Mariners Care Foundation 50/50 Raffle Official Rules & Information

1. INTRODUCTION. The Mariners Care Foundation, a Washington State 501©(3) non-profit organization (the “Foundation”) will conduct Mariners Care Foundation 50/50 Raffles at Seattle Mariners home games at T-Mobile Park (each, a “Mariners Game” and together, “Mariners Games”) as described in these Mariners Care Foundation 50/50 Raffle Official Rules & Information (“Official Rules”).

A Mariners Care Foundation 50/50 Raffle is a fundraising raffle for the Foundation during which ticketed fans attending an applicable Mariners Game can purchase raffle tickets; the prize for the winning participant is half of the net gambling receipts generated from the sale of raffle tickets at a single Mariners Game (each, a “Raffle” and together, the “Raffles”). Raffle ticket sales will cease at the end of the top of the seventh (7th) inning of each applicable Mariners Game. A winning ticket entry will be manually drawn from the entries by a Foundation representative thereafter and the winning ticket number will be announced during the 8th inning. The total prize amount for the winning Raffle ticket holder is fifty percent (50%) of the net gambling receipts; the Foundation may deduct up to $2,000 in actual expenses per Raffle prior to calculating the prize amount. The remaining fifty percent (50%) of the receipts will be retained by the Foundation to support its charitable initiatives.

All Raffle tickets, transactions, participants, purchasers and winners are subject to these Official Rules, and to all applicable statutes, rules, and regulations, including but not limited to the Revised Code of Washington and the Washington State Gambling Commission rules and regulations promulgated thereunder, and all other applicable rules and regulations adopted by any regulatory and/or enforcement agency having jurisdiction with respect to the activities to which these Official Rules apply.

The Raffles will be operated exclusively by the Foundation.

2. ELIGIBILITY. Each Raffle is open to all ticket holders to Mariners Games who: (i) are eighteen (18) years of age or older as of the date of entry; (ii) are physically present at T-Mobile Park; and (iii) provide valid government-issued identification. By purchasing a Raffle ticket, the entrant agrees to abide by all terms of these Official Rules subject to all federal, state, local and municipal laws and regulations. Some restrictions apply. Void where prohibited or restricted by law.

Foundation volunteers cannot purchase Raffle tickets while working a Raffle; however, immediate family and household members may participate. No other person affiliated with the Foundation, the Mariners, or a registered manufacturer and distributor of raffle-related products or services used for the Raffle, including any affiliated person, any employee or agent, or their immediate family member or member of their household, may participate in any Raffle as a Raffle ticket purchaser or receive a Raffle prize.

3. TICKET PURCHASE. The Raffles will be conducted at all Mariners Games at T-Mobile Park during the 2024 Major League Baseball season. Raffle tickets will be sold from the time T-Mobile Park gates open (approximately two hours prior to first pitch) until the end of the top of the 7th inning of the applicable Mariners Game. The winning number and total prize amount will be announced in stadium at T-Mobile Park and posted thereafter at mariners.com/raffle. Raffle tickets can be purchased from stationary kiosks and roaming Raffle ticket sellers throughout T-Mobile Park. Each Raffle ticket seller will be wearing a “50/50 Raffle” uniform bib apron bearing the Raffle logo and a nametag displaying their first name.

4. Entry. Raffle Tickets may be purchased with credit/debit card in United States dollars (U.S. $) as follows: 1 ticket entry for $10; 5 ticket entries for $25; 20 ticket entries for $50; 300 ticket entries for $150.

Raffle tickets will be sold only in areas where an event ticket is required for admission to T-Mobile Park. Each ticket is a receipt for the purchaser and represents one (1) entry for the Raffle conducted during that specific Mariners Game and is not eligible for any past or future Raffle drawing. The Foundation is not responsible for printing errors in any Raffle-related material or any misdirected, incomplete, lost, late or illegible tickets or other errors or problems that may limit the entrant’s ability to participate in or win any Raffle.

False or deceptive entries or acts by the purchaser will render the purchaser ineligible. Entrants may purchase as many Raffle tickets as they wish, subject to availability, however the Foundation strongly encourages responsible play. If you or someone you know has a gambling problem, call the Washington State Problem Gambling Helpline at 1-800-547-6133 for confidential help 24 hours a day. A Raffle ticket is not transferrable or assignable from its purchaser to any other person. All sales of Raffle tickets are final; no refunds will be made under any circumstances. Raffle ticket purchases are not tax deductible.

The Foundation has the right to suspend a Raffle at any time during the applicable Mariners Game due to any unforeseen incidents that result in the Foundation being unable to conduct the Raffle for any reason (for example, weather delay, power outage, emergency, or other unforeseeable circumstances). In that case, Raffle ticket sales will terminate and the Raffle drawing will be postponed until it is safely possible to do so. Once a winning Raffle ticket is drawn, notice of the winning ticket number will be posted to mariners.com/raffle. The Foundation also reserves the right to terminate Raffle sales early if any backlog in ticket printing may interfere with manually drawing and announcing the winner prior to the end of the applicable Mariners Game.

5. Drawing. Every Raffle transaction will be electronically tallied. The running net total may be periodically displayed and updated in real time on the scoreboards and video displays and/or at various locations throughout T-Mobile Park. The winning ticket number will be drawn by hand out of the Raffle vessel that contains every Raffle number on tickets of equal size and shape that has printed and mixed throughout the game as the corresponding Raffle tickets were sold throughout T-Mobile Park. Raffle sales will cease at the end of the top of the 7th inning and the manual drawing will occur thereafter with the winner announced during the 8th or 9th inning. Raffle ticket holders do not need to be present to win. One (1) Raffle winner will be chosen out of the pool of purchased tickets for that game. The decisions of the Foundation are final and binding on all matters relating to any Raffle.

6. Winner Notification. The winning Raffle ticket number will be posted online at mariners.com/raffle. In the case of a discrepancy between the announced number and the actual number, the actual number drawn will be considered to be the valid winning Raffle ticket. Your Raffle ticket receipt includes the email address [email protected] and the phone number 206-346-4000, which you can contact to learn the winning Raffle number at the end of each Mariners Game. The winning number will also be posted on mariners.com/raffle within 48 hours following the drawing date. The Foundation has no obligation or means to contact the winning ticket holder directly.

7. ODDS OF WINNING; Prize. The odds of winning the Raffle and the amount of the prize (“Prize”) depend on the number of tickets sold. The Foundation shall pay each Prize to each Raffle winner within 24 hours following verification of the potential winner, including such winner providing all documentation required by the Foundation and by applicable law. Each Raffle winner will receive one-half (1/2) of the total net receipts collected by the Foundation for the Raffle on the applicable game day (“Prize”); payment will be made by check or electronic ACH transfer. No substitutes for the cash prize will be allowed.

8. CLAIMING THE PRIZE. To claim the Prize, potential winners should email [email protected] with a photo of the winning ticket for additional information on documentation needed and how to present the ticket for verification. The purchased Raffle ticket is the only valid receipt for claiming a Prize and must be redeemed in person. The potential Raffle winner will be required to submit their valid social security number and appropriate identification to the Foundation and execute and return an Affidavit of Eligibility, a Liability and Publicity Release, and all applicable tax forms.

Failure to submit any required identification or completed documents to the Foundation within the specified time period, noncompliance with these Official Rules, or return of any Prize or Prize notification as undeliverable, may result in disqualification and the Prize being forfeited. Any forfeited Prize money will be retained by the Foundation. Potential winners may also choose to waive their right to receive a Prize at which time the Prize from that drawing will be forfeited and the Prize money will be retained by the Foundation.

All Raffle winners will be subject to the Internal Revenue Service (“IRS”) rules and regulations regarding gambling winnings. The Foundation must comply with all reporting requirements on the Prize amounts imposed by state, local and/or federal laws. Each winner assumes all responsibility for any state, local or federal taxes, fees or other government assessments on the Prize amount. Federal tax law requires that a tax withholding on certain Raffle Prize values must be collected from the winner before distribution of the Prize. Each winner is advised to consult their own tax advisor(s) with respect to the liabilities that may arise from winning a Raffle Prize.

All Raffle winners will have thirty (30) days following the conclusion of the applicable game date to claim their Prize. If a Prize remains unclaimed after thirty (30) days following the conclusion of the date of the applicable Raffle date, the unclaimed Prize money will be retained by the Foundation.

The Foundation and the Mariners are not responsible for any lost or stolen Raffle tickets.

8. RAFFLE SPONSOR. The Foundation is the sponsor of the Raffles. The Foundation is recognized by the IRS as a Section 501©(3) charitable organization and is incorporated under the laws of Washington. It is a separate legal entity from The Baseball Club of Seattle, LLLP, d/b/a the Seattle Mariners, the legal entity that owns and operates the Seattle Mariners Major League Baseball franchise and operates T-Mobile Park (the “Seattle Mariners”). The Foundation is conducting the Raffle with the permission of the Seattle Mariners, but the Foundation is solely responsible for the operation and conduct of the Raffles. 9. Release of Liability; Disqualification; Remedies; Other Conditions. By purchasing or attempting to purchase a Raffle ticket, purchasers agree to release and hold harmless the Foundation, the Seattle Mariners, the other MLB Entities (defined below) and each of their respective parent, subsidiary or affiliated companies, and each of their respective owners, members, shareholders, employees, directors, officers, affiliates, representatives, agents, successors, and assigns (collectively, “Released Parties”) against any and all liability claims or actions of any kind whatsoever arising directly or indirectly for injuries (including death), damages or losses to persons and property, which may be sustained in connection with their participation or attempted participation in a Raffle or the receipt or use of any Raffle Prize, or while preparing for, participating, in, and/or traveling to any Prize-related activity. The Released Parties are not responsible for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Raffle: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic or Internet connectivity or other online or network communication problems; errors or limitations of any Internet providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any Wi-Fi transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of any website in whole or in part for any reason; traffic congestion on the Internet or any website; unauthorized human or non-human intervention of the operation of the Raffle, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Raffle, or loss, miscount, misdirection, inaccessibility or unavailability of any email account used in connection with the Raffle. Released Parties are not responsible for any typographical errors, any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Raffle. The Foundation, in its sole discretion, reserves the right to disqualify any person tampering within the entry process or otherwise in violation of the Official Rules. The Foundation further reserves the right to cancel, terminate or modify the Raffle for any lawful reason, including but not limited to if any Raffle is not capable of completion as planned, including but not limited to, infection by tampering, unauthorized intervention or technical failures of any sort, fraud, or other unforeseen circumstances. Released Parties make no warranty, guaranty or representation of any kind concerning any Prize and disclaim any implied warranty. Failure to enforce any term of these Official Rules will not constitute a waiver of that provision. All disputes will be resolved under applicable Washington law in the County of King, State of Washington, without reference to its conflicts of law principles.

Any attempt to deliberately damage or undermine the legitimate operation of any Raffle may be in violation of criminal and civil laws and will result in disqualification from participation in the Raffle. Should such an attempt be made, the Foundation reserves the right to seek remedies and damages (including attorneys’ fees) to the fullest extent of the law, including criminal prosecution.

A Raffle purchaser’s sole and exclusive remedy for any claim against the Foundation or any of the released parties arising out of the sale of Raffle tickets or the conduct of the Raffle shall be limited to the return of the purchase price paid for their Raffle ticket(s). In no event will the Released Parties be liable to any party or ticket purchaser for any loss or injury to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.

By accepting a prize, recipient (a) agrees that the released parties will have no liability whatsoever for, and shall be held harmless by the recipient against, any claim or cause of action, including, but not limited to, personal injury, death, or loss of property, or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Raffle and from acceptance, possession, misuse or use of the prize.

As used herein, “MLB Entities” means the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, the Major League Baseball Clubs (“Clubs”), MLB Advanced Media, L.P. (“MLB”), Major League Baseball Properties, Inc., The MLB Network, LLC, each of their parent, subsidiary, affiliated, and related entities, any entity which, now or in the future, controls, is controlled by or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities.

10. Publicity Release. By accepting a Prize, each winner grants (and agrees to confirm grant in writing promptly upon request) to the Foundation, the Seattle Mariners, the MLB Entities, and their third party designees full permission, except where legally prohibited, to print, publish, broadcast and use worldwide in any media now known or developed hereafter, the Winner’s name, biographical information, photograph, voice, likeness and statements for any purpose, commercial or otherwise, including but not limited to promotion, advertising, publicity and other communications without additional compensation.
