Tickets to Bark at the Park must be purchased in advance. You must accept the waiver below before you can purchase your ticket to Bark at the Park.

I, the undersigned participant, fully understand, appreciate and agree that I have voluntarily requested to participate in the "Bark at the Park" event (the "Event") at Globe Life Field in Arlington, Texas (the "Ballpark"), which will involve my attendance and the attendance of my dog of which I have custody. I acknowledge, agree, and represent that I have, or will immediately upon entering and continuously thereafter, inspected the area where I will be permitted to watch the game with my dog and determined that it is safe and suitable for my dog's participation in the Event and further agree and warrant that if, at any time, I determine anything to be unsafe, including the threat from other dogs participating in the event, I will immediately advise a Ballpark official of such unsafe condition(s) and will leave the Ballpark with my dog.

I acknowledge that the activities of the Event can be dangerous and could involve the risk of serious injury, illness, death, or damage to me, my dog, others, and others' dogs. I acknowledge that injuries received may be compounded or increased by negligent rescue operations or procedures of the Released Parties identified below. I understand that my actions and the actions of the dog of which I have custody and/or control during the Event may result in injuries and damages to myself and others, whether anticipated or unanticipated, or foreseeable or unforeseeable, including my dog as well as dogs of others by participating in this Event. I understand that I assume the risk and responsibility for any and all risks associated with participating in this Event, including but not limited to injury, Communicable Disease (as defined herein) death, and property damage, as well as injury, illness, death, and property damage to dogs. I agree to abide by any decision of any Ballpark official relevant to my ability or the ability of the dog of which I have custody to participate in this Event safely, and I further agree that Ballpark officials may authorize necessary treatment for me and/or the dog in my custody.

I further understand and assume any and all risks associated with my participation in this Event, including but not limited to illness, Communicable Disease, traveling to and from the Event, falls, contact with spectators at the Event, injuries or damages, including death sustained by and through other participant dogs, the effects of the weather including extreme temperature and humidity, and/or the condition of the premises and the Ballpark, including, but not limited to, sidewalks and parking lots.

I confirm and assure that my dog has current Rabies, Distemper, Parvo, Bordatella, and Canine Influenza Virus (CIV) vaccinations, is in good health, is able to tolerate the presence of crowds and other dogs, and does not demonstrate dangerous or aggressive behavior towards persons or other dogs. I agree to abide by all the rules and instructions given in connection with this Event. I assume the risk for injuries and damages sustained as a result of the manner and method by which the Event is administered.

I agree to grant the Rangers or their designees, without further compensation, an unrestricted, worldwide license in perpetuity to use, without further notification, the name, voice, image, likeness, actions and statements of me or any minor child and/or dog that accompanies me to the Event, for any purpose, including but not limited to advertising, promotional or commercial purposes, in any media known or hereafter developed.

In consideration for allowing me to participate in this Event with my dog in my custody and control, I agree, for myself, my dog, and for any minor child accompanying me to the Event, and all of our respective heirs, legatees, executors, administrators, successors and assigns, or anyone acting on our behalf, to forever waive, release, and discharge Rangers Baseball LLC (the "Rangers"), Rangers Baseball Express LLC, Rangers Stadium Company LLC, Texas Rangers Baseball Foundation, Ballpark Parking Partners LLC, the City of Arlington, any sponsor(s) of the Event, Office of the Commissioner of Baseball (“MLB”), MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs**, and all of their respective parents, subsidiaries, affiliates, related entities, sponsors, officers, directors, employees, agents, officials, partners, managers and shareholders, and other personnel or entities in any way assisting or connected with this Event (together the "Released Parties"), from any and all claims, demands, causes of action, proceedings, losses, damages, liabilities, costs and expenses (in all cases including reasonable attorneys' fees), of any kind or nature, that relate to or arise in any way from attendance at or participation in the Event by me, my dog, and/or any minor child accompanying me, expressly including any claims arising from any NEGLIGENT acts, omissions, or conduct of the Released Parties (collectively, "Claims," and each, a “Claim”).**

I further agree that I am solely responsible for any Claim for personal injury, illness, injury to a dog, or property damage made by any third party and based in whole or in part on my, my dog's, and/or my minor child's attendance at or participation in the Event. In particular, I agree to pay all cleaning or repair costs resulting from any damage to the Ballpark caused by my dog. As such, I further agree, for myself, my dog, and for any minor child accompanying me to the Event, and all of our respective heirs, legatees, executors, administrators, successors and assigns, or anyone acting on our behalf, (i) to defend, indemnify and hold harmless any of the Released Parties from any allegation, action, or lawsuit brought against any of the Released Parties by a third party and based in whole or in part on (a) Claim(s) that relate to or arise in any way from attendance at or participation in the Event by me, my dog, and/or any minor child accompanying me, even those caused by the NEGLIGENT acts, omissions, or conduct of the Released Parties, and (ii) not to institute legal proceedings against any of the Released Parties for any of the Claims that have been waived, released or discharged herein.

COMMUNICABLE DISEASE ASSUMPTION OF RISK AND RELEASE OF LIABILITY. This Section is an acknowledgement and express assumption of risk and release of liability in any way related to me, my dog, and/or any minor child accompanying me being exposed to or contracting COVID-19 (as defined by the World Health Organization) and any strains, variants, or mutations thereof, the coronavirus that causes COVID-19 and/or any other communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof (collectively, “Communicable Disease”), during or in connection with my, my dog’s , and/or my child’s participation in the Event and/or my/my child’s presence at the Ballpark. By participating in the Event and/or being present at the Ballpark, I acknowledge and expressly assume the risk that I/my child may be exposed to Communicable Disease. I expressly understand that the risks of exposure to Communicable Disease include contracting Communicable Disease and the associated dangers, medical complications (including death) and physical and mental injuries, both foreseen and unforeseen, that may result from contracting Communicable Disease. I further acknowledge and understand that my/ my child’s interaction with Ballpark and Event staff, participants and any other individuals or dogs present at the Ballpark poses an elevated, inherent risk of being exposed to and contracting Communicable Disease, that it cannot be guaranteed that I//my dog/any child accompanying me will not be exposed to Communicable Disease, and that potential exposure to or contraction of Communicable Disease while participating in the Event and/or being present at the Ballpark are risks that cannot be eliminated. If infected with Communicable Disease, I acknowledge and understand that I/my child may subsequently infect others, even if I/my child don’t/doesn’t experience or display any symptoms. In connection with the foregoing, I agree that I/my child will not participate in the Event or be present at the Ballpark if, within fourteen (14) days preceding the Event, I/my child (i) tested positive or presumptively positive for Communicable Disease or was identified as a potential carrier of Communicable Disease, (ii) experienced any symptoms commonly associated with Communicable Disease, including, without limitation, fever, cough, loss of sense of taste or smell, or shortness of breath; and/or (iii) was in direct contact with or the immediate vicinity of any person who is either confirmed or suspected of being infected with Communicable Disease. I further agree that I/my child will submit to any health screening and/or Communicable Disease testing that may be required as a condition of my/my child’s participation in the Event and/or presence at the Ballpark.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I HEREBY WAIVE, RELEASE, FOREVER DISCHARGE, AND COVENANT NOT TO SUE THE RELEASED PARTIES FOR, AND THE RELEASED PARTIES SHALL NOT BE RESPONSIBLE FOR, ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY (INCLUDING, WITHOUT LIMITATION, FOR PERSONAL INJURY, DEATH OR PROPERTY DAMAGE) THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, EXPOSURE TO OR CONTRACTION OF COMMUNICABLE DISEASE BY ME/MY DOG/MY CHILD OR ANY OTHER INDIVIDUAL INFECTED BY ME/MY DOG/MY CHILD, INCLUDING, WITHOUT LIMITATION CLAIMS RESULTING FROM THE NEGLIGENCE OF THE RELEASED PARTIES AND/OR THE INHERENT RISKS ASSOCIATED WITH PARTICIPATION IN THE EVENT AND/OR BEING PRESENT AT THE BALLPARK DURING A COMMUNICABLE DISEASE PANDEMIC.

I represent that I am at least eighteen (18) years of age and I am competent to sign and agree to this Agreement with full understanding of the above information.

I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED EVENT, I AM PARTICIPATING AT MY OWN RISK, AND I AM AWARE OF THE RISKS ASSOCIATED WITH PARTICIPATING IN THIS EVENT, WHICH MAY INCLUDE BUT ARE NOT LIMITED TO PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY, ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS’ NEGLIGENCE, INCLUDING THE NEGLIGENCE OF THE RELEASED PARTIES, AND NONETHELESS I ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, ASSOCIATED WITH PARTICIPATION IN THIS EVENT. I FURTHER ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT, AND FULLY UNDERSTAND THE PROVISIONS AND COVENANTS CONTAINED HEREIN. I AM AWARE THAT BY SIGNING THIS AGREEMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
