2023 New York Mets Teen Club Membership Program Terms & Conditions
  1. Participation and Eligibility. Participation in the 2023 New York Mets Teen Club membership program (the “Program”) is subject to the rules, regulations, policies, and procedures set forth in these terms and conditions or otherwise communicated to participants (collectively, the “Terms”). Sterling Mets, L.P. d/b/a New York Mets (the “Club”) has the right to change, limit, or otherwise amend the Terms at any time in its discretion, and reserves the right to cancel the Program at any time without notice. The Program is only open to teenagers thirteen (13) through fifteen (15) years of age. Eligible teenagers enrolled in the Program will have their membership continue until 11:59:59 PM ET on the date prior to their sixteenth (16th) birthday, at which time the membership will automatically terminate. The Club reserves the right to request proof of eligibility at any time.

  2. Enrollment; Cancellation. To sign up, an eligible teenager’s parent or legal guardian must enroll their teenager in the Program by visiting mets.com/teenclub and clicking the Sign-Up for Free Button and completing the mets.com form. The mets.com Privacy Policy explains how submitted information may be collected and used. By enrolling in the Program, each enrolled teenager’s parent or legal guardian, on behalf of themselves and their teenagers, agree to be bound by the Terms. To cancel an enrolled teenager’s membership, a parent or legal guardian should email [email protected], with the subject line: “New York Mets Teen Club – Cancellation,” and include your name and the name of your enrolled teenager in the body of the email. Please allow 7 - 10 days for your request to be processed.

  3. Limits; Membership Revocation. There is a limit of one membership ID per teenager. Membership IDs are not transferable. If the Club suspects that an enrolled teenager or their parent/legal guardian has failed to comply with these Terms, no longer meets the eligibility requirements, has engaged in fraudulent or inappropriate activity, as the Club determines, in its sole discretion, the Club reserves the right to terminate the membership.

  4. Waiver of Liability; Publicity Release. By enrolling in the Program, parents and legal guardians, on behalf of themselves and their enrolled teenagers, agree to waive any and all claims against the Club, Queens Ballpark Company, L.L.C., the MLB Entities, and each of their respective parent, subsidiary, or affiliated companies, shareholders, owners, partners, employees, officers, directors, and agents, and the City of New York, the New York City Department of Parks and Recreation, the New York City Economic Development Corporation and the New York City Industrial Development Agency (“Released Entities”) arising out of or related to their participation in the Program or any travel or activity related to the Program. “MLB Entities” means MLB Advanced Media, L.P., the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, the Club and other Major League Baseball Clubs (collectively, the “MLB Clubs”), Major League Baseball Properties, Inc., The MLB Network, LLC, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the MLB Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. By enrolling in the Program, parents and legal guardians, on behalf of themselves and their enrolled teenagers, grant the Club and the other MLB Entities the irrevocable, transferable, sublicensable and assignable right to use and/or publicize such parent/legal guardian’s or enrolled teenager’s name, city and state of residence, photograph, voice, statements, and/or other likeness, and/or experience or prize information (if applicable) (“Content”) in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, except to the extent prohibited by law. In addition, in connection with the use of the Content, parents and legal guardians, on behalf of themselves and their enrolled teenagers hereby release and waive any action or cause of action that parents and legal guardians, on behalf of themselves and their enrolled teenagers may assert in connection with the use of the Content including, but not limited to, any claims which parents and legal guardians, on behalf of themselves and their enrolled teenagers have or may have for invasion of privacy, defamation, violation of any right of publicity, or any other cause of action arising out of the production, reproduction, distribution, transmission, publication, public performance, broadcast, or exhibition of advertisements, promotions, content, programs and/or materials in which the Content appears.

  5. Governing Law. In the case of violation of applicable laws, regulations, or the Terms, or fraud or abuse involving the Program, the Club will have the right to take appropriate administrative and/or legal action, including, but not limited to, revocation of the membership and violators will be liable for payment of all fines, penalties, costs, fees, and any other monies owed pursuant to applicable law. If any term of these Terms is held to be unlawful or unenforceable, such decision shall not affect the validity of any remaining provisions of these Terms, which shall be enforced to the fullest extent permitted by law. The Program is governed by the laws of the State of New York.

  6. Arbitration; Class Action Waiver. Any dispute, claim or cause of action arising out of these Terms, including, but not limited to, parents and legal guardians of enrolled teenagers and their enrolled teenagers’ participation in the Program, shall be settled by mandatory, confidential, final, and binding arbitration. The arbitration shall be held in New York County, New York, and administered by JAMS in accordance with its then-existing commercial arbitration rules (except for any rules authorizing class arbitration). There shall be a single arbitrator to be selected in accordance with those rules. Neither parents/legal guardians of enrolled teenagers, the enrolled teenagers, nor any MLB Entity shall be entitled to join or consolidate claims in arbitration by or against other individuals or entities, or arbitrate as a representative member of a putative class or in a private attorney general capacity. The arbitrator shall have the power to award any remedies available under applicable law; provided, however, that the arbitrator shall have no authority to award punitive or other monetary damages not measured by the prevailing party’s actual damages, except as may be required by statute. Any award and any judgment confirming it only applies to the arbitration in which it was awarded and cannot be used in any other case except to enforce the award itself.
