Milwaukee Brewers 2020 Ten Percent Bonus Program
Terms and Conditions
In response to the postponement of certain 2020 Regular Season games, the Milwaukee Brewers Baseball Club, LP (the “Brewers”) has established the “2020 Ten Percent Bonus Program” (the “Program”). Below are the Terms and Conditions that apply to and govern the Program.
Eligibility:
The Program is directly available to individuals and entities who purchased tickets from the Brewers for home games that were scheduled to be played by the Brewers at Miller Park during the 2020 Regular Season, but which games were officially postponed for reasons related to the COVID-19 pandemic (“Postponed Games”).
The individuals and entities eligible for this program include the following Ticket Plan Holders of four (4) games or more, Group Ticket purchasers, and Suite Rental purchasers who have made a down payment to the Brewers for Postponed Games (“Eligible Ticket Holders”).
Eligible Ticket Holders do not include individuals or entities who purchased or otherwise acquired tickets for Postponed Game(s) in any of the following ways: (i) from or through third-party platforms or outlets (for example, StubHub, Vivid Seats, Gametime, SeatGeek and/or others); (ii) as a single game ticket; (iii) for multi-game suite leases (i.e., 20 game, half season or full season suite leases); (iv) for purposes of resale and not for personal use, as determined by the Brewers in its sole and absolute discretion; (v) pursuant to a Sponsorship Agreement or a Trade/Barter Agreement with the Brewers; (vi) pursuant to the internal ticket policies available to associates of the Brewers. Furthermore, the Brewers shall have the right, in its sole and absolute discretion, to preclude any individual or entity from participating in the Program based on the manner in which a ticket was acquired (e.g. free of charge). Any Eligible Ticket Holder who is precluded from participating in the Program will not receive the Bonus (as those terms are defined below), but may remain eligible to receive a refund of the ticket purchase price, service fees, and other applicable amounts paid in connection with Postponed Games.
These Program Terms and Conditions are subject to all Brewers terms and conditions applicable to the Eligible Ticket Holder’s ticket package, which terms and conditions are incorporated herein in their entirety by reference.
Eligible Ticket Holder Options:
Eligible Ticket Holders may choose either a refund of the relevant amounts paid for Postponed Games, or may elect to receive the Bonus Option, below.
The Bonus:
If an Eligible Ticket Holder selects to receive a refund, the Brewers will issue a refund of the total amount paid by the Eligible Ticket Holder, per ticket account, for all Postponed Games (but in no event in an amount greater than the amount that the Eligible Ticket Holder paid to the Brewers in connection with Postponed Games) and for any parking that was paid for Postponed Games. Service charges and processing fees will be refunded. Delivery fees are non-refundable. No Eligible Ticket Holder who requests a refund will be eligible to receive a Bonus as defined below).
If a refund is not requested by August 1, 2020, the Brewers will (i) apply the full amount an Eligible Ticket Holder paid to the Brewers for Postponed Games plus (ii) any amount paid to the Brewers for parking related to Postponed Games (the “Postponed Games Account Balance”) to the Eligible Ticket Holder’s account, and (ii) add a bonus in the amount of ten percent (10%) of the Postponed Games Account Balance (the “Bonus”). The Bonus will be held without interest and may be applied to the cost of a Qualified Purchase, as defined below.
Example: An Eligible Ticket Holder purchased a 2020 Full Season Ticket Package from the Brewers in November 2019. All games in the Full Season Package were postponed. The amount paid by the Eligible Ticket Holder in connection with Postponed Games was $1,000. Under the Program, the Brewers will place the Postponed Games Account Balance of $1,000 in the Eligible Ticket Holder’s account, together with a Bonus of 10% ($100) which will be applied to a Qualified Purchase.
Qualified Purchase(s):
All Eligible Ticket Holders may use their Postponed Games Account Balance and any Bonus toward the cost of the following, all of which are considered “Qualified Purchases”:
(i) purchase of single game or group tickets for any home game at Miller Park during the 2020, 2021, or 2022 seasons for which tickets are sold;
(ii) renewal of their 2021 and/or 2022 Brewers ticket plan of 4 or more games; and/or
(ii) purchase of pre-paid parking, tailgate permits, or pavilion rentals for any home game at Miller Park during the 2020, 2021, and 2022 seasons for which tickets are sold.
An Eligible Ticket Holder may not apply the Bonus, or any portion thereof, until the Eligible Ticket Holder has fully applied the entire amount of any Postponed Games Account Balance.
Eligible Ticket Holders may not use the Postponed Games Account Balance or the Bonus (or any portion of either amount) to purchase the following: tickets to (a) concerts, (b) any other non-baseball event held at Miller Park during the 2020, 2021, or 2022 seasons, or any restricted games, such as Postseason, designated by the Brewers. Nothing herein shall limit the Brewers rights with respect to the sale of tickets, or with respect to the status of tickets as revocable licenses.
The Bonus (and therefore the Postponed Games Account Balance) must be applied toward a Qualified Purchase on or before the end of the 2022 Major League Baseball Season. If the Bonus is not applied toward a Qualified Purchase on or before the end of the 2022 Major League Baseball Season, it shall be deemed forfeited by the Eligible Account Holder and will automatically expire without notice. The Postponed Games Account Balance and the Bonus are not redeemable for cash or any item not set forth herein, and is non-refundable. The Bonus and the Postponed Games Account Balance may not be sold, transferred, or offered as a gift. Any unredeemed Postponed Games Account Balance after the completion of the 2022 baseball season, and all portions thereof, will be available to the Eligible Ticket Holder for refund and/or to purchase tickets for Brewers games in subsequent seasons, subject to ticket availability and in the Brewers’ sole and absolute discretion.
Eligible Ticket Holders who timely elect to receive the Bonus, but later request a refund of the Postponed Games for any reason, will be refunded and automatically deemed to have forfeited the Bonus.
Eligible Ticket Holders who elect the Refund Option will not receive the Bonus or otherwise participate in the Program.
Other Terms:
Acceptance of or participation in the Program does not confer upon any Eligible Ticket Holder any rights or options not expressly set forth in these Terms and Conditions, and does not alter, modify, amend, supersede, or cancel any of the terms and conditions set forth in the applicable ticket rules and related policies, or the law.
The failure of the Brewers to seek redress for any violation of, or to insist upon the strict performance of, any covenant, term, condition, representation, and/or warranty set forth in these Terms and Conditions will not constitute a waiver of such rights or in any way limit or prevent the subsequent enforcement of any such covenant, term, condition, representation, and/or warranty.
The Brewers shall have the right, in its sole and absolute discretion, to discontinue the Program, or any provision thereof, at any time and for any reason.
All aspects of the Program, including, without limitation, these Terms and Conditions, shall be governed by and construed in accordance with the laws of the State of Wisconsin and any applicable federal laws without regard to choice of law rules. Any aspect of the Program is void where prohibited by law. If any provision of these Terms and Conditions is held to be unlawful, void, or unenforceable, such provision shall be severable without affecting the enforceability of all remaining provisions.
This Program shall be governed by Wisconsin Law.
