PIRATES CHARITIES 50/50 RAFFLE

BRADENTON, FL - LECOM PARK - OFFICIAL RULES AND INFORMATION

Overview: All Pirates Charities 50/50 Raffle (“Raffle”) tickets, transactions, participants, purchasers and winners are subject to these Official Rules, and to all applicable statutes, rules and regulations, including, but not limited to, Section 849.0935 of the Florida Statutes, the rules and regulations adopted pursuant thereto, and all other applicable rules and regulations adopted by any regulatory and/or enforcement agency having jurisdiction with respect to the activities to which these Official Rules apply.

Raffles will be conducted at each Pittsburgh Pirates home game at LECOM Park throughout the Spring Training season. Raffle tickets will be available from the time the gates open through the last out of the 5th inning (the “Entry Period”). The winning ticket number will be drawn at the top of the 6th inning, and the number will be announced during the middle of the 6th inning. In the event that 5 or fewer innings are played, Pirates Charities reserves the right to adjust the timing of the winning ticket number drawing.

To Enter:

In Person: Entrants with an admission ticket for the applicable Pittsburgh Pirates Spring Training home game may obtain a Raffle ticket from a Raffle seller or Raffle kiosk located inside LECOM Park or by visiting the Ticket Office at LECOM Park during the Entry Period. Entrants without an admission ticket for the applicable Pittsburgh Pirates Spring Training home game may obtain a Raffle ticket by visiting the Ticket Office at LECOM Park during the Entry Period. An admission ticket for the applicable Pittsburgh Pirates Spring Training home game is not required to obtain a Raffle ticket. Obtaining a Raffle ticket does not permit the entrant to enter LECOM Park.

Online: An entrant may obtain a Raffle ticket by visiting https://pirates5050.com. DATA CHARGES MAY APPLY TO USE OF MOBILE PHONE/DEVICE TO PARTICIPATE IN THE RAFFLE. To enter, an eligible entrant must be located within the State of Florida (the “Raffle Area”) at the time of entry. Online entry is void outside the Raffle Area and where prohibited by law, rule or regulation. All online entries must include a valid e-mail address for the entrant. Online entrants to the Raffle may be given the option to receive commercial e-mail from www.pirates.com and/or www.mlb.com. If obtained online, entrants will receive a confirmation e-mail with the entrant’s Raffle numbers. Please note, there may be a delay in the e-mail delivery during times of high website traffic. Any e-mail delays do not impact an entrant’s chances of winning the Raffle. All online entries are subject to, and will be treated in a manner consistent with, Major League Baseball’s Terms of Use, which may be viewed at www.mlb.com/tou, and Privacy Policy, which may be viewed at www.mlb.com/privacy. Raffle ticket transactions generated by a script, macro or other mechanical or automated means will be disqualified. In the event of a dispute as to the identity or eligibility of any potential Raffle winner based on an e-mail address, the winning entry will be declared to have been obtained by the Authorized Account Holder (as defined below) of the e-mail address submitted at the time of entry, provided they are eligible according to these Official Rules. The “Authorized Account Holder” means the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address for the domain associated with the submitted e-mail address.

Regardless of method of entry, Raffle tickets will only be available during the Entry Period.

No purchase or contribution is necessary to enter or to win. Raffle tickets may be obtained by request or with credit or debit for the following contribution amounts:

  • 5 tickets for $10
  • 20 tickets for $20
  • 100 tickets for $50
  • 300 tickets for $100

There is a maximum of one (1) Raffle ticket per person during each Entry Period if no contribution is made. Each receipt given to the entrant contains ticket number(s) equal to the number of chances or entries obtained for that game’s Raffle. Entries are not eligible for any past or future Raffle drawings. Pirates Charities is not responsible for printing errors in any Raffle-related material or any misdirected, incomplete, lost, late or illegible tickets or other errors or problems that may limit the entrant’s ability to participate in or win any Raffle. False or deceptive entries or acts will render the entrant ineligible. No refunds will be made, except as otherwise determined by Pirates Charities in its sole discretion. Raffle ticket contributions are not tax deductible.

Eligibility: Entrants must be at least eighteen (18) years of age at the time of entry. Pirates Charities has the right to request photo identification from any person desiring to enter the Raffle. By obtaining a Raffle ticket, the entrant agrees to abide by all terms of these Official Rules and all federal, state, local and municipal laws and regulations applicable thereto. Raffle is void where prohibited by law, rule or regulation. Raffle staff members are not eligible to obtain Raffle tickets at Pittsburgh Pirates’ Spring Training home games at which they are working on, or on behalf of, said Raffle.

Random Drawing: Every transaction is electronically tallied. The running total is periodically displayed and updated in real time on the Raffle kiosks and announced throughout the ballpark. The winning ticket number is selected by random drawing through an automated computer program upon conclusion of each Raffle at the end of the 5th inning. Winners need not be present to claim their prize. One (1) winner will be chosen out of the pool of valid tickets for that game. The decisions of Pirates Charities are final and binding on all matters relating to any Raffle.

Winner Notification: The winning ticket number will be announced during the 6th inning. The winning ticket number will also be available at the Guest Relations booth by the main gate at LECOM Park. The number will also be posted on www.pirates.com/raffle within three (3) business days of the game.

Prize: The holder of the winning Raffle ticket shall be entitled to receive, subject to compliance with these Official Rules, the greater of: (a) one half (1/2) of the total amount collected by Pirates Charities on that Raffle; or (b) One Hundred Dollars $100.00.

To claim your winning prize, potential winners should go to the Guest Relations booth by the main gate at LECOM Park or call (412) 325-4720. The Raffle ticket is the only valid receipt for claiming a prize and must be redeemed either in person or via mail. The potential Raffle winner will be required to submit their valid social security number and/or other identification to Pirates Charities and shall be required to execute and return a Winning Ticket Claim Form and a Publicity Release. Upon completion of the corresponding paperwork, a check will be mailed to the winner within six (6) to eight (8) weeks of claiming their prize.

Failure to submit any identification or failure to return required documents to Pirates Charities within the specified time period, noncompliance with these Official Rules, or return of any prize or prize notification as undeliverable, may result in disqualification and the prize being forfeited and donated to Pirates Charities. Potential winners may also choose to waive their right to receive the prize, at which time the prize will be forfeited and donated to Pirates Charities.

The Raffles are governed by Florida law. All winners will be subject to the IRS rules and regulations regarding gambling winnings. For the season, Pirates Charities will complete and file IRS form W-2G and withhold federal income tax from the winner’s proceeds in accordance with IRS guidelines and regulations. Prize winners who are non-resident aliens for tax purposes will be subject to all applicable withholding and reporting requirements.

All Raffle winners will have until thirty (30) days following the conclusion of Spring Training to claim their prize. If a prize remains unclaimed after thirty (30) days following the conclusion of Spring Training, the unclaimed prize will be forfeited and donated to Pirates Charities.

Each Raffle winner assumes all responsibility for any federal, state, county or local taxes, fees or withholdings. Each winner is advised to consult with their own tax advisor(s) with respect to the liabilities that may arise from winning a prize in the Raffle. No substitute prizes are permitted.

Pirates Charities and the Pittsburgh Pirates are not responsible for any lost or stolen Raffle tickets.

Pirates Charities: Pirates Charities is a recognized 501(c)(3) charitable organization existing under the laws of Pennsylvania and is a distinct legal entity from Pittsburgh Associates, the legal entity which owns and operates the Pittsburgh Pirates Major League Baseball franchise. Pirates Charities is conducting the Raffles at LECOM Park with the permission of and limited assistance from the Pittsburgh Pirates, but Pirates Charities is solely responsible for the operation and conduct of the Raffles. Registration does not imply endorsement.

Additional Conditions: By obtaining a Raffle ticket, entrants agree to release and hold harmless Pirates Charities, Pittsburgh Associates (“Pittsburgh Pirates”), the other MLB Entities (as defined below), Bump5050, Bump Worldwide, Inc., each of their respective affiliates, and each of their respective shareholders, partners, members, directors, officers, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) against any and all claims, demands, causes of action, damages, liabilities, losses, costs and expenses arising out of or relating to, directly or indirectly, such entrant’s participation in the Raffle (including receipt and/or of any prize).

Pirates Charities, in its sole discretion, reserves the right to disqualify any person tampering within the entry process or otherwise in violation of these Official Rules. Pirates Charities further reserves the right to cancel, terminate or modify any Raffle for any reason, including, but not limited to, if any Raffle is not capable of completion as planned, including, but not limited to, infection by tampering, unauthorized intervention or technical failures of any sort, fraud or acts of God. Pirates Charities will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to any Raffle. The Released Parties make no representation, warranty or guaranty of any kind concerning any prize and disclaim any implied warranty. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All disputes will be resolved in the state and federal courts located in Allegheny County, Pennsylvania.

Any attempt to deliberately damage or undermine the legitimate operation of any Raffle may be in violation of criminal and civil laws and will result in disqualification from participation in the Raffle. Should such an attempt be made, Pirates Charities reserves the right to seek remedies and damages (including attorneys’ fees) to the fullest extent of the law, including criminal prosecution.

An entrant’s sole and exclusive remedy for any claim against Pirates Charities arising out of or relating to the sale of Raffle tickets or the conduct of the Raffle shall be the return of the purchase price paid for their Raffle ticket(s), if any. In no event shall the Released Parties be liable to any party for any special, indirect, incidental, consequential, exemplary or punitive damages, whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.

The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Enterprises, Inc., The MLB Network, LLC, Major League Baseball Properties, Inc., the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.
