PUP NIGHTS AT PNC PARK

In consideration for me and/or any accompanying minor children and/or dogs being permitted to participate in “Pup Night at PNC Park” (the “Event”), I hereby agree to the following terms and conditions:

1. I agree to abide by all instructions and rules related to participation in the Event, including the decision of any PNC Park representative regarding my ability or the ability of any accompanying minor children and/or dogs to participate in the Event safely. I further agree that any PNC Park representative may authorize reasonably necessary treatment for me and/or any accompanying minor children and/or dogs.
2. I represent that any accompanying dogs are in good health and have current rabies vaccinations. I agree to present proof of vaccination upon entry into the Event.
3. I acknowledge and agree (individually and, if applicable, on behalf of any accompanying minor children) that participating in the Event can be dangerous and may result in serious bodily injury or death to myself and/or any accompanying minor children and/or dogs. I assume (individually and, if applicable, on behalf of any accompanying minor children) the risk of all injuries or death, including those not foreseeable at this time, to myself and/or any accompanying minor children and/or dogs that may result from, or are in any manner related to, participating in the Event.
4. I hereby waive, release, discharge and covenant not to sue (individually and, if applicable, on behalf of any accompanying minor children) any or all of the Pirates, the Sports & Exhibition Authority of Pittsburgh and Allegheny County, the City of Pittsburgh, the County of Allegheny, the Commonwealth of Pennsylvania, each of their respective affiliates, and each of their respective partners, shareholders, members, officers, directors, employees, agents, and sponsors (collectively, the “Released Parties”) from and against any and all claims, demands, causes of action, damages, liabilities, losses, costs, and expenses, including attorney’s fees (collectively, “Damages”), suffered by me and/or any accompanying minor children and/or dogs as a result of, or in any manner related to, directly or indirectly, my or their participation in the Event.
5. I hereby agree (individually and, if applicable, on behalf of any accompanying minor children) to indemnify and hold each of the Released Parties harmless from and against any and all Damages suffered by a Released Party as a result of, or in any manner related to, directly or indirectly, my or their participation in the Event.
6. I hereby authorize (individually and, if applicable, on behalf of any accompanying minor children) the Pirates and their designees to use in any manner my and/or any accompanying minor children’s and/or dogs’ likenesses while participating in the Event. I hereby disclaim (individually and, if applicable, on behalf of any accompanying minor children) any right to privacy related to the use of such likenesses. I also hereby waive (individually and, if applicable, on behalf of any accompanying minor children) any and all Damages, foreseen or unforeseen, actual or potential, arising out of, or in any manner related to, use by the Pirates or their designees of such likenesses. The foregoing references to likenesses include any and all forms or reproductions of my or their image, voice or name, including, but not limited to, video, audio or photo, whether recorded or live, printed or broadcast, moving or still.
7. This Release and Waiver shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to conflict of law principles. All claims or disputes arising out of or relating to this Release and Waiver or attendance at the Event (“Claims”) shall be resolved exclusively through mandatory, confidential, final, and binding arbitration held in Pittsburgh, PA. I hereby agree (individually and, if applicable, on behalf of any accompanying minor children) that all Claims shall be arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a claim of any other party. I hereby waive (individually and, if applicable, on behalf of any accompanying minor children) all rights to a jury trial in any action or proceeding involving any Claim.
