Phillies Ticket Terms and Conditions

IMPORTANT: EACH OF THE FOLLOWING TERMS CONTAIN AN EXPRESS ASSUMPTION OF RISK, A RELEASE OF CLAIMS INCLUDING CLAIMS BASED ON THE NEGLIGENCE OF RELEASED PARTIES, AN INDEMNIFICATION OBLIGATION, A BINDING ARBITRATION AGREEMENT, A CLASS ACTION WAIVER, AND A JURY TRIAL WAIVER THAT AFFECT YOUR LEGAL RIGHTS. PLEASE REVIEW THESE PROVISIONS CAREFULLY.

This ticket is a limited, revocable license and solely licenses its holder, on the holder’s own behalf and on behalf of any accompanying minor(s) (collectively “Holder”) to use the specified seat (or standing room) at the specified game (the “Game”) at Citizens Bank Park (together with surrounding areas, including parking lots, the “Ballpark”), subject to the following terms and conditions (“Terms”), the violation of which will result in termination of this license without refund and Holder’s removal from the premises, in addition to any other civil and criminal remedies. By purchasing, receiving, accepting, transferring, presenting for admission or using a ticket, Holder agrees to these Terms for themselves and any Accompanying Party (as defined below).

An “Accompanying Party” as used herein is any accompanying party for whom Holder retains a ticket to attend the Game with Holder (each of whom Holder represents has authorized Holder to act on their behalf in accepting the applicable ticket terms).

By purchasing, accepting, or using this ticket, Holder agrees that:

• Holder will comply with all applicable requirements of law and the rules and regulations of The Phillies and Major League Baseball (“MLB”), including but not limited to the Ballpark’s Guest Code of Conduct (available here). Holder may not enter the playing field or non-public areas of the Ballpark.
• Holder understands that attending the Game and related activities involves risks of injury, illness, death and property loss or damage before, during and after the Game. Holder voluntarily accepts all risks inherent in attending, observing or participating in baseball games and related activities, including the risks of being struck by thrown or batted balls, bats, bat fragments, promotional items or other objects, at any time during the Game, warmups, batting practice, and fielding practice. Additional risks may arise from crowd movement, interactions with spectators or personnel, inclement weather, heat, fireworks, pyrotechnics, smoke, loud noises, flashing or patterned lights, mascots, promotional activities, vehicle and pedestrian traffic, and conditions in seating areas, stairs, ramps, concourses, restrooms, concessions, elevators, escalators, sidewalks, and parking areas. This acknowledgment supplements, and does not narrow, the separate contractual release of negligence claims below. • Holder will not transmit or aid in transmitting by any means any information about the Game, including but not limited to any account, description, picture, video, audio, reproduction or other information concerning the Game, other than for personal, non-commercial use as permitted by Phillies and MLB policies. Holder may not film any commercial content at the Ballpark without the express prior consent of The Phillies and/or MLB. Holder grants The Phillies and MLB an unrestricted, worldwide, perpetual, irrevocable, royalty-free, assignable and sub-licensable right and license to use Holder’s and any Accompanying Party’s name, image, likeness, voice, comments, and/or other proprietary or publicity rights in any live or recorded broadcast, telecast, photograph, video, audio and/or other recording created in connection with the Game or other transmission, distribution, public performance, or reproduction in whole or in part of the Game in any and all media now or hereafter known, without compensation, for all purposes including but not limited to advertising or promotional purposes. The Phillies is the exclusive owner of all copyrights and other proprietary rights in the Game and in such Game information.
• Tickets obtained from unauthorized sources may be invalid, lost, stolen or counterfeit, and if so, are void. Unlawful sale or attempted sale is prohibited.
• The maximum resale premium is the greater of 25% of the stated ticket price or $5, plus lawful taxes, although this maximum premium is not applicable to resales via the Internet or by a ticket broker duly licensed by the City of Philadelphia.
• This ticket may not be used for advertising, promotion (including contests and sweepstakes) or other trade or commercial purposes without the express written consent of The Phillies.
• Additionally, the license granted by this ticket may be terminated by tendering the purchase price of this ticket to Holder.

“Released Parties” means The Phillies, the City of Philadelphia, Philadelphia Authority for Industrial Development, Philadelphia Industrial Development Corporation, The Stadium Complex Parking Venture, ABM Industry Groups, LLC, Aramark Sports and Entertainment Services, LLC, the other Major League Baseball Clubs, MLB Advanced Media, L.P., the Office of the Commissioner of Baseball, Major League Baseball Properties, Inc., MLB Network, LLC, the Ballpark owner and operator, all related MLB entities, and all of their respective current and future parents, subsidiaries, affiliates, successors, assigns, owners, partners, members, shareholders, directors, officers, players, coaches, employees, agents, sponsors, vendors, independent contractors, subcontractors, security and crowd-management providers, parking operators and suppliers. Each Released Party is an intended third-party beneficiary of the provisions expressly protecting Released Parties and may independently enforce those provisions to the fullest extent permitted by law.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOLDER, ON BEHALF OF HOLDER, ANY ACCOMPANYING PARTY AND HOLDER’S AND ANY ACCOMPANYING PARTY’S PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, NEXT OF KIN AND ANY OTHER PERSON OR ENTITY THAT MAY BE ENTITLED TO MAKE A CLAIM ON HOLDER’S OR ANY ACCOMPANYING PARTY’S BEHALF, KNOWINGLY AND VOLUNTARILY WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ALL CLAIMS, LIABILITIES, CAUSES OF ACTION, INJURIES, LOSSES, DAMAGES OR DEMANDS, KNOWN OR UNKNOWN, OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR ARE RELATED IN ANY WAY TO: (A) THE PURCHASE, RECEIPT, TRANSFER OR USE OF THIS TICKET; (B) ENTRY INTO, PRESENCE AT, OR DEPARTURE FROM THE BALLPARK; OR (C) ATTENDANCE AT OR PARTICIPATION IN THE GAME OR ANY RELATED ACTIVITIES BEFORE, DURING OR AFTER THE GAME. THIS RELEASE EXPRESSLY INCLUDES CLAIMS FOR PERSONAL INJURY, ILLNESS, WRONGFUL DEATH AND PROPERTY DAMAGE OR LOSS ARISING IN WHOLE OR IN PART FROM: (1) THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES INCLUDING ALLEGED NEGLIGENT PREMISES MAINTENANCE, OPERATION, SECURITY, SCREENING, CROWD MANAGEMENT, SUPERVISION OR STADIUM SERVICES, AND/OR (2) THE INHERENT RISKS ASSOCIATED WITH VISITING THE BALLPARK, INCLUDING, WITHOUT LIMITATION (X) EXPOSURE TO OR CONTRACTION OF ANY COMMUNICABLE DISEASE (AS DEFINED BELOW) BY HOLDER, ANY ACCOMPANYING PARTY OR OTHER INDIVIDUALS EXPOSED TO ANY COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTY; AND (Y) ALL CLAIMS IN CONNECTION WITH THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO HOLDER OR ANY ACCOMPANYING PARTY.

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of any Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of such assumptions of risk, waivers of claims, and releases of liability shall not be affected thereby and shall remain valid and fully enforceable.

A “Communicable Disease” as used herein is any airborne, aerosolized or surface transmissible communicable and/or infectious disease, virus, bacteria or illness or the cause thereof, including, without limitation, COVID-19 and any strains, variants, or mutations thereof.

Holder consents, as a condition of admission and continued presence at the Ballpark, to reasonable and lawful security checks of Holder and Holder’s personal belongings, including walk-through detection technology, handheld screening, bag inspection and other reasonable security procedures. The Phillies may refuse entry to or remove any person who declines lawful screening, enters restricted areas, appears intoxicated, violates the Guest Code of Conduct or other applicable policies, disrupts the Game, or possesses any prohibited item or any other item or object that The Phillies considers potentially dangerous, hazardous, inappropriate, and/or injurious to other patrons, and any such items or objects may be confiscated. Holder releases the Released Parties from any claims arising from reasonable screening, inspection, denial of admission, ejection or other enforcement activity.

To the fullest extent permitted by law, Holder shall indemnify, defend and hold harmless the Released Parties against third-party claims, liabilities, damages and reasonable attorneys’ fees, investigation expenses and other recoverable costs, to the extent arising from Holder’s negligent, reckless, willful or unlawful acts or omissions; violation of these Terms, applicable law or Ballpark policies; damage to property; entry into restricted areas; interference with operations; or injury to another person caused by Holder.

Holder is responsible for personal property and vehicles brought to or parked at the Ballpark. To the fullest extent permitted by law, the Released Parties disclaim liability for theft of, loss of or damage to such property, including property left in parking areas, lockers or other facilities, including where negligence is alleged.

THE LICENSE GRANTED BY THIS TICKET SHALL BE GOVERNED BY PENNSYLVANIA LAW (EXCEPT THAT THE FOLLOWING ARBITRATION CLAUSE SHALL BE GOVERNED BY THE FEDERAL ARBITRATION ACT). ANY DISPUTE, CLAIM OR CAUSE OF ACTION ARISING OUT OF OR IN ANY WAY RELATED TO THESE TERMS; THE PURCHASE, RECEIPT, TRANSFER, RESALE OR USE OF A TICKET; ENTRY INTO OR PRESENCE AT OR DEPARTURE FROM THE BALLPARK; THE GAME OR RELATED ACTIVITIES; OR RELATED DEALINGS WITH ANY RELEASED PARTY, WHETHER IN CONTRACT, TORT, STATUTE OR OTHERWISE, INCLUDING CLAIMS FOR PERSONAL INJURY OR PROPERTY DAMAGE, SHALL BE SETTLED SOLELY BY CONFIDENTIAL, MANDATORY, FINAL AND BINDING ARBITRATION HELD IN PHILADELPHIA, PENNSYLVANIA AND ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS COMMERCIAL ARBITRATION RULES (OR ITS CONSUMER ARBITRATION RULES, IF APPLICABLE). ARBITRATION IS MORE INFORMAL THAN A LAWSUIT IN COURT, USES A NEUTRAL ARBITRATOR INSTEAD OF A JUDGE OR JURY, AND DISCOVERY AND APPELLATE REVIEW ARE MORE LIMITED. HOLDER AND THE PHILLIES WAIVE ANY AND ALL RIGHTS TO A JURY TRIAL.

HOLDER AGREES THAT ANY PROCEEDING, WHETHER IN ARBITRATION OR OTHERWISE, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION. HOLDER WAIVES ANY RIGHT TO BRING OR TO PARTICIPATE IN SUCH AN ACTION TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

If The Phillies determine that a majority of the tickets Holder originally purchased from The Phillies are being re-sold on the secondary market, The Phillies may, in its sole discretion, classify Holder as a “Ticket Reseller.” Ticket Resellers may not be eligible for certain pricing and seat locations. In addition, The Phillies, in its sole discretion, may cancel and refund any ticket purchase made by a Ticket Reseller.

If the Game is postponed for any reason, either before the Game date or on the Game date but before the Game is considered an official game under MLB rules, or if the Game is suspended or canceled, the following rules apply:

1. If the Game is rescheduled to an open date or as part of a split (day-night) doubleheader, the original ticket will be valid for entry to the rescheduled game only. No part of the purchase price will be refunded if Holder fails to use the ticket on the rescheduled game date.
2. If the Game is either not rescheduled at all or is rescheduled to the date of another scheduled game to create a straight (back-to-back) doubleheader, Holder will receive an account credit in the amount of the face value of the Game ticket and parking (if applicable). No credit will be issued for handling charges, convenience fees or other service charges. Account credit may be used to purchase tickets to any remaining regular season home game in the current season, or may be used before April 30th of the following season to purchase tickets to any regular season home game in that season (based on availability).

An “Accompanying Party” as used herein is any accompanying party for whom Holder retains a ticket to attend the Game with Holder (each of whom Holder represents has authorized Holder to act on their behalf in accepting the applicable ticket terms).

• Holder understands that attending the Game and related activities involves risks of injury, illness, death and property loss or damage before, during and after the Game. Holder voluntarily accepts all risks inherent in attending, observing or participating in baseball games and related activities, including the risks of being struck by thrown or batted balls, bats, bat fragments, promotional items or other objects, at any time during the Game, warmups, batting practice, and fielding practice. Additional risks may arise from crowd movement, interactions with spectators or personnel, inclement weather, heat, fireworks, pyrotechnics, smoke, loud noises, flashing or patterned lights, mascots, promotional activities, vehicle and pedestrian traffic, and conditions in seating areas, stairs, ramps, concourses, restrooms, concessions, elevators, escalators, sidewalks, and parking areas. This acknowledgment supplements, and does not narrow, the separate contractual release of negligence claims below.

Holder grants Phillies Florida LLC, The Phillies, MLB and MLB PDL an unrestricted, worldwide, perpetual, irrevocable, royalty-free, assignable and sub-licensable right and license to use Holder’s and any Accompanying Party’s name, image, likeness, voice, comments, and/or other proprietary or publicity rights in any live or recorded broadcast, telecast, photograph, video, audio and/or other recording created in connection with the Game or other transmission, distribution, public performance, or reproduction in whole or in part of the Game in any and all media now or hereafter known, without compensation, for all purposes including but not limited to advertising or promotional purposes. Phillies Florida LLC or The Phillies is the exclusive owner of all copyrights and other proprietary rights in the Game and in such Game information.

Additionally, the license granted by this ticket may be terminated by tendering the purchase price of this ticket to Holder.

HOLDER, ON BEHALF OF HOLDER, ANY ACCOMPANYING PARTY AND HOLDER’S AND ANY ACCOMPANYING PARTY’S PERSONAL REPRESENTATIVES, ASSIGNS, HEIRS, NEXT OF KIN AND ANY OTHER PERSON OR ENTITY THAT MAY BE ENTITLED TO MAKE A CLAIM ON HOLDER’S OR ANY ACCOMPANYING PARTY’S BEHALF, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE PHILLIES, PHILLIES FLORIDA LLC, THE CITY OF CLEARWATER, FLORIDA, THE OTHER MAJOR LEAGUE BASEBALL CLUBS (“CLUBS”), MLB ADVANCED MEDIA, L.P., THE OFFICE OF THE COMMISSIONER OF BASEBALL (“BOC”), MAJOR LEAGUE BASEBALL PROPERTIES, INC., THE MLB NETWORK, LLC, EACH OF THEIR PARENT, SUBSIDIARY, AFFILIATED AND RELATED ENTITIES, ANY ENTITY WHICH, NOW OR IN THE FUTURE, CONTROLS, IS CONTROLLED BY, OR IS UNDER COMMON CONTROL WITH THE CLUBS OR THE BOC AND THE OWNERS, GENERAL AND LIMITED PARTNERS, SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS OF THE FOREGOING ENTITIES (COLLECTIVELY, THE “RELEASED PARTIES”) WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR ARE RELATED IN ANY WAY TO, (A) USE OF THIS TICKET, (B) PRESENCE AT THE BALLPARK OR (C) PARTICIPATION IN THE GAME OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (1) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (2) THE INHERENT RISKS ASSOCIATED WITH VISITING THE BALLPARK, INCLUDING, WITHOUT LIMITATION (X) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTY OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTY; AND (Y) ALL CLAIMS IN CONNECTION WITH THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO HOLDER OR ANY ACCOMPANYING PARTY.

The Phillies or Phillies Florida LLC may refuse entry to or remove any person who declines lawful screening, enters restricted areas, appears intoxicated, violates the Guest Code of Conduct or other applicable policies, disrupts the Game, or possesses any prohibited item or any other item or object that The Phillies considers potentially dangerous, hazardous, inappropriate, and/or injurious to other patrons, and any such items or objects may be confiscated. Holder releases the Released Parties from any claims arising from reasonable screening, inspection, denial of admission, ejection or other enforcement activity.

To the fullest extent permitted by law, Holder shall indemnify, defend and hold harmless the Released Parties against third-party claims, liabilities, damages and reasonable attorneys’ fees, investigation expenses and other recoverable costs, to the extent arising from Holder’s negligent, reckless, willful or unlawful acts or omissions; violation of these Terms, applicable law or Ballpark policies; damage to property; entry into restricted areas; interference with operations; or injury to another person caused by Holder.

To the fullest extent permitted by law, the Released Parties disclaim liability for theft of, loss of or damage to such property, including property left in parking areas, lockers or other facilities, including where negligence is alleged.

ANY DISPUTE, CLAIM OR CAUSE OF ACTION ARISING OUT OF OR IN ANY WAY RELATED TO THESE TERMS; THE PURCHASE, RECEIPT, TRANSFER, RESALE OR USE OF A TICKET; ENTRY INTO OR PRESENCE AT OR DEPARTURE FROM THE BALLPARK; THE GAME OR RELATED ACTIVITIES; OR RELATED DEALINGS WITH ANY RELEASED PARTY, WHETHER IN CONTRACT, TORT, STATUTE OR OTHERWISE, INCLUDING CLAIMS FOR PERSONAL INJURY OR PROPERTY DAMAGE, SHALL BE SETTLED SOLELY BY CONFIDENTIAL, MANDATORY, FINAL AND BINDING ARBITRATION HELD IN CLEARWATER, FLORIDA AND ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS COMMERCIAL ARBITRATION RULES (OR ITS CONSUMER ARBITRATION RULES, IF APPLICABLE). ARBITRATION IS MORE INFORMAL THAN A LAWSUIT IN COURT, USES A NEUTRAL ARBITRATOR INSTEAD OF A JUDGE OR JURY, AND DISCOVERY AND APPELLATE REVIEW ARE MORE LIMITED. HOLDER, PHILLIES FLORIDA LLC AND THE PHILLIES WAIVE ANY AND ALL RIGHTS TO A JURY TRIAL.

HOLDER AGREES THAT ANY PROCEEDING, WHETHER IN ARBITRATION OR OTHERWISE, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION. HOLDER WAIVES ANY RIGHT TO BRING OR TO PARTICIPATE IN SUCH AN ACTION TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

If The Phillies or Phillies Florida LLC determine that a majority of the tickets Holder originally purchased from The Phillies or Phillies Florida LLC are being re-sold on the secondary market, The Phillies or Phillies Florida LLC may, in its sole discretion, classify Holder as a “Ticket Reseller.” Ticket Resellers may not be eligible for certain pricing and seat locations. In addition, The Phillies or Phillies Florida LLC, in its sole discretion, may cancel and refund any ticket purchase made by a Ticket Reseller.

If the Game is canceled for any reason, Holder will receive an account credit in the amount of the face value of the Game ticket and parking (if applicable). No credit will be issued for handling charges, convenience fees or other service charges. Account credit may be used to purchase tickets to any remaining Phillies Spring Training home game in the current season or any Phillies Spring Training home game the following season (based on availability).
