Ticket Back Terms and Conditions

By using this ticket (“Ticket”) for admission to the Stadium, Ticket holder, on their behalf and on behalf of any accompanying minor (“Minor”) and other accompanying party for whom holder holds a ticket (whom holder represents has authorized holder to act on their behalf in accepting applicable terms) (together with Minor, “Accompanying Parties”), agrees to terms & conditions, including AGREEMENT TO ARBITRATE/CLASS ACTION WAIVER, available at www.yankees.com/ticketterms (“Agreement”), summarized below (Agreement controls if any conflict). Unless otherwise defined herein, all capitalized terms shall have the meaning set forth in the Agreement. Ticket holder and Accompanying Parties, collectively, “Holder”.

This Ticket grants Holder the revocable license to: (a) attend the Event on the date specified on the Ticket; and (b) sit in the Seat, unless this Ticket is designated “General Admission.”

Holder will comply with all Stadium policies/protocols (including, without limitation, for security, bags, fan conduct, health & safety and all terms available at www.mlb.com/yankees/ballpark/information/policies) and terms/conditions presented at purchase, including without limitation (a) terms that mandate/prescribe quantity of tickets available for purchase, (b) requirements for Accompanying Parties, and (c) terms regarding ticket resale/transfer.

Holder agrees that: (a) Holder will not transmit or aid in transmitting any photographs, images, videos, audio, livestreams or other accounts or descriptions (including play-by-play data) (whether text, data or visual), in any media, about the event to which this Ticket grants admission or any attractions offered at the Stadium in connection therewith (collectively, the “Event”); (b) New York Yankees Partnership (“Licensor”) will have the unrestricted, irrevocable, assignable right and license to use Holder’s image, likeness, name, voice, comments and/or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio, audiovisual and/or other recording taken in connection with the Event or the Stadium or other transmission, distribution, public performance, or reproduction in whole or in part of the Event or the Stadium, for all purposes, worldwide, in perpetuity, and in any and all media now or hereafter known, without compensation or consideration, notification or permission, unless otherwise prohibited by applicable law; and (c) Holder will be subject to and consents to all security inspections and/or screenings, including the use of metal detectors and physical pat-downs, and waives all claims against the Released Parties (as defined below) related thereto. Licensor reserves the right to refuse admission to or eject from the Stadium any person, item or property that poses a threat to safety. Any violation of this License shall give the Stadium operator the right to immediately revoke this License.

Holder assumes all risks associated with the purchase of this Ticket from anyone other than Licensor or its designated agents. Any resale of this Ticket in violation of applicable law (including, but not limited to, NY Art & Cult Affr § 25 et seq.) will invalidate this License.

WARNING: OBJECTS MAY LEAVE THE PLAYING FIELD. Holder acknowledges and assumes all of the risks and dangers arising from, incidental to or related in any way to attending, observing and/or participating in the Event including, without limitation, contracting COVID-19 or other communicable disease or being injured by objects leaving the playing field or other items. Please stay alert and be aware of your surroundings at all times while in the Stadium. If Holder is concerned about Holder’s and any Accompanying Party’s seat location, Holder may request a seat relocation by contacting a Guest Relations representative. All relocation requests are subject to availability, may be in a different area in the Stadium and may require additional payment.

INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER COMMUNICABLE DISEASES EXISTS IN ANY PUBLIC PLACE INCLUDING THE STADIUM REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER AGREES TO (a) ASSUME ALL RISKS OF COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (b) COMPLY WITH ALL STADIUM HEALTH & SAFETY POLICIES. HOLDER AGREES TO FOLLOW ALL APPLICABLE FEDERAL, STATE, COUNTY, CITY AND STADIUM DIRECTIVES IN CONNECTION WITH, AND IN ORDER TO REDUCE THE RISK OR SPREAD OF DISEASE OR SICKNESS.

Holder agrees that: (a) the Licensor, MLB and all other Major League Baseball-related entities (collectively, the “MLB Entities”), Major League Soccer (“MLS”), New York City Football Club, LLC (“NYCFC”) and the Event producer; (b) each of the MLB Entities’, MLS’s, NYCFC’s and Event producer’s respective past, present and future licensees, sponsors and vendors; (c) the Stadium and the owner and/or operator thereof and any local or state governmental body associated with the Stadium including the City of New York, the New York City Industrial Development Agency, the New York City Economic Development Corporation and the City of New York Police Department; (d) the Ticket manufacturer, provider and/or agent; and (e) all past, present and future affiliates, successors, assigns, players, managers, coaches, employees, trustees, partners, members, directors, officers, owners, agents, representatives, servants and independent contractors of each of the foregoing entities (collectively, the “Released Parties”), shall not be responsible for any personal injury (including illness and death), property damage, or other loss suffered in connection with the Event and/or the negligence of any of the Released Parties. Holder releases the Released Parties from any and all claims which Holder has or may have for any other cause of action arising out of the Agreement, use of this Ticket, attendance at, observation of, and/or participation in the Event.

BY ATTENDING THE EVENT, HOLDER AGREES THAT ANY DISPUTE, CLAIM, OR CAUSE OF ACTION ARISING OUT OF OR IN ANY WAY RELATED TO THIS LICENSE, THE TICKET AND THE AGREEMENT SHALL BE SETTLED BY MANDATORY, CONFIDENTIAL, FINAL, AND BINDING ARBITRATION. HOLDER, ACCOMPANYING PARTIES (INCLUDING MINORS) AND THE RELEASED PARTIES SHALL NOT BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION BY OR AGAINST OTHER INDIVIDUALS OR ENTITIES, OR ARBITRATE AS A REPRESENTATIVE MEMBER OF A PUTATIVE CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY.

BY ATTENDING THE EVENT, HOLDER IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY AND AGREEMENT TO ARBITRATE TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. IN THE EVENT HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT SUCH RIGHTS, RELEASES AND WAIVERS ON BEHALF OF ANY MINOR, HOLDER SHOULD NOT ENTER THE STADIUM OR IMMEDIATELY LEAVE WITH SUCH MINOR.

THIS TICKET AND THE LICENSE GRANTED THEREBY SHALL BE GOVERNED AND CONSTRUED BY NEW YORK STATE LAW, WITHOUT GIVING EFFECT TO ITS CONFLICT OF LAWS PRINCIPLES EXCEPT THAT THE ARBITRATION AGREEMENT SHALL BE COVERED BY THE FEDERAL ARBITRATION ACT.

IN NO EVENT WILL ANY OF THE MLB ENTITIES BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR FOR LOST PROFITS, REVENUES OR BUSINESS OPPORTUNITIES EVEN IF SUCH RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

RAIN CHECK:

(a) Games: In the event a regulation game (as determined by MLB) is not played, the Ticket will constitute a rain check that can either be: (i) used for admission to the rescheduled Game, if any, subject to certain doubleheader and Premium Game limitations; or (ii) exchanged for a Ticket comparable in price and location to another, similar Game within 12 months of the originally scheduled Game, subject to availability and Premium Game limitations. (b) All Other Events: The Ticket will constitute a rain check that can be, within 12 months of the originally scheduled date of the Event: (i) used to attend a rescheduled performance of the same Event; or (ii) exchanged for a Ticket comparable in price and location to another, similar Event.

GENERAL INFORMATION:

1. Time, opponent, date, team rosters, lineups and seating locations are subject to change.
2. Licensor makes no representation, warranty and/or guarantee that nine (9) innings will be played in any regulation game.
3. Ticket price does not include New York State Sales Tax.
4. This Ticket may not be used for advertising, promotions (including contests and sweepstakes) or other trade or commercial purposes without the express written consent of Licensor.
5. Licensor reserves the right to change all Stadium policies without prior notice.
