Eligibility: The Best Buds Opening Day Sweepstakes presented by Budweiser (“Sweepstakes”) is open to legal residents of the of the United States including its commonwealths, territories and possessions who, as of the start of the Promotion Period (defined below), are twenty-one (21) years of age or older at the time of entry. Employees, officers and directors of MLB Advanced Media, L.P. (“Sponsor”), the other MLB Entities (as defined below), teamDigital Promotions, Inc. (“Administrator”), Anheuser-Busch, LLC, and each of their respective parent companies, subsidiaries, affiliates, governors, related entities, partners, partnerships, principals, licensees, sponsors, and advertising/promotion agencies and all of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, “Released Parties”), wholesale distributors and retail licensees, and the immediate family members (parent, spouse, sibling, or child, and their respective spouses, regardless of where they reside) and those living in the same household of each (whether or not related) are not eligible to participate or win. The “MLB Entities” shall mean Sponsor, the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. This Sweepstakes is subject to all applicable federal, state, and local rules and regulations. Void where prohibited or restricted by law, rule or regulation.
Promotion Period: The Sweepstakes begins at 9:00:00 a.m. Eastern Time (“ET”) on 7/10/2020 and ends at 9:00:00 a.m. ET on 7/24/2020 (the “Promotion Period”).
How to Participate: During the Promotion Period, you may enter the Sweepstakes when you visit MLB.com/BestBuds and click on the applicable Sweepstakes banners, buttons and/or links to access the online Sweepstakes entry form (the “Entry Form”). Follow the instructions provided to fully complete and submit the Entry Form, inclusive of your favorite Major League Baseball team (“Team”). By successfully completing and submitting the Entry Form, you will receive one (1) entry into the Sweepstakes. Limit one (1) entry per person and per valid e-mail address throughout the Promotion Period. Additional entries from any one person or valid e-mail address in excess of the stated limitation will be void.
All information submitted by entrants is subject to, and will be treated in a manner consistent with, MLB’s Terms of Use accessible at: https://www.mlb.com/official-information/terms-of-use and Privacy Policy accessible at: www.mlb.com/privacy. Entrants must fully complete and submit all non-optional data requested on the Entry Form to be eligible. Incomplete entries are void. Entrants to the Sweepstakes will be given the option to receive commercial e-mails from Sponsor and/or Anheuser-Busch, LLC; however, eligibility to participate in the Sweepstakes is not dependent upon entrant’s consent to receive such e-mails and consenting to receive such e-mails does not impact entrant’s chances of winning. By entering this Sweepstakes, each entrant gives his/her express permission to be contacted by the Administrator and/or Sponsor by telephone and/or email for Sweepstakes administration purposes. Released Parties are not responsible for lost, incomplete, late, delayed, inaccurate, misdirected, stolen, undelivered, or garbled entries, or email; failures or malfunctions of phones, phone lines or telephone systems; lost entries, or transmissions; any error, omission, interruption, defect or delay in transmission, or communication; interrupted or unavailable network, server, Internet Service Provider (ISP), cable, satellite or other connections including those through and/or by any website; miscommunications, failed computer hardware or software or technical failures; non-delivery; misdirected, blocked, or delayed e-mail notifications; garbled, misrouted, jumbled, scrambled, delayed or misdirected transmissions; printing, typographical or other errors appearing within these Official Rules, in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, telephone, electronic, or otherwise relating to or in connection with the Sweepstakes, or downloading of materials from or use of the website, including, without limitation, the errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, or email or the announcement of prizes. Administrator and/or Sponsor, as applicable, reserve(s) the right, in their sole discretion, to void any and all entries of an entrant who Administrator and/or Sponsor, as applicable, believes has attempted to tamper with, corrupt, or impair the administration, security, fairness or proper play of this Sweepstakes or who is otherwise not in compliance with these Official Rules. The use of automated entry or similar devices to participate or subvert the entry process is prohibited and all entries through such devices are void. In the event of a dispute as to the identity of any entrant, such entrant will be deemed the person named on the applicable Entry Form.
Winner Selection/Notification: On or about 7/30/2020, Administrator will conduct thirty (30) separate random drawings (one (1) drawing per Major League Baseball team) to select one (1) winner per drawing. Each Sweepstakes entry received during the Promotion Period will be included in the drawing applicable for the Team specified for such Sweepstakes entry. Each prize drawing will be conducted by Administrator, an independent sweepstakes management company. Subject to verification of eligibility and compliance with these Official Rules, the potential winners will be declared the official winners of the Sweepstakes. The potential winners will be notified by telephone and/or email and will be required to execute and return an Address Verification Form within five (5) days of the date of issuance. In the event that a potential winner declines a prize, is not eligible to accept a prize, does not comply with the terms of these Official Rules or is not available for any reason when called, his/her prize opportunity will be forfeited and Administrator, at its sole discretion and time permitting, may randomly select an alternate potential winner from among all remaining eligible entries received for the applicable Team throughout the duration of the Promotion Period. Odds of winning a prize will depend on the total number of eligible entries received per Team throughout the duration of the Promotion Period. The decisions of Sponsor and/or Administrator, as applicable, will be final and binding in all matters relating to this Sweepstakes.
Thirty (30) Grand Prizes (one (1) Grand Prize awarded per Team): Each Grand Prize winner will receive one (1) jersey of a current/former MLB player from his/her selected Team. Approximate Retail Value (“ARV”) of each Grand Prize: $125. Jersey is not autographed. Exact player is at Sponsor’s sole discretion. All prize details shall be determined in the sole and absolute discretion of Administrator and/or Sponsor, as applicable. Total ARV of all prizes awarded: $3,750.
Miscellaneous: No transfer, assignment, cash redemption, or substitution of a prize permitted except by Sponsor who may substitute a prize with a prize of comparable or greater value at its sole and absolute discretion. Winners are responsible for all income, federal, state and local taxes as well as any other costs or expenses associated with prize acceptance. By participating, each entrant agrees (1) to be bound by these Official Rules, (2) that Sponsor, the MLB Entities and each of their respective designees shall have the right and permission to use (unless prohibited by law) entrant’s name, voice, address (city and state of residence), Team, photograph and/or other likeness and prize information for advertising, promotional and/or trade and/or any other purpose in any and all media or format now known or hereafter devised throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification to entrants or any third parties; and (3) that the Released Parties and each of their respective employees, agents, representatives, licensors, successors and assigns shall have no liability and will be held harmless for any liability, loss, injury or damages of any kind, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize (or any portion thereof) (including any travel or activity related thereto) and/or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify, terminate or suspend this Sweepstakes (or any portion thereof) should viruses, bugs, unauthorized human intervention or other causes corrupt or impair the administration, security, fairness or proper operation of the Sweepstakes (or any portion thereof) or for any other reason and, in the event of termination, at its discretion, to randomly select a potential winner from among those eligible, non-suspect entries received during the Promotion Period prior to event requiring such termination. Administrator and/or Sponsor, as applicable, reserve the right, in their sole discretion, to disqualify any person and void all associated entries of any person who they believe has tampered with, or attempted to tamper with or impair, the entry process, or any other component of this Sweepstakes, whose conduct or actions affect or impair the administration, integrity, security, fairness or proper conduct of this Sweepstakes, or who is in violation of these Official Rules. Released Parties (a) make no warranty, guaranty or representation of any kind concerning the prize (or any portion thereof), and (b) disclaim any implied warranty. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES IN ANY WAY, OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR, SPONSOR, AND/OR EACH OF THEIR RESPECTIVE AGENTS WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND ANY AND ALL REMEDIES AVAILABLE FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMISSIBLE BY LAW.
Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, each Sweepstakes participant agrees that (a) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party, and (ii) settled by binding arbitration in New York County, New York before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (b) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses. For New Jersey residents, the limitations set forth above may be inapplicable where attorneys’ fees, court costs, or other damages are mandated by statute.
Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
