The 76®/Los Angeles Dodgers® Double Play Ticket Promotion 2024

PROMOTION:

The 76^® Los Angeles Dodgers^® Double Play Ticket Promotion (the “Promotion”) is sponsored by Phillips 66 Company (“Phillips 66” or “Sponsor”). During the Promotion Period (as defined below), purchase a minimum of eight (8) gallons of fuel in a single transaction using the Fuel Forward™ App (the “App”) at a participating southern California 76^® fuel station to receive a buy one (1) ticket, get one (1) ticket offer to one (1) eligible Los Angeles Dodgers home game played during the 2024 Major League Baseball regular season, subject to availability.

PROMOTION PERIOD: 12:00:01 AM, PT on March 28, 2024, through 11:59:59 PM, PT on August 14, 2024, while supplies last (the “Promotion Period”).

HOW TO PARTICIPATE:

• Purchase a minimum of eight (8) gallons of any grade fuel in a single transaction beginning March 28, 2024, through August 14, 2024, at a participating southern California 76^® gas station/convenience store using the App. If you don’t have the App, you can download it for free from the App store at https://apps.apple.com/us/app/ or Google Play at https://play.google.com/store/apps/.
• Go to the Dodger Ticket Deal Card in the App and click the “Redeem Now” button. This will take you to Dodgers.com/76 (the “Website”). Follow instructions on the Website. Participants must provide their full name, email address, and zip code in the respective fields in the online form on the Website. Participant will receive a promotional code (the “Promo Code”) after completing the online form.
• Each Participant who completes the online form will also receive a confirmation email with their Promo Code within twenty-four (24) hours after the completion of the online form.
• Visit the Website and follow the instructions on the Website, enter the Promo code, choose an eligible game date and eligible ticket(s) and complete the purchase of your ticket(s) (all online fees apply).

Each Promo Code is valid for the purchase of two (2) tickets for the price of one (1) ticket for one (1) eligible Los Angeles Dodgers home game during the 2024 Major League Baseball regular season, subject to ticket availability. All ticket transactions in connection with the Promotion must be completed online at the Website. Go to the Website to see a list of all eligible home games and the eligible seat locations for each, which shall be determined by Los Angeles Dodgers LLC at its sole discretion. Tickets obtained through this Promotion may not be exchanged or refunded, may not be used for any commercial or promotional purposes whatsoever, are for personal use only and are subject to terms and conditions applicable to Major League Baseball tickets in general. Promo Codes cannot be redeemed for cash and will not be replaced if lost or stolen. ALL PROMO CODES MUST BE REDEEMED AND TICKETS PURCHASED BY SEPTEMBER 29, 2024 OR WILL OTHERWISE BE VOID. The Promotion ticket offer may not be combined with any other offer and is not valid on previously purchased tickets.

ELIGIBILITY: The Promotion is open only to legal residents of the United States who are eighteen (18) years of age or older (except in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age, such legal age of majority) as of March 28, 2024. Employees of Sponsor, the MLB Entities (as defined below), or anyone involved in the production and distribution of materials for this Promotion and their immediate families (i.e., spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) are not eligible to participate. LIMIT ONE (1) PROMO CODE PER PERSON PER DAY, PER TRANSACTION, PER USER ACCOUNT DURING THE PROMOTION PERIOD, regardless of the number of gallons or grade of fuel purchased.

Sponsor and the MLB Entities are not responsible for printing, typographical errors, or any other errors in any Promotion-related materials or administration of the Promotion, including, but not limited to, errors in advertising and in these Official Rules, or for lost, stolen, misdirected, damaged, incomplete, or illegible Promo Codes.

Sponsor and the MLB Entities are not responsible for (a) lost, late, mutilated, illegible, misdirected, incomplete, or non-delivered mail, redemptions, text messages or email, or for interrupted or unavailable satellite, network, server, internet service provider, website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed or misdirected transmissions or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information; (b) any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in this Promotion, any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the Website; or (c) any other unforeseeable events. ANY REDEMPTION THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE REDEMPTION, IS VOID, AND WILL NOT BE HONORED. Sponsor reserves the right, at its sole discretion, to (1) disqualify any individual, who tampers with the entry process or operation of the Promotion, and (2) modify, suspend or terminate all or part of this Promotion. Caution: Any attempt by you to deliberately damage any website or undermine the legitimate operation of this Promotion is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from you to the fullest extent of the law. Sponsor is not responsible for injury or damage to a participant's or any other person's mobile phone, computer, tablet or any other entry device related to or resulting from participating in this Promotion. By participating in this Promotion, each participant accepts and agrees to these Official Rules. All transportation to and from any game and any expenses not listed herein are the ticket holder’s responsibility. Sponsor and the MLB Entities and each of their respective assigns (collectively, the “Released Parties”) shall not be liable for any circumstances which may prevent the Los Angeles Dodgers games from being played. Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see mlb.com/ticketback for details. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Each ticketholder and their guest(s) agree to comply with all applicable ballpark and venue regulations. Sponsor and the MLB Entities reserve the right to remove or to deny entry to any ticketholder and/or their guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Released Parties will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and ticket forfeiture, and may invalidate the license granted by the game/event/exhibition ticket.

LIMITATION OF LIABILITY: By accepting the Promo Codes and/or tickets, you agree to release and hold harmless the Released Parties and each of their respective parents, partners, members, managers, subsidiaries, affiliates, officers, directors, employees, agents, licensees, retailers, franchises, advertising and promotion agencies, successors, and assigns from any and all liability, including all claims arising out of, but not limited to, injuries or damages of any kind sustained in connection with your participation in the Promotion or from the receipt, acceptance, enjoyment, and/or use or misuse of any tickets obtained in connection with the Promotion. The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (“MLB”), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. The Released Parties are not responsible for incomplete, misdirected, delayed, undelivered, inaccurate, lost, late, garbled, mutilated, illegible entries, postage due mail, incorrect or inaccurate transcription of entry, electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction or unauthorized access to or alterations of entry materials, technical, network, telephone equipment, electronic, computer, hardware or software malfunctions, or limitations of any kind or for entries that for any reason are not received by Sponsor by the stated deadline. The Released Parties are not responsible for any error or malfunction that occurs when processing entries, in the announcement of the ticket giveaway, or in any promotion-related materials. The Released Parties (i) make no warranty, guaranty or representation of any kind concerning the tickets and (ii) disclaim any implied warranty.

DISPUTES: Except where prohibited, participants agree that (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will participants be permitted to obtain awards for, and participants hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the state of Texas, without giving effect to any choice of law or conflict of law rules (whether of the state of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Texas.
