Kansas City Royals Hit For Your Seats Official Rules

The following describes the Official Contest Rules for the 2020 Royals Hit For Your Seats Contest (the "Contest"). The Contest is subject to all applicable federal, state and local laws, rules and regulations. Void outside the states listed below, and where prohibited by law, rule or regulation. Contest entrants must be eligible and qualify to win by satisfying the terms, requirements and conditions set forth below:

1. Sponsor: The Sponsor of the Contest is Kansas City Royals® Baseball Corporation ("Sponsor" or "Kansas City Royals").

2. Eligibility. To participate in the Contest, a person must (a) purchase or renew, and submit payment in full or a Deposit for, an Eligible Package by 4:49 PM Central Time ("CT") on October 11, 2019 (b) register for the Contest in accordance with Section 3 below; and (c) be of legal age of majority in his/her jurisdiction and at least eighteen (18) years of age at the time of registration and a legal resident of Iowa, Kansas, Missouri or Nebraska. "Deposit" means a non-refundable payment of a portion the Eligible Package cost required to reserve an Eligible Package. Due to time and space restraints, participation is limited to the first 600 people to meet the above requirements.

"Eligible Package" means a Kansas City Royals partial (20-game), half (40- or 41-game), Select 64, or full (81-game) regular season ticket plan for the Kansas City Royals 2020 regular season.

Professional Baseball Players and Colligate Baseball Players are not eligible to participate in the Contest. "Professional Baseball Player" means any individual who was on the roster of a Club (defined below), Minor League Baseball club or independent league baseball team at any time. "Colligate Baseball Player" means any individual with college baseball experience, other than intramural activities, at any time after December 31, 2006 and any individual who has signed a Letter of Intent to play collegiate baseball at any time after December 31, 2006.

Ticket brokers/re-sellers (as defined by the Kansas City Royals in its sole and absolute discretion) are not eligible to participate in the Contest.

Employees of Sponsor, the MLB Entities and each of their respective parent companies, affiliates, owners, subsidiaries, divisions, advertising and promotional agencies and their respective officers, directors and agents (including immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) are not eligible to participate (together with Sponsor, the "Contest Parties"). "MLB Entities" means the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM" or "MLB.com"), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs ("Clubs"), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.

3. Registration. Beginning on or about August 29, 2019, the Kansas City Royals will notify the primary account holder on record of each Eligible Package (each person so notified and eligible pursuant to Section 2, an "Eligible Package Participant"). Notification will be made via email to the email address on file for the Eligible Package Participant. To register to participate in the Contest, the Eligible Package Participant must follow the instructions in the email to sign up by completing and signing the Kansas City Royals Hit For Your Seats Registration Form (the "Registration Form") and returning it to the Kansas City Royals by email at [email protected] on or before 2:00 PM Central Time ("CT") on October 15, 2019. Each Eligible Package Participant properly registering, is a "Package Participant". Limit of one (1) registration per Kansas City Royals Eligible Package. In the event a Package Participant is unable to attend the Promotion Event, the Package Participant may designate a proxy to take his or her official Batting Turn ("Proxy Participant" and together with Package Participants, "Participants") by completing and signing the proxy designation on the Registration Form. Package Participant must have permission from the Proxy Participant to designate him/her as such and to submit any of his/her name. The Proxy Participant must meet all of the eligibility requirements of Section 2 of these Official Rules, except the Proxy Participant is not required to have an Eligible Package in order to take an official Batting Turn. Proxy Participants are not eligible to be a Grand Prize Winner or Additional Prize Winner, as further described below. A Proxy Participant may only take one (1) official Batting Turn at the Promotion Event (i.e., a Proxy Participant may only participate in the Promotion Event for one (1) Package Participant). All information submitted online is subject to, and will be treated in a manner consistent with, Major League Baseball's website (MLB.com) Terms of Use accessible at: mlb.com/tou and Privacy Policy accessible at: mlb.com/privacy.

4. Hit For Your Seats. On October 18, 2019, at Kauffman Stadium in Kansas City, Missouri (the "Contest Event"), each Participant will have the opportunity to step in the batter's box for one (1) official Contest Batting Turn. A "Batting Turn" is defined as the first to occur of the following: (i) five (5) pitched balls, regardless of whether a Participant swings, and (ii) a Participant hitting a Home Run. Baseballs will be pitched by an automatic pitching machine at a height, speed and interval to be determined by the Kansas City Royals at its sole and absolute discretion.

5. Batting Turn Conditions. Participants must present valid identification on the day of the Contest Event in order to participate. All Participants must sign a waiver prior to entering the batter's box and must wear a batting helmet and use a baseball bat provided by the Kansas City Royals. The exact time, order, nature and duration of an official Batting Turn will be determined by the Kansas City Royals at its sole discretion. Transportation to/from Kauffman Stadium, parking and lodging are not included and are the responsibility of each Participant. Each Participant agrees to comply with all applicable ballpark regulations in connection with his/her participation in the Contest Event. The Contest Parties reserve the right to remove or to deny entry to any Participant who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the Contest Event. Participants must use bats and balls provided by the Kansas City Royals. Such bats and balls will remain the property of the Kansas City Royals. The Contest Parties will not be responsible for Participants missing their official Batting Turn for any reason or for weather conditions, acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of the Contest Event. The Kansas City Royals, in its sole and absolute discretion, will determine whether conditions (weather or otherwise) at Kaufmann Stadium on the date of the Contest Event is held are suitable for the Contest Event to begin and/or continue to its conclusion. In the event of inclement weather, as determined in the sole discretion of the Kansas City Royals, Eligible Participants will be notified of an alternate Contest Event date.

6. A Winning Hit. If a Participant hits a Home Run during his/her official Batting Turn, he/she (if a Package Participant) or the Package Participant who designated him/her (if a Proxy Participant) will be declared a winner of the Contest (each a "Grand Prize Winner" and collectively, the "Grand Prize Winners"). A "Home Run" will occur when the baseball is hit over the outfield wall of Kaufmann Stadium, in fair territory, without first bouncing on the field or foul territory during the official Batting Turn. The ultimate determination of whether a hit constitutes a Home Run will be made by the Kansas City Royals, in its sole and absolute discretion.

7. Additional Ways to Win. The Kansas City Royals will place targets on the Kaufmann Stadium playing field (the "Targets"). The size and placement of the Targets will be determined by the Kansas City Royals in its sole and absolute discretion. If a Participant hits a pitched ball during his/her official Batting Turn that (a) comes to rest inside or hits a Target, as applicable, or (b) hits the outfield wall on a fly in fair territory without aid of or interference by any person or object, he/she (if a Package Participant) or the Package Participant who designated him/her (if a Proxy Participant) will be declared an Additional Prize winner of the Contest ("Additional Prize Winner" and together with the Grand Prize Winners, the "Winners"). The ultimate determination of whether a Participant qualifies as an Additional Prize Winner will be made by the Kansas City Royals, in its sole and absolute discretion.

8. Grand Prizes. Each Grand Prize Winner will receive the lessor of (i) the full payment amount of his/her Eligible Package (including for the avoidance of doubt, the Deposit); or (ii) a Ten Thousand Dollar ($10,000) credit to be deducted from the full payment amount owed for his/her Eligible Package (the "Grand Prize" and together with the Additional Prizes, the "Prize(s)"). The approximate retail value ("ARV") of each Prize is dependent upon the purchase price of the Grand Prize Winner's Eligible Package (maximum of $10,000). For avoidance of doubt, the value of Eligible Packages does not include any Postseason tickets or tickets for any MLB Jewel Events. Limit one (1) Grand Prize per Package Participant. No Proxy Participant is eligible to claim the Grand Prize.

9. Additional Prizes. Each Additional Prize Winner pursuant to Paragraph 7 will receive one (1) Additional Prize per Additional Prize event achieved (maximum of three (3)) of Additional Prize Winner's choice, subject to availability. The "Additional Prizes" are as follows, each with their ARV:

One (1) Kansas City Royals Player Bobblehead - $20
Two (2) Season Ticket Member Pint Glasses - $20
One (1) Season Ticket Member Flag - $10
One (1) Autographed Baseball signed by one (1) 2019 Kansas City Royals player determined by Sponsor at its sole discretion - $50

No Proxy Participant is eligible to claim an Additional Prize. Players featured on Bobblehead and Autographed Baseball subject to availability.

10. Grand Prize & Additional Prize Conditions. All Grand Prize and Additional Prize details will be determined in the sole and absolute discretion of the Kansas City Royals. Each Winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). In order to claim the Grand Prize or an Additional Prize, each Winner must complete and sign an affidavit, Prize claim, release and all applicable tax forms. All costs and expenses associated with a Prize acceptance and use, including, but not limited to, lodging, transportation costs, meals, gratuities and other expenses incurred by a Winner accepting a Prize, are the sole responsibility of each individual Winner. The Prizes are non-transferable and non-assignable, except at Kansas City Royals' sole and absolute discretion.

11. Waiver of Liability/Publicity Release. By participating in the Contest, each Participant agrees to (a) be bound by these Official Rules, and (b) waive any and all claims against the Kansas City Royals and the other Contest Parties for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Contest or from the receipt or use of any Grand Prize or Additional Prize (or any portion thereof) or any travel or activity related to the receipt or use of any Prize (or any portion thereof). By registering for this Contest, each Participant gives his/her express permission to be contacted by the Kansas City Royals and/or MLBAM by telephone, email and/or postal mail for Contest purposes. Each Winner, by acceptance of a Prize, grants to the Kansas City Royals, MLBAM and each of their respective designees the right to publicize such Winner's name, address (city and state of residence), photograph, voice, statements and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.

12. General Terms. The Contest Parties are not responsible for late, incomplete, inaccurate, delayed, undelivered transmissions, email or mail; or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections including those through and/or by any website, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; wireless service congestion; failures or malfunctions of phones, phone lines or telephone systems, wireless towers or cellular tower equipment; any error, omission, interruption, defect or delay in wireless or other transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed email notifications; printing, typographical or other errors appearing within these Official Rules, in any Contest-related advertisements or other materials; or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, wireless service, mail, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, or the cancellation or postponement of any official Batting Turns. Persons who tamper with or abuse any aspect of the Contest or attempt to undermine the legitimate operation of the Contest by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any representative of the Kansas City Royals or the other MLB Entities or who are in violation of these Official Rules, as solely determined by the Kansas City Royals, will be disqualified and all associated registrations will be void. Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by the Kansas City Royals, the MLB Entities or their respective agents. The Kansas City Royals will have the sole right to disqualify any individual for violation of these Official Rules or any applicable laws relating to the Contest, and to resolve all disputes in its sole discretion. The Kansas City Royals' failure to enforce any term of these Official Rules will not constitute a waiver of that provision.

The Kansas City Royals reserves the right, in its sole discretion, to cancel or suspend the Contest (or any portion thereof) should unauthorized human intervention or any other cause corrupt the administration, security, fairness, integrity or proper operation of the Contest (or any portion thereof). The Kansas City Royals also reserves the right, in its sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE KANSAS CITY ROYALS WILL DISQUALIFY ANY REGISTRANT RESPONSIBLE FOR THE ATTEMPT, AND THE KANSAS CITY ROYALS, THE OTHER MLB ENTITIES AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Disputes. As a condition of entering this Contest, each Participant agrees that (a) any and all disputes, claims, controversies or causes of action arising out of or relating to this Contest, or any Prizes awarded (each, a "Claim"), will be (i) arbitrated on an individual basis only, and will not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party, and (ii) settled by binding arbitration in the State of Missouri before a single arbitrator appointed by AAA in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (b) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses. These Official Rules will be governed by and construed and interpreted in accordance with the laws of the State of Missouri applicable to contracts entered into and performed exclusively in the State of Missouri.
