Rogers Centre Concerts and Live Events - Ticket Terms & Conditions
THIS TICKET IS A REVOCABLE LICENSE/LIMITS HOLDER’S LEGAL RIGHTS;
HOLDER VOLUNTARILY ASSUMES RISK OF ILLNESS/INJURY; NO RE-ENTRY
This ticket is a revocable license issued to the buyer and/or bearer (“Holder”) by Rogers Stadium Limited Partnership (“RSLP”) permitting Holder to enter the publicly-accessible areas of Rogers Centre stadium (the "Stadium”) to attend the sporting, entertainment or other event taking place at the Stadium for which this ticket is issued (the “Event”). By using this ticket Holder, on their own behalf and on behalf of any minor or other accompanying party for whom Holder retains a ticket (each of whom Holder represents have authorized Holder to act on their behalf in accepting the Agreement) (any such minor and/or other accompanying party being referred to herein as an “Accompanying Party”) agrees to the terms and conditions available at http://www.bluejays.com/rogerscentreticketterms (the “Agreement”), which are summarized below. RSLP may update the terms of the Agreement, without notice and Holder’s use of this ticket will mean that Holder accepts such updates. Holder agrees, on their own behalf and on behalf of any Accompanying Party, to the collection, use and disclosure of personal information by RSLP in accordance with its privacy policy, available at www.bluejays.com/rogerscentreprivacypolicy.
Holder acknowledges and agrees that each individual wishing to enter the Stadium for the purposes of observing the Event must hold and present their own individual ticket upon entry. Holder agrees to transfer any individual ticket(s) that they are holding on behalf of any other individual(s) (including any Accompanying Party) to such other individual(s) prior to entry. Holder is responsible for any violation of the Agreement by Holder or any Accompanying Party.
This ticket must be produced upon entry to the Stadium and upon request anytime thereafter. No re-entry into the Stadium will be permitted. Holder, on their own behalf and on behalf of any Accompanying Party, (a) consents to security searches, screenings and/or inspection of Holder’s and/or any Accompanying Party’s person, bags, clothing, or other articles for security purposes, whether by walk-through metal detection, handheld metal detection, bag checks or otherwise by RSLP, the performer(s) and/or the producer or licensor of the applicable Event; and (b) acknowledges and agrees to comply with (i) all policies/protocols of RSLP, the performer(s) and/or the producer or licensor of the applicable Event (including for security, bags, fan conduct, health & safety, stadium rules, code of conduct, standards of conduct, and the terms/conditions presented at purchase) and (ii) all applicable laws, policies and guidance of federal, provincial, municipal and local authorities (including all current guidance of Toronto Public Health, Public Health Ontario, and the Public Health Agency of Canada or other applicable public health authority) (subsections (i) and (ii) are, collectively, the “Applicable Policies”).
RSLP, the performer(s) and the producer or licensor of the applicable Event reserve the right, without refund of any portion of the purchase price, to revoke the license granted by this ticket and refuse admission to, or eject from, the Event, Holder and any Accompanying Party if any such person (a) violates the terms of the Agreement, including without limitation any Applicable Policy; (b) is in possession of any item or object considered potentially dangerous, hazardous, inappropriate and/or injurious to other patrons, and any prohibited items may be confiscated; (c) appears to be or is intoxicated; (d) engages in conduct deemed by any of RSLP, the performer(s) and/or the producer or licensor of the applicable Event to be improper, disorderly, unbecoming, abusive, illegal or objectionable, or might otherwise interfere with the Event or the reasonable enjoyment of others; (e) uses vulgar or abusive language; or (f) poses a risk to the health or safety of others.
Holder, on their own behalf and on behalf of any Accompanying Party, (a) agrees not to transmit/aid in transmitting any account, description, picture, video, audio, reproduction or other information concerning the Event and (b) consents to and waives compensation for use of their image/personality rights in connection with the Event.
WARNING – AN INHERENT RISK OF EXPOSURE TO AIRBORNE, AEROSOLIZED, OR SURFACE TRANSMISSIBLE INFECTIOUS AND/OR COMMUNICABLE DISEASES, VIRUSES, BACTERIA, OR ILLNESSES, THE CAUSES THEREOF, OR ANY STRAINS, VARIANTS OR MUTATIONS THEREOF, INCLUDING, BUT NOT LIMITED TO, THE SEVERE ACUTE RESPIRATORY SYNDROME CORONAVIRUS 2, THE COVID-19 CORONAVIRUS DISEASE, AND INFLUENZA (COLLECTIVELY, “COMMUNICABLE DISEASES”) EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER AGREES TO (A) ASSUME ALL RISKS OF ANY COMMUNICABLE DISEASES, AND (B) COMPLY WITH ALL APPLICABLE POLICIES.
Holder, on their behalf and on behalf of any Accompanying Party, acknowledges, and expressly and voluntarily assumes all risks that are in any way related to or arising from attending and observing the Event, including being exposed to or contracting Communicable Diseases in the Stadium. Holder releases and covenants not to sue RSLP, the performer(s), the performer(s), the producer or licensor of the applicable Event, Canada Lands Company CLC Limited, Infrastructure Ontario, any local or provincial governmental body associated with the Stadium, the ticket vendor and/or provider (including Ticketmaster, L.L.C and Ticketmaster Canada LP), each of their past, present and future corporate affiliates, successors, assigns, employees, partners, members, directors, officers, owners, agents, representatives and independent contractors of such entities (collectively, “Releasees”), from claims arising out of the Event, even if due to the sole/joint/comparative negligence, or strict liability, of Releasees (“Released Claims”) and will indemnify Releasees from and against the Released Claims.
BY ATTENDING AND/OR PARTICIPATING IN THE EVENT, HOLDER, ON THEIR OWN BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTY, AS WELL AS HOLDER’S AND ANY ACCOMPANYING PARTY’S PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, NEXT OF KIN AND ANY OTHER PERSON OR ENTITY THAT MAY BE ENTITLED TO MAKE A CLAIM ON THEIR BEHALF, IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASEES TO THE FULLEST EXTENT PERMITTED BY LAW. IF HOLDER IS UNABLE TO AGREE TO THE AGREEMENT ON BEHALF OF AN ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY MUST LEAVE THE EVENT.
Holder will indemnify, defend and hold harmless the Releasees from and against any and all demands, suits, claims, costs (including reasonable attorneys’ fees and expenses), expenses and liability arising out of, incidental to or related in any way to (i) Released Claims, (ii) Holder’s and/or any Accompanying Party’s acts or omissions, or (iii) Holder’s breach of any of the terms, conditions or representations made in the Agreement.
HOLDER AGREES THAT THE INDEMNITY OBLIGATIONS AND LIABILITIES ASSUMED HEREIN ARE WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF, INCLUDING THE SOLE, JOINT, OR CONCURRENT NEGLIGENCE OF ANY RELEASEE, WHETHER ACTIVE OR PASSIVE, STRICT LIABILITY, LATENT, PATENT, OR PRE-EXISTING DEFECTS OR CONDITIONS, AND INCLUDING ANY CLAIMS ARISING OUT OF INGRESS, EGRESS, LOADING AND UNLOADING OF PERSONNEL OR CARGO.
EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAWS, ANY DISPUTE, CLAIM OR CAUSE OF ACTION ARISING OUT OF OR IN ANY WAY RELATED TO THE AGREEMENT, INCLUDING, BUT NOT LIMITED TO, HOLDER’S OR ANY ACCOMPANYING PARTY’S ATTENDANCE AT THE EVENT, SHALL BE SETTLED BY MANDATORY, CONFIDENTIAL, FINAL, AND BINDING ARBITRATION, PURSUANT TO THE ARBITRATION ACT, 1991 (ONTARIO). THE PLACE OF ARBITRATION SHALL BE TORONTO, ONTARIO, CANADA. HOLDER MAY NOT JOIN/CONSOLIDATE CLAIMS IN ARBITRATION OR ARBITRATE AS A REPRESENTATIVE MEMBER OF A PUTATIVE CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR SIMILAR PROCEEDING.
The Agreement will be governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein. If any part of the Agreement is held to be invalid or legally unenforceable for any reason, the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable.
