Unsung Heroes Award Program

Terms & Conditions

Washington Nationals Baseball Club, LLLC ("Washington Nationals") is accepting nominations for its Washington Nationals Unsung Heroes Award Program (the "Program"). The Program honors and recognizes unsung community heroes who have distinguished themselves by selflessly working or volunteering in fields that care for, serve, teach, protect, and improve the lives of others, around the corner or around the globe, who are most in need. To submit a nomination, nominator must be of legal age of majority (and at least 18 years of age) and a resident of the District of Columbia, Virginia, Maryland, North Carolina, West Virginia, Pennsylvania or Delaware at the time of nomination submission. Employees, officers, and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of the Washington Nationals, the other MLB Entities and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Program are not eligible to participate or receive an Award. The "MLB Entities" shall mean the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM"), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs ("Clubs"), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. The Program is subject to all applicable federal, state and local laws, rules and regulations. Void outside the states listed above and where prohibited or restricted by law, rule or regulation.

The Washington Nationals will evaluate all eligible nominations in consideration of its selection of eligible nominees who are most worthy of receiving a Program Award. The Washington Nationals will select potential eligible nominees most deserving of receiving a Program Award ("Potential Honoree") for select Washington Nationals home games played at Nationals Park in Washington, D.C.; however, the Washington Nationals reserves the right to not award any Awards if it does not receive a sufficient number of eligible or qualified nominations at its sole discretion. Subject to verification of eligibility of both Potential Honoree and the nominator who nominated such Potential Honoree, the Potential Honoree will be declared an official honoree of the Program ("Honoree"). Eligible nominations will be evaluated based on the following criteria: How the nominee bettered life for those in his/her community, and how the nominee best reflects the principles of volunteerism, heroism, or philanthropy. Limit one (1) Award per person, family or household.

Nominators may submit nominations online only by completing the online form. Nominations must be submitted in the English language. All nominations must include a valid email address for the nominator. Nominators must fully complete and submit all non-optional data requested on the nomination form for their nominations to be eligible. Incomplete and/or inaccurate nominations are void. Limit one (1) nomination per person/email address/household.

Nominations must not exceed one hundred (100) words in length. All information submitted by nominators online is subject to, and will be treated in a manner consistent with, Major League Baseball's Terms of Use accessible at: https://www.mlb.com/official-information/terms-of-use and Privacy Policy accessible at: mlb.mlb.com/privacy.

Self-nominations will be accepted. In order to submit a nomination which is not a self-nomination, nominator must have permission from the person he/she is nominating (or, if such person is under the legal age of majority in the jurisdiction in which he/she resides ("Minor Nominee"), must be the Minor Nominee's parent or legal guardian). The Washington Nationals in its sole discretion, may require nominator to verify such permission before awarding an Award.

Nominators must not include any of the following content in any nomination: (i) pornography, adult-oriented content or any other sexually-explicit material; (ii) materials relating to lotteries or gambling; (iii) explicit language or content, images of violence, or promotion of illegal activities; (iv) content in violation of intellectual property rights or laws; (v) libelous, defamatory, disparaging, tortious or slanderous materials; (vi) content that denigrates, disparages or reflects negatively on the MLB Entities, their owners and employees, or the game of baseball; (vii) tobacco, e-cigarettes, alcohol or drugs; (viii) dangerous stunts; (ix) real weapons of any kind including, but not limited to, guns, knives or projectiles; (x) material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by federal, state or local law, ordinance, or regulation; (xi) individuals under legal age of majority without providing a signed release from parent or legal guardian; (xii) audio and/or visual content owned by any third party (e.g., recorded music; pre-produced video, etc.); and (xiii) material that is unlawful, or otherwise in violation of or contrary to the laws or regulations in any state where the nomination is created. Any nomination that does not comply with the foregoing, in the sole discretion of Washington Nationals, will be disqualified and eliminated from consideration.

Honorees (or if Honoree is a Minor Nominee, such Minor Nominee's parent or legal guardian) will each receive either: (A) two (2) tickets for Honoree and one (1) guest (or if Honoree is a Minor Nominee, such Minor Nominee's parent or legal guardian, and the Honoree) for Marvel Super Hero Day™, and the opportunity for the Honoree to participate in the Marvel Super Hero Day™ on field pre-game ceremonies and to be featured on the scoreboard; or (B) two (2) tickets for Honoree and one (1) guest (or if Honoree is a Minor Nominee, such Minor Nominee's parent or legal guardian, and the Honoree) for one (1) Washington Nationals 2019 regular season home game played at Nationals Park in Washington, DC determined by the Washington Nationals at its sole discretion, and the opportunity for the Honoree to participate in such game's pre-game on field ceremonies and to be featured on the scoreboard (each, an "Award"). TRANSPORTATION TO/FROM THE GAME AND LODGING NOT INCLUDED. (Approximate Retail Value of each Award: $160.)

Each Honoree is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). All costs and expenses associated with the Award acceptance and use not specified herein as being provided, including but not limited to lodging, transportation costs, meals, gratuities and other expenses incurred by accepting the Award are the sole responsibility of each individual Honoree. The Washington Nationals reserves the right to substitute any Award (or any portion thereof) with an award of comparable or greater value at its sole and absolute discretion. All Awards are non-transferable and non-assignable, with no cash redemptions except at the Washington Nationals' sole and absolute discretion. All Award details, including, without limitation, the exact nature and duration of the pre-game on field ceremonies, shall be determined in the sole and absolute discretion of the Washington Nationals and subject to availability.

TRANSPORTATION TO/FROM THE GAME AND LODGING NOT INCLUDED. Exact date of game and seat locations at the game shall be determined in the sole discretion of the Washington Nationals. Each Honoree's guests must be of legal age of majority in their jurisdictions of residence (and at least eighteen (18) years of age), unless accompanied by a parent or legal guardian. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable, as applicable, and may be subject to change. The terms and conditions of the tickets awarded will govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played or held, as applicable, due to weather conditions, an act of God, an act of terrorism, civil disturbance or any other reason. Each Honoree and his/her guests agree to comply with all applicable ballpark and venue, as applicable, regulations in connection with the Award. The Washington Nationals reserve the right to remove or to deny entry to any Honoree and/or his/her guests who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Major League Baseball game tickets awarded may not be resold or offered for resale or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and Award forfeiture, and may invalidate the license granted by the game, event or exhibition tickets.

Nominators will be contacted by the Washington Nationals only if their nominee is selected as an Honoree.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROGRAM OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROGRAM MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE,THE WASHINGTON NATIONALS WILL DISQUALIFY ANY INDIVIDUAL RESPONSIBLE FOR THE ATTEMPT, AND THE WASHINGTON NATIONALS, MLBAM AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

By participating in the Program and submitting a nomination or giving permission to be nominated, each participant agrees to (a) be bound by these Terms and Conditions, including all entry requirements, and (b) waive any and all claims against the Washington Nationals, the other MLB Entities, and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Program, and all of their respective officers, directors, employees, agents and representatives (collectively, "Released Parties") for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Program or from the receipt or use of any Award (or any portion thereof) or any travel or activity related to the receipt or use of any Award (or any portion thereof). 

Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due or garbled entries, transmissions, email or mail; or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections including those through and/or by any website, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; wireless service congestion; failures or malfunctions of phones, phone lines or telephone systems, wireless towers or cellular tower equipment; any error, omission, interruption, defect or delay in wireless or other transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed email notifications; printing, typographical or other errors appearing within these Terms and Conditions, in any Program-related advertisements or other materials; or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, wireless service, mail, typographical, printing or otherwise relating to or in connection with the Program, including, without limitation, errors or difficulties which may occur in connection with the administration of the Program, the processing of entries, the announcement of the Awards or in any Program-related materials, or the cancellation or postponement of any Major League Baseball game, event or exhibition. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program. Released Parties are not responsible for injury or damage to entrants' or to any other person's computer and/or wireless device related to or resulting from participating in this Program or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Program or website or attempt to undermine the legitimate operation of the Program by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any representative of the Washington Nationals and/or MLBAM or who are in violation of these Terms and Conditions, as solely determined by the Washington Nationals, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Program is unlawful and subject to legal action by the Washington Nationals, MLBAM and/or their respective agents. The Washington Nationals shall have the sole right to disqualify any entrant for violation of these Terms and Conditions or any applicable laws relating to the Program, and to resolve all disputes in its sole discretion. Released Parties (a) make no warranty, guaranty or representation of any kind concerning any Award (or any portion thereof), and (b) disclaim any implied warranty. The Washington Nationals' failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision. 

In the event that the Program is challenged by any legal or regulatory authority, the Washington Nationals reserves the right to discontinue or modify the Terms and Conditions, or to disqualify nominations submitted by individuals residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any nominators whose nominations are disqualified due to such an action.

Each entrant agrees that any and all disputes, claims, controversies or causes of action arising out of or relating to this nomination form, or any Awards awarded, shall be (1) arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party, and (2) settled by binding arbitration in New York County, New York before a single arbitrator appointed by the American Arbitration Association in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (B) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses. These Terms and Conditions shall be governed by and construed and interpreted in accordance with the laws of the State of New York, U.S.A, applicable to contracts entered into and performed exclusively in that State.
