services.
Indians Destinations obtains tickets for events in various forms at different time periods. Indians Destinations is not necessarily in physical possession of admission tickets at the time a booking is made or accepted. Indians Destinations will be acquiring event tickets on the Buyer's behalf. Tickets cannot be guaranteed together in quantities greater than four (4), odd numbers, specific rows or sections.
For all packages which include a Majestic Indians game jersey, all requests must be fully completed and returned to an Indians Destinations representative by the date specified in order to guarantee on-time delivery. Indians Destinations cannot guarantee on-time delivery for merchandise not ordered by the date specified.
CANCELLATION & REFUND POLICY
For cancellations made 60+ days prior to departure, 90% of the total package price is refundable. Cancellations made less than 60 days prior to departure are non-refundable. Indians Destinations ("seller") will refund to buyer any deposits paid by buyer not yet utilized by seller to purchase package components, and seller will use its best efforts to obtain refunds for any package components already purchased less any deposits. We regret that we cannot make any exceptions for personal emergencies. We recommend purchasing travel insurance.
Indians Destinations ("ID") is responsible only for arranging and coordinating the transportation, accommodations and other benefits in connection with your trip (the "Trip"). You acknowledge and agree that ID does not own, operate or otherwise control, and is not an agent for, any of the entities actually providing the transportation, accommodations or other benefits to be provided in connection with the Trip including, without limitation, car rental, air transportation and hotel accommodations, and you hereby release [FSM/Club] and the members, partners, officers, affiliates, agents, employees and representatives of [FSM/Club], MLB Advanced Media, L.P., the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, the Major League Baseball Clubs ("Clubs"), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities (the "Released Parties") from all loss, injury and damage that you or any person traveling with you may suffer during the Trip, and from any property loss or damage that may occur during the Trip including, without limitation, loss or theft of luggage. You further acknowledge and agree that ID shall not be responsible for, and you assume all risk in connection with, all loss, injury or damage, or any cancellation, delay, or changes to itineraries and schedules, that result from any terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, weather, cancellation of baseball games, strikes or labor disputes, or any other reason beyond the control ID, and in no event shall you be entitled to any refund of any amounts due for the Trip. ID reserves the right to accept or decline any person as a member of its Trip or to cancel a Trip completely in its sole discretion. ID reserves the right to cancel any reservation and will remit a full refund to the cancelled party.
BY PARTICIPATING IN THE TRIP, YOU ARE AGREEING TO THE TERMS AND CONDITIONS SET FORTH IN THIS ACKNOWLEDGEMENT AND RELEASE.
