Season Ticket Account - Terms and Conditions

1. THE TICKETS DESCRIBED ON THE REVERSE SIDE OF THESE TERMS AND CONDITIONS (THE "SEASON TICKETS") ARE REVOCABLE LICENSES AND NO PROPERTY RIGHTS ARE GRANTED TO THE ACCOUNT HOLDER (THE "ACCOUNT HOLDER"). THE BOSTON RED SOX BASEBALL CLUB LIMITED PARTNERSHIP (THE "CLUB") RETAINS THE RIGHT TO REFUSE TO RENEW THE SEASON TICKETS IN SUBSEQUENT YEAR(S) AND/OR LIMIT THE NUMBER OF SEASON TICKETS AVAILABLE FOR PURCHASE. THE CLUB RESERVES THE RIGHT TO REASSIGN THE SEASON TICKETS AT ANY TIME PRIOR TO OR DURING A SEASON (AS DEFINED BELOW) IN THE CLUB'S SOLE DISCRETION, AND RESERVES THE RIGHT TO REVOKE THE SEASON TICKETS AT ANY TIME AND FOR ANY REASON IN ITS SOLE DISCRETION, INCLUDING FOR VIOLATION OF ANY CLUB POLICIES, INCLUDING THOSE SET FORTH ON THE BACK OF THE SEASON TICKETS OR ON WWW.REDSOX.COM, SUCH AS ANY RESTRICTIONS ON TICKET RESALE, OR IF THE ACCOUNT HOLDER FAILS TO PAY ANY INVOICED AMOUNT BY THE REQUIRED DUE DATE.

2. ACCOUNT HOLDER ACKNOWLEDGES AND AGREES THAT ALL TICKET SALES ARE FINAL AND NO REFUNDS WILL BE MADE.

3. All inquiries and correspondence relating to the Season Tickets must be provided to the Club in writing. No verbal address changes are permitted. No postseason rights to the Season Tickets are conferred on the Account Holder. If the Club is involved in any postseason play, Account Holders having "Plan A" Season Tickets will be given the opportunity to purchase a number of seats for each postseason game that is equal to the number of Season Tickets on the reverse side of this form. The decision to provide any non-"Plan A" Account Holders with the opportunity to purchase postseason tickets is at the Club's sole discretion. Any postseason seat locations made available for purchase will be determined by the Club in its sole discretion. In the event of a conflict between the terms and conditions of these Season Ticket Account - Terms and Conditions and the terms and conditions of any separate seat license agreement entered into between the Club and the Account Holder (the "Seat License Agreement"), the terms of the Seat License Agreement shall control.

4. This Section 4 applies only to Account Holder's that have enrolled in an automatically renewing Season Ticket program:

4.1 THE ACCOUNT HOLDER'S PURCHASE OF THE SEASON TICKETS SHALL AUTOMATICALLY RENEW PRIOR TO EACH SEASON, SUBJECT TO THE TERMS AND CONDITIONS SET FORTH HEREIN. BY ENROLLING IN THE CLUB'S AUTOMATIC RENEWAL PROGRAM, ACCOUNT HOLDER GIVES THE CLUB THE AUTHORIZATION TO CHARGE ACCOUNT HOLDER'S CREDIT/DEBIT CARD FOR THE SEASON TICKETS FOR THE 2026 MAJOR LEAGUE BASEBALL REGULAR SEASON (THE "2026 SEASON") AND EACH CLUB SEASON THEREAFTER (EACH, A "SEASON"), AND ACCOUNT HOLDER AGREES TO THE TERMS AND CONDITIONS LISTED HEREIN.

4.2 ACCOUNT HOLDER ACKNOWLEDGES THAT THE SEASON TICKETS WILL AUTOMATICALLY RENEW BEFORE THE START OF EACH SEASON UNLESS ACCOUNT HOLDER OPTS-OUT, AS DESCRIBED HEREIN. ON OR ABOUT OCTOBER 15TH OF EACH YEAR, THE CLUB WILL EITHER (i) SEND ACCOUNT HOLDER A RENEWAL INVOICE AND ACCOUNT HOLDER WILL HAVE UNTIL NOVEMBER 15TH ("OPT-OUT DEADLINE") TO OPT-OUT OF AND DECLINE TO PURCHASE THE SEATS FOR THE UPCOMING SEASON AS DESCRIBED HEREIN, OR (ii) SEND ACCOUNT HOLDER A TERMINATION NOTICE (EMAIL SHALL SUFFICE) AND IN SUCH CASE THIS AGREEMENT WILL TERMINATE EFFECTIVE UPON THE DATE OF SUCH TERMINATION NOTICE. IN THE EVENT ACCOUNT HOLDER DECIDES TO OPT-OUT, ACCOUNT HOLDER MUST EITHER (i) SUBMIT THE DIGITAL OPT-OUT FORM PROVIDED BY EMAIL, OR (ii) REQUEST A PAPER COPY OF THE OPT-OUT FORM BY EITHER (1) CONTACTING ITS ACCOUNT MANAGER DIRECTLY OR (2) CONTACTING THE ACCOUNT HOLDER'S CLIENT SERVICES TEAM AT CLIENTSERVICES@REDSOX.COM. ACCOUNT HOLDER MUST SUBMIT THE DIGITAL OPT-OUT FORM OR A PAPER COPY OF THE OPT-OUT FORM ON OR BEFORE THE OPT-OUT DEADLINE.

4.3 The Account Holder's authorization for the Club's automatic renewal program remain in full force and effect until the Club has received written notification of Account Holder's desire to terminate the authorization in the time and manner specified herein as to afford the Club and Account Holder's credit card company or bank a reasonable opportunity to terminate the transaction. Account Holder agrees that if Account Holder's credit card numbers change, Account Holder will notify the Club of such changes and this authorization will remain in effect for the new account number(s) provided.

5. Account Holder understands and agrees that Club is not liable in any way for erroneous bill statements or incorrect charges and that should an error occur in billing, the Club's only responsibility is to correct such error if and when the Club receives notice of such error or Club otherwise becomes aware of such error. Account Holder hereby waives all claims against the Club for indirect or consequential liability for any errors in payment processing or resulting from the timing of payment. Account Holder understands that individual banks have individual processing times and may process the transaction(s) at a later date than the date on which the Club's transaction is processed. Account Holder understands that it is Account Holder's obligation to provide the Club with any changes or updates to Account Holder's payment information in a timely manner, and Account Holder agrees that if Account Holder's credit/debit card is declined for any reason, Account Holder will be responsible for promptly paying any and all balances when due. Failure to adhere to the payment schedule specified by the Club may result in denied entry to any Club Major League Baseball game, and the Club reserves the right to restrict entry to Club Major League Baseball games and/or revoke Account Holder privileges if the account is not paid in full or paid in accordance with the payment schedule specified by Club and/or if any authorized charge is refused by the applicable credit card company or bank for any reason. Only Visa, MasterCard, American Express and Discover credit/debit cards shall be accepted.

6. Account Holder agrees to abide by all terms and conditions applicable to season ticket holders, including, but not limited to, those set forth herein and those terms, conditions, rules and regulations provided (1) on the Boston Red Sox website, (2) on each ticket, and (3) on signage at Fenway Park, and understands that failure to abide by these terms and conditions may result in the revocation of Account Holder privileges.

7. These Season Ticket Account – Terms and Conditions and the authorization set forth herein are governed by the laws of the Commonwealth of Massachusetts.
