Army Navy Baseball Classic

This ticket solely licenses its holder, on behalf of himself/herself and any minor(s) accompanying holder (collectively “Holder”) to use the specified seat (or standing room) at the specified game, subject to the following agreements and conditions, the violation of which will result in its termination without refund and holder’s removal from the premises, in addition to any other civil and criminal remedies.

By use of this ticket, Holder agrees that:

· Holder will comply with all applicable requirements of law and the rules and regulations of The Phillies and Major League Baseball.

· Holder assumes all risk incident to attending a baseball game, whether occurring before, during or after the game (including without limitation from thrown or batted balls, thrown bats or fragments thereof and spectators’ conduct) and releases The Phillies and The U.S. Military and Naval Academies and their respective players from liability therefor.

· Holder will not transmit or aid in transmitting by any means any information about the game to which this ticket grants admission, including but not limited to any account, description, picture, video, audio, reproduction or other information concerning the game; holder’s name, likeness and voice may be used in any broadcast, photograph and/or video and/or audio sound recording created in connection with the game for all purposes.

Tickets obtained from unauthorized sources may be invalid, lost, stolen or counterfeit and if so are void. Unlawful sale or attempted sale is prohibited.

The maximum resale premium is the greater of 25% of the stated ticket price or $5, plus lawful taxes, although this maximum premium is not applicable to resales via the Internet or by a ticket broker duly licensed by the City of Philadelphia.

This ticket may not be used for advertising, promotion (including contests and sweepstakes) or other trade or commercial purposes without the express written consent of The Phillies.

Additionally, the license granted by this ticket may be terminated by tendering the purchase price of this ticket to Holder.

In addition to all other terms and conditions set forth on this ticket regarding the Event, by accepting or using the ticket, Holder also expressly releases Phillies, The U.S. Military and Naval Academies and, without limitations, their respective officials, employees, players, agents, volunteers and representatives from any and all present and future liability for injuries, expenses, claims, attorney fees, or liability resulting from or related to attending the game or other events on the premises, even if based on their negligence.

THE LICENSE GRANTED BY THIS TICKET SHALL BE GOVERNED BY PENNSYLVANIA LAW (EXCEPT THAT THE FOLLOWING ARBITRATION CLAUSE SHALL BE GOVERNED BY THE FEDERAL ARBITRATION ACT) AND ANY DISPUTE, CLAIM OR CAUSE OF ACTION ARISING OUT OF OR IN ANY WAY RELATED TO THE EVENT SHALL BE SETTLED BY CONFIDENTIAL, MANDATORY, FINAL AND BINDING ARBITRATION HELD IN PHILADELPHIA AND ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS COMMERCIAL ARBITRATION RULES (INCLUDING THE CONSUMER ARBITRATION RULES, IF APPLICABLE). ANY AND ALL CLAIMS SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS ONLY AND SHALL NOT BE ARBITRATED AS A REPRESENTATIVE MEMBER OF A PUTATIVE CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY OR CONSOLIDATED OR JOINED WITH OR IN ANY ARBITRATION OR OTHER PROCEEDING INVOLVING A CLAIM OF ANY OTHER PARTY. THE LICENSEE, THE PHILLIES, AND THE U.S. MILITARY AND NAVAL ACADEMIES WAIVE ANY AND ALL RIGHTS TO A JURY TRIAL.

If an official game is unable to be played on its scheduled date (either 4/10/20 or 4/11/20), the face value of the tickets will be refunded.

Credits/refunds will be handled for such tickets as follows:

Tickets purchased via Internet or Phone-The purchaser will have a refund applied to the credit card used in the original ticket purchase.

Tickets purchased at Citizens Bank Park Ticket Windows will need to be returned to the Phillies Ticket Office and refund will be issued via the original method of payment.
