NO REFUNDS - NO EXCHANGES

IMPORTANT

Holder is admitted on condition and by use of this ticket expressly agrees not to use any photograph, reproduction, description, video, audio, or moving picture of Coors Field or any part thereof (including signage) for any commercial purposes including, without limitation, advertising, promotion, sale, or other venture for profit.

Holder understands and agrees on behalf of his/herself and on behalf of any minor accompanying Holder on a tour (“Minor”) that portions of the tour may include parts of Coors Field (including service levels) where construction, storage, or servicing, repair, maintenance, or cleaning operations are in progress, and holder assumes all risks and dangers incidental to the tour, and agrees that Colorado Rockies Baseball Club, Ltd. (the “Club”) (including its corporate and charitable affiliates), the Denver Metropolitan Major League Baseball Stadium District (“District”), the MLB Entities (defined below), and their respective partners, shareholders, managers, board members, officers, directors, employees, agents, contractors, subcontractors, and representatives (each a “Released Party”) are not liable for any personal injuries (including death), damage to property, or other loss suffered as a result of such risks or dangers and/or resulting from the negligence of any Released Party including, but not limited to, negligence rescue attempts, and Holder specifically releases and holds harmless each and every Released Party therefrom. “MLB Entities” means the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“MLB Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the MLB Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities. Holder agrees to indemnify, defend, and hold harmless the Released Parties for any and all liabilities, claims, damages, judgments, penalties, fines, expenses, and costs (including, but not limited to, attorneys’ fees and costs) arising out of or related to the tour and Holder’s participation therein.

Holder understands and agrees on behalf of his/herself and on behalf of any Minor that the Club and MLB Entities shall have the unrestricted right and license to use Holder’s and any Minor’s name, image, likeness, voice, comments, or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio sound, social media post, audiovisual, and/or other recording taken in connection with the tour for all purposes, worldwide, in perpetuity, and in any and all media now or hereafter known without consent, compensation, or further notice. The rights granted herein to the Club and the MLB Entities are freely assignable.

The Club reserves the right to revoke the license granted by this ticket for any reason by tendering to Holder any monies paid by Holder to the Club for the ticket, excluding service charges. Holder is subject to all rules and policies of the Club including those set forth in The Rockies A-Z Guest Guide to Coors Field (“A-Z Guide”) and all applicable federal, state, and local laws, rules, policies, health orders, and regulations (collectively, “Laws”) including those of the City & County of Denver and the District. The Club reserves the right, without refund of any portion of the purchase price of this ticket, to revoke the license granted by this ticket and refuse admission or remove any person from the tour and/or Coors Field that the Club deems to be in violation of the A-Z Guide or such Laws.

Any dispute, claim, or cause of action regarding the terms of this ticket, participation in a tour, any related activities, or any claims arising out of or related to this ticket or a tour (including any claim for injury or damage to property), or sales or resales of a ticket, shall be brought (i) individually, without resort to any form of class or collective action, and without joinder or consolidation of claims of third parties, and (ii) exclusively before a single, private, impartial arbitrator in a confidential, final, and binding arbitration held in Denver, Colorado administered by the American Arbitration Association under its then current Commercial Arbitration Rules. The arbitrator shall have the power to award any remedies available under applicable law. Any award and any confirming judgement applies only to the arbitration in which it was awarded and cannot be further used in any other case except to enforce the award itself. This ticket may not be used for advertising, promotion (including contests, sweepstakes, raffles, or giveaways) or other trade or commercial purposes without the express written consent of the Club. This ticket may not be resold or offered for resale in a manner, at a price, or otherwise in violation of the A-Z Guide or any Laws; any such resale will invalidate the license granted by this ticket.

All tour dates and times are subject to change. No firearms or other weapons are allowed on the premises. All bags and persons (including any Minor) are subject to search. SMOKING IS PERMITTED ONLY IN DESIGNATED AREAS; MARIJUANA IS NOT PERMITTED ANYWHERE WITHIN THE PREMISES.

COVID-19 NOTICE

COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY MINOR/ACCOMPANYING PARTIES, AGREES TO (1) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF THE CLUB.
