Red Sox Destinations: Spring Travel Terms and Conditions

PAYMENT & RESERVATION

Full payment is due upon reservation. Payments must be made in the form of cashier's check, MasterCard, Visa, American Express, or Discover. Verbal credit card authorization confirms the reservation. Failure to make payment in full on the reservation date will result in cancellation of the reservation and forfeiture of any and all payments previously made. Red Sox DestiNATIONS reservations are nontransferable and may not be utilized for advertising, promotional or other commercial purposes without the express written consent of New England Sports Enterprises, LLC d/b/a Fenway Sports Management d/b/a Red Sox Destinations ("RSD").

CANCELLATIONS & REFUNDS

For cancellations received more than 60 days prior to departure, 10% of the total package price will be automatically forfeited and 90% of the total package price is refundable. For cancellations received less than 60 days prior to departure, the entire package price will be automatically forfeited. Packages booked within 60 days of a scheduled trip are nonrefundable. We regret that we cannot make any exceptions for personal emergencies. We recommend purchasing travel insurance. For complete protection, we offer travel insurance through our partners at AAA Travel after completed purchase of the package.

RSD reserves the right to accept or decline any person as a member of a Red Sox DestiNATIONS trip (a "Trip") and/or cancel any reservation for any reason at any time in RSD's sole discretion, in which event individuals whose reservations have been declined or canceled will be entitled to a full refund of payments previously made (except due to a cancellation for a reason beyond the control of RSD as described below). In addition, RSD reserves the right to cancel any Trip completely for any reason at any time in RSD's sole discretion, in which event individuals whose reservations have been declined or canceled will be entitled to a full refund of payments previously made (except due to a cancellation for a reason beyond the control of RSD as described below).

You acknowledge and agree that RSD shall not be responsible for, and you assume all risk in connection with, all loss, injury or damage, or any cancellation, delay, or changes to itineraries and schedules, that result from any terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, weather, cancellation of baseball games, strikes or labor disputes, or any other reason beyond the control RSD, and in no event shall you be entitled to any refund of any amounts due for the Trip in connection with cancellations or changes due to such causes.

TRAVEL DOCUMENTS & MERCHANDISE

If you selected a hotel option directly through Red Sox Destinations, you will receive your game tickets and guest credentials inside your Red Sox Destinations gift bag upon arrival at your hotel. If you have selected the "no hotel" option or made your own hotel accommodations, your tickets and credentials will be mailed to you via FedEx and will arrive one (1) week prior to departure. Please note that we require a physical address be provided as FedEx cannot deliver to P.O. Boxes. If international, please contact us as we will hold your game tickets/credentials for hotel delivery.

Your travel documents and personal itinerary will arrive via email one (1) week prior to your trip departure. Included within your itinerary are all confirmation numbers, a schedule of events and other pertinent information for your Red Sox Destinations Spring Training trip.

HOTEL POLICY

Hotels generally require a credit card or cash deposit upon check-in to cover incidental hotel charges. Participants are personally responsible for all incidental charges. All incidental charges are to be paid directly to the hotel by the participant upon check-out. Guest requests for specific room types, including smoking, non-smoking, or specific bedding, are subject to availability at time of check-in and cannot be guaranteed.

Rental Car Policy

A $200.00 credit card deposit must be provided at the time of car rental. RSD will only provide a car in the class appearing on the rental lists provided by RSD. Participants are personally responsible for all insurance, fuel charges, upgrades, damage charges and additional drivers.  Rental terms and conditions apply. TAXES

Included are all presently known government and local taxes on included services. You will be responsible for any additional taxes.

TICKETS

RSD obtains tickets for events in various forms at different time periods. RSD is not necessarily in physical possession of admission tickets at the time a booking is made or accepted. RSD will be acquiring event tickets on the buyer's behalf. Special ticket requests, including requests for specific seating locations, are subject to availability and cannot be guaranteed.

RELEASES

RSD is responsible only for arranging and coordinating the transportation, accommodations and other benefits in connection with your Trip. You acknowledge and agree that RSD does not own, operate or otherwise control, and is not an agent for, any of the entities actually providing the transportation, accommodations or other benefits to be provided in connection with the Trip including, without limitation, car rental, air transportation and hotel accommodations. 

You hereby, on behalf of yourself and your minor child(ren) (if applicable), voluntarily assume all risk and danger of property loss and personal injury incidental to the Trip and the game of baseball, including without limitation those relating to travel and those relating to the structure and conditions of any ballpark visited, and the danger of being injured by thrown or flying objects including bats and balls. To the extent permitted by law, you, on behalf of yourself and your minor child(ren) (if applicable), irrevocably waive all claims of any nature against RSD, the Boston Red Sox Baseball Club Limited Partnership, MLB Advanced Media, L.P., the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, the Major League Baseball Clubs ("Clubs"), Major League Baseball Properties, Inc., BAMTech, LLC and The MLB Network, LLC., each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the foregoing entities and the members, owners, general and limited partners, shareholders, directors, officers, employees, affiliates, representatives, independent contractors, licensees, vendors and agents of the foregoing entities (collectively, the "Released Parties") and release and discharge the Released Parties from all claims, liability, costs, expenses, damages, injuries and/or losses (whether direct or consequential and whether arising under statute, from negligence, personal injury, death, property damage or otherwise, including without limitation loss or theft of luggage) that you or any person traveling with you may suffer during the Trip, notwithstanding that it may have been caused by the negligent act or omission on the part of such Released Party or Parties.

You, on behalf of yourself and your minor child(ren) (if applicable), hereby grant the Released Parties the worldwide and perpetual right and authority to use, reproduce, distribute, broadcast or otherwise transmit, publish and display in whole or in part, your name(s), photograph(s), or any other likeness and/or biographical information you may provide and, if applicable, and any statement you have made or may make concerning the Trip in any and all media now known or hereafter invented, in perpetuity, for any purpose, without notification, compensation or additional consideration, unless prohibited by law.
