Legacy Club Open House Waiver and Release

Benefits:

As may be determined by the Club in its discretion from time to time, Benefits may be accrued by an eligible Participant based on the number of consecutive years that such Participant has maintained a certain type of Club season ticket license. The rules for earning, redeeming, retaining or forfeiting Benefits will be determined, and may be changed, limited, modified or cancelled by the Club in its sole discretion. Benefits cannot be redeemed for cash, have no cash value and cannot be combined with any other ticket or promotional offer of the Club or any third party. Benefits must not be transferred, sold or assigned. Benefits are not the property of the Participant and can be revoked at any time by the Club in its sole discretion. The Club will not be responsible or liable for the accuracy of Benefits s information in any Account or any unauthorized Benefit redemption activity.

Name and Likeness Release:

I hereby acknowledge and agree that, in consideration for the New York Yankees Partnership (together with its parent, affiliated and subsidiary companies and each of their respective successors and assigns, the "Partnership") granting me permission to participate in the Legacy Club Open House, which may involve playing baseball (i.e., hitting, running, throwing, catching) and other sport-related activities in Yankee Stadium (the "Stadium") on December 6, 2025 and December 7, 2025 (the "Event"), I hereby grant the Partnership the right to utilize my name, voice and likeness (including, photographs and any video/audio recording of my appearance at the Event) in any and all manner and media, now known or hereafter developed, throughout the universe in perpetuity without limitation and without additional compensation or consideration, notification or permission, unless prohibited by applicable law. I hereby waive any right that I may have to inspect or approve any finished product (including, any brochures, videos, slide shows, websites, and/or other collateral materials) or any advertising copy that may be used in connection therewith or the use to which it is applied. I hereby represent and warrant that I have the right to make this release and that my granting this waiver and the rights conveyed thereby will not infringe upon the rights of any third party. I hereby assign all right, title and interest I may have in any and all media now known or hereafter devised in which any or all of my appearance, name, voice and/or likeness have been captured in connection with the Event to the Partnership, along with full rights of assignability. I understand and agree that any permitted photographs and/or video/audio recordings I may make of the Event shall be solely for my private, non-commercial use, and that absolutely no sale, transmission, distribution or other commercial use of any such photographs and/or video/audio recordings or descriptions shall be permitted by the Partnership.

Physical Condition:

I hereby confirm that I: (i) have no psychiatric, medical and/or physical condition and/or history that would prevent me from participating in the Event and/or endanger myself, other Event participants and/or the Partnership employees, coaches and/or any other person supervising the Event on behalf of the Partnership; (ii) have not been instructed by any physician to refrain from participating in the Event and (iii) am physically fit and able to participate in the Event.

Equipment and Facilities Inspection:

I agree that before participating in the Event, I will inspect the facilities and all equipment to be used in the Event. I will immediately advise the Partnership employees, coaches and/or any other person supervising the Event on behalf of the Partnership of any unsafe condition that I observe and will refuse to participate in the Event until all unsafe conditions I observed have been remedied. I understand and agree that I must at all times abide by Stadium policies and procedures and the rules and the instructions of the Partnership employees, coaches and/or any other person supervising the Event on behalf of the Partnership, and that my failure to do so will result in my immediate dismissal from the Event and/or ejection from the Stadium.

Assumption of Risk:

I understand that I, and each participant in the Event, will be engaging in activities that may involve the risk of serious personal injury, illness or disease (including but not limited to COVID-19), permanent disability, dismemberment and death, and that also involve the risk of severe economic and property loss and damage. I understand that these risks may result from my or other's (including, Event participants, the Partnership employees and coaches or any other person supervising the Event on its behalf) actions, negligence and/or failure to act of, from the rules of play, the challenges of the Event and/or the condition of any real or personal property, facilities or equipment used during the Event. I also understand that there may be risks involved which are unknown to me or the Partnership and its partners, officers, employees, coaches and/or other persons supervising the Event on behalf of the Partnership and may not be foreseen or reasonably foreseeable by any of the foregoing persons or entities at this time or at the time of the Event and any activities in which I may participate.

I assume all of the foregoing risks including, the risk of any negligence by other Event participants or the Partnership and its owners, general partners, limited partners, stockholders, members, directors, officers, employees, agents and representatives and the risk of injury caused by the condition of any real or personal property, facilities or equipment used during the Event, and accept personal responsibility for any injury (including, personal injury, disability, dismemberment and death), illness or disease (including but not limited to COVID-19), damage, loss, claim, liability or expense (including, reasonable attorneys' and professionals' fees), of any kind or nature, that I may suffer as a result of, arising out of or in connection with my participation in or attendance at the Event.

Furthermore, I agree that no general or limited partner, shareholder, director, officer, member, beneficiary, trustee, manager, other controlling person, investor, employee, attorney, agent or independent contractor of the Partnership (each an "Exculpated Person") shall be personally liable for any obligation or liability of such party in connection with the Event, and all obligations and liabilities of such party in connection with the Event are enforceable solely against such party and such party's assets, and not against any Exculpated Person or the assets of any such Exculpated Person.

Liability Release and Indemnity Agreement:

I hereby release and forever discharge and agree to indemnify, defend, save and hold harmless, the Partnership, the City of New York, the New York City Industrial Development Agency, the New York City Economic Development Corporation and the City of New York Police Department and each of their respective parent, affiliated and subsidiary companies and each of their respective officials, owners, general partners, limited partners, stockholders, owners, members, directors, officers, employees, agents and representatives and, in all cases, each of their respective affiliates, and the other participants in the Event (each such entity or individual being referred to as a "Released Party") of and from any and all injuries (including, personal injury, disability, dismemberment and death), illness or disease (including but not limited to COVID-19), losses, damages, claims, liabilities or expenses of any kind or nature (and whether accruing to me, my heirs or my personal representatives) that are caused or alleged to be caused in whole or in part by the action, negligence or failure to act by any Released Party or condition of any real or personal property, facilities or equipment of any Released Party that may be suffered as a result of, arising out of or in connection with my participation in or attendance at the Event.

I acknowledge that, in the event of any breach by any Released Party or any third party, the damage, if any, caused to me thereby will not be irreparable or otherwise sufficient to entitle me to seek injunctive or other equitable relief. I will be strictly limited to the right, if any, to recover damages in an action at law and will have neither the right to rescind or terminate this Waiver and Release or any of the Partnership's rights hereunder, nor the right to enjoin the production, exhibition, or other exploitation of my name, voice and likeness or any subsidiary or allied rights with respect thereto. I further acknowledge that the Partnership shall not be responsible for any lost, stolen, misplaced or damaged personal items that I may leave unattended at the Event.

Medical Treatment:

In the event that I am unable to act on my own behalf as a result of an injury that I may sustain or illness or other medical conditions that I may experience during the Event, I hereby authorize any emergency first aid, medication, medical treatment or surgery deemed necessary by the attending medical personnel. Further, if I am not able or unavailable to do so, I authorize the attending medical personnel to execute on my behalf any permission forms, consents or other appropriate documents and to otherwise act on my behalf in connection with any such necessary medical attention. I further agree to assume all responsibility for any costs and expenses incurred as a result of any such medical emergency (e.g., transportation, hospitalization, x-rays, etc.).

Severability of Provisions:

I have carefully read the entirety of this Waiver and Release and agree to all its terms and conditions. I agree that the foregoing terms and conditions are intended to be as broad and inclusive as is permitted by applicable law. Any terms and conditions set forth herein found by a court of competent jurisdiction to be void or unenforceable as a matter of public policy or otherwise shall not affect the validity or enforceability of any other terms and conditions. This Waiver and Release will inure to the benefit of and will be binding upon my and each Released Party's respective affiliates, successors, licensees, assigns, heirs and representatives. The validity, construction and enforceability of this Waiver and Release shall be governed by, and construed and interpreted in accordance with the internal laws of the State of New York without regard to conflict of law rules applied in such state.
