50/50 Raffle Official Rules

By participating in the Brewers Community Foundation 50/50 Raffle (the ā€œRaffleā€) held during any Milwaukee Brewers MLB regular season game, any Milwaukee Brewers MLB Postseason game, or any other baseball game at American Family Field, as applicable, each participant (ā€œParticipantā€) agrees to be bound by these ā€œOfficial Rulesā€ and by the decisions of the Brewers Community Foundation, Inc. (collectively, the ā€œRulesā€), and the Rules shall be binding and final as to all matters related to the Raffle.

The Raffle is conducted in accordance with Chapter 563, Wisconsin Statutes, and is subject to all applicable federal, state, and local laws. Raffle is void outside of the State of Wisconsin and wherever prohibited by law.

SPONSOR: Brewers Community Foundation, Inc. (ā€œSponsorā€), American Family Field, One Brewers Way, Milwaukee, WI 53214. Raffle License Number: R0023023B-92065.

PROCEEDS: Fifty percent (50%) of the revenue from the Raffle will benefit Sponsor, a Wisconsin non-profit corporation and tax-exempt Section 501Ā©(3) non-for-profit organization.

RAFFLE PRIZE: There will be a maximum of one (1) winning Raffle ticket (ā€œOfficial Winnerā€) selected for each Drawing (as hereinafter defined), and the Official Winner of each Drawing will, subject to the Rules, be awarded fifty percent (50%) of the Raffle ticket revenue from the respective Milwaukee Brewers home game at the Ballpark (the ā€œPrizeā€). The Released Parties (as hereinafter defined) (i) make no warranty, guaranty, or representation of any kind concerning any Prize, and (ii) disclaim any implied warranty.

ELIGIBILITY: During the dates and times and at the location specified herein, Raffle tickets may be purchased only by persons eighteen (18) years of age or older, who are physically present in the State of Wisconsin at the time of purchase, in accordance with the Rules. Raffle tickets may NOT be purchased by anyone under the age of eighteen (18), regardless of location or method of purchase. Raffle tickets are sold exclusively in-person in and around American Family Field on the day of Milwaukee Brewers home games and, in the discretion of Sponsor, other baseball games at American Family Field.

The following persons are not eligible to participate in the Raffle or to win any Prize (collectively, the ā€œIneligible Partiesā€): owners, shareholders, members, officers, directors, employees, agents, volunteers, and consultants of Sponsor, Milwaukee Brewers Baseball Club, L.P. (the ā€œBrewersā€), or the other MLB Entities involved in the administration of the Raffle during the respective season, and immediate family members of each of the foregoing (any spouse, parent, child, sibling, and grandparent thereof, and any spouse or ā€œstepā€ of each) and those living in their same households (those persons, whether related or not, who live in the same residence for at least three (3) months during the twelve (12)-month period preceding the date of the applicable Drawing). For purposes hereof, ā€œMLB Entitiesā€ means, collectively, the Office of the Commissioner of Baseball (the ā€œBOCā€), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball clubs (the ā€œClubsā€), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.

HOW TO ENTER / RAFFLE PERIOD: Participants may enter the Raffle at American Family Field, One Brewers Way, Milwaukee, WI 53214 (the ā€œBallparkā€), by purchasing a Raffle ticket from a Brewers Community Foundation 50/50 Raffle roaming seller (a ā€œ50/50 Roaming Sellerā€), subject to availability and operability. Each Raffle ticket costs two dollars ($2.00). For purposes hereof, the ā€œRaffle Periodā€ shall mean the period beginning prior to the start of the respective game when the Ballpark and/or its parking lots are open to ticketed members of the public, through the conclusion of the 4th inning of the respective game. For purposes of clarity, Raffle ticket sales will conclude when the third out of the bottom half of the 4th inning has been recorded.

Please Note: No portion of the Raffle ticket price may be deducted as a charitable contribution for federal income tax purposes.

DRAWING: The potential winning Raffle ticket will be randomly drawn from among all eligible Raffle tickets purchased during the Raffle Period for each Milwaukee Brewers home game at the Ballpark (the ā€œDrawingā€). The Drawing will be conducted by Sponsor between the end of the Raffle Period and the end of the top of the 6th inning of the respective game, and the potential winning number will be announced via the public address system and/or displayed on the Ballpark scoreboard during the middle of the 6th inning of such game.

The potential winning Raffle ticket number will also be posted at the 50/50 Table located on the Loge (2nd) level concourse behind Sections 216/217, or the winner can call the 50/50 Raffle hotline (414-902-4334) for information.

Odds of winning depend on the number of Raffle tickets purchased for the applicable Drawing.

HOW TO CLAIM PRIZE: The Participant in possession of the Raffle ticket with the potential winning number will have until the end of the top of the 7th inning (i.e., until the third out is recorded in the top of the 7th inning) to claim the Prize at the 50/50 Table located on the Loge (2nd) level concourse behind Sections 216/217. If the Participant in possession of the Raffle ticket with the potential winning number does not claim the Prize at the 50/50 Table before the last out is recorded in the top of the 7th inning, that Participant will be deemed to have forfeited any claim to the Prize, and an alternate potential winning number will be announced during the middle of the 7th inning (i.e., after the final out is recorded in the top of the 7th inning, but before the first official pitch in the bottom half of the 7th inning). The Participant in possession of the Raffle ticket with the alternate potential winning number may claim the Prize at the 50/50 Table located on the Loge (2nd) level concourse behind Sections 216/217 until such time as the Ballpark officially closes to fans after the end of the game. If the Participant in possession of the Raffle ticket with the alternate potential winning number does not claim the Prize by the time the Ballpark closes to fans after the end of the game, that Participant may still claim the Prize within thirty (30) days after the conclusion of the Raffle Period for the respective baseball game by contacting the Raffle hotline (414-902-4334). A Prize that is not claimed within thirty (30) days after the conclusion of the Raffle Period for the respective baseball game is forfeited.

The designated Raffle ticket (in its original, physical form) is the only valid receipt for claiming a Prize. A Raffle ticket will be void and a Prize will not be paid/redeemed if there is any evidence to suggest, in Sponsorā€™s sole determination, that the ticket was stolen, unissued, ineligible, altered, counterfeit in whole or in part, defective, printed in duplicate, or printed/produced in error. All Raffle ticket purchases are final, and no refunds or replacements will be issued by Sponsor. Sponsor is not responsible for any lost, stolen, or misplaced Raffle tickets.

DETERMINATION OF OFFICIAL WINNER: Sponsor shall have the sole discretion to determine whether a Participant with a winning Raffle ticket is the Official Winner of the Prize for the respective Drawing. Sponsorā€™s decision concerning the eligibility of the Official Winner and the validity of the winning Raffle ticket shall be final and binding. To be deemed the Official Winner: (1) the Participant must be eligible to participate in the Raffle under the Rules and must not be in violation of the Rules as determined in Sponsorā€™s sole judgment; (2) the Participant must be in possession of the winning Raffle ticket and must contact Sponsor by the deadline and in the manner specified above under ā€œHow to Claim Prize;ā€ (3) the Participantā€™s winning Raffle ticket must be inspected and verified in person by Sponsor; (4) the Participant must execute and return to Sponsor an affidavit of eligibility on a form to be provided by Sponsor and provide all tax identification information and other information and documents required by federal, state, or local law, or as otherwise requested by Sponsor; and, (5) if applicable, the Participant must provide Sponsor with payment for any required withholding taxes due prior to the Participantā€™s receipt of the Prize. If for any reason whatsoever all of the foregoing requirements are not satisfied with respect to a particular Participant, or if the Participant does not claim the prize by the stated time and in the stated manner, then that Participant will be disqualified and the Prize forfeited, and the Prize will continue to remain the property of Sponsor to use in accordance with these Rules or otherwise for charitable fundraising purposes.

Sponsor shall use the following rules to determine the identity of any Participant and of the Official Winner of each Prize: Sponsor shall conclusively presume that the person who is in possession of that Raffle ticket is the lawful owner of that Raffle ticket, and Sponsor shall not make, nor have any duty to make, any inquiry whatsoever into the circumstances under which that person came into possession of such winning Raffle ticket. In the unlikely event that an error or problem in the administration of the Raffle results in two (2) or more Participants holding winning Raffle tickets that contain identical ticket numbers, then the Participant who claims the Prize first at the 50/50 Table shall be deemed to hold the winning Raffle ticket. Other than as stated herein, Sponsor shall have no obligation to contact any Participant to claim a Prize.

AWARD OF PRIZE TO OFFICIAL WINNER: The Prize will be awarded to the Participant who has been designated by Sponsor as the Official Winner. All Prizes will be sent to the Official Winner via check within thirty (30) business days of Sponsorā€™s determination of the Official Winner of the Prize for the respective Drawing as described above. For security and safety reasons, no cash payments will be made to the Official Winner.

TAXES: All applicable federal, state and local income taxes shall be the sole responsibility of the Official Winner. The taxable value of the Prize will be reported as taxable income to the Official Winner for federal and state income tax purposes, as required by law.

RELEASE OF LIABILITY: Participants, by participating in the Raffle, agree that Sponsor, the Brewers, the other MLB Entities, the Southeast Wisconsin Professional Baseball Park District, and each of their respective parent companies, affiliates, subsidiaries, partners, and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, shareholders, managers, members, contractors, volunteers, licensees, consultants, and agents (collectively, the ā€œReleased Partiesā€) will have no liability whatsoever for, and shall be held harmless by Participants against, any liability for injuries, losses, cost, expenses, or damages of any kind, including damages for death, personal injury, property damage, or property loss, or other harm arising from or in connection with, whether in whole or in part or directly or indirectly, this Raffle or the acceptance, possession, misuse, or use of any Prize, the Rules and their application thereof, all means of Raffle ticket sales, Raffle administration, and/or winning Raffle ticket selection.

GENERAL CONDITIONS: The Released Parties are not responsible for: (1) Raffle tickets that are stolen, lost, damaged, illegible, given away, or no longer in Participantā€™s possession; (2) Raffle tickets that have been or may have been tampered with or re-sold in violation of these Official Rules; (3) any other errors of any kind, whether human, typographical, printing, mechanical, telephone, computer, mail, or electronic in nature, which relate to or are connected with the Raffle, including, without limitation, typographical or other errors in the printed or other material related of this Raffle, the administration of the Raffle, the selection of Official Winners, in the announcement of the Prize, including erroneous appearance of qualification for the Prize, any Participants disqualified for any of the reasons stated in the Rules, or any loss, damage, or claims caused by, or in any way related to the Prize or the Raffle itself.

Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel, or suspend this Raffle, or to amend the Rules at any time, without prior individual notice, should any factor interfere with the administration, security, or proper play of this Raffle as contemplated by these Rules, including but not limited to the unlikely event that Sponsor is unable, for whatever reason, to adhere to the schedule stated above with respect to the selection and/or announcement of the potential winning number (or the alternate potential winning number). If Sponsor determines, in its sole discretion, that it is necessary to modify the schedule for selecting or announcing the potential winning number, Sponsor will announce via the public address system and/or display on the Ballpark scoreboard, as soon as reasonably possible, any revision(s) to the stated selection and/or announcement schedule, as well as any revision(s) to the stated time period in which the Participant in possession of the Raffle ticket with the potential winning number must claim the Prize.

If for any reason Sponsor is prevented from continuing with this Raffle, or the integrity and/or feasibility of the Raffle is undermined by any event including but not limited to fire, flood, pandemic, epidemic, earthquake, explosion, labor dispute or strike, non-authorized human intervention, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial/territorial or local government law, order, or regulation, or any order of any court or jurisdiction, Sponsor shall have the right, but not the obligation, in its sole and absolute discretion, to award the Prize by way of random drawing from among all eligible, non-suspect Raffle tickets received before the known occurrence or discovery of such event.

PUBLICITY RELEASE: Except where prohibited by law, each Official Winner, by accepting a Prize, grants Sponsor and Sponsorā€™s designees and affiliates, the Brewers, and the MLB Entities, full permission to use that Official Winnerā€™s name, address (city and state/territory/province only), image, voice and/or other likeness and Prize information for advertising, trade, and promotional purposes without further compensation and without notice, review, or approval, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity.

COPYRIGHT: All Raffle materials are copyrighted by Sponsor, and may not be copied, reproduced, or used for any purpose without Sponsorā€™s express prior written consent.

WINNERS LIST: Winning numbers for the Raffle will be posted by Sponsor online at brewers.com/5050. For the name of the winners, send a self-addressed stamped envelope to: Winnerā€™s List ā€“ The Brewers Community Foundation 50/50 Raffle, American Family Field, One Brewers Way, Milwaukee, WI 53214. Please specify the applicable Milwaukee Brewers home game. Requests must be received no later than ninety (90) days after the conclusion of the respective Drawing.

GOVERNING LAW; SEVERABILITY: The Raffle and the Rules shall be subject to and governed by the laws of the State of Wisconsin, and any litigation brought by any Participant Arising out of or in connection with the raffle shall be subject to the exclusive jurisdiction of the applicable federal or state court located within Milwaukee County, Wisconsin. As a condition of entering the Raffle, each Participant agrees that: (1) any and all disputes, claims, controversies, or causes of action arising out of or relating to the Raffle, these Rules, or any Prize(s) awarded (each, a ā€œClaimā€), shall be resolved individually, without resort to any form of class action, and shall not be consolidated or joined with or in any other proceeding involving a Claim of any other party; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THe Raffle, BUT IN NO EVENT ATTORNEYSā€™ FEES; AND (3) under no circumstances shall such Participant be permitted to obtain awards for, and such Participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual, reasonable out-of-pocket expenses, and waives any and all rights to have damages multiplied or otherwise increased. If a court of competent jurisdiction finds that any provision of the Rules, or their application to a particular person or circumstance, is invalid or unenforceable to any extent, then the remainder of the Rules, and the application of all of the Rules to other persons or circumstances, shall not be affected by that determination, and shall remain enforceable to the fullest extent permitted by law.

DEPOSITING FRAUDULENT, ALTERED, OR COUNTERFEIT RAFFLE TICKETS OR RELATED MATERIALS IN THE FEDERAL MAILS IS A VIOLATION OF FEDERAL LAW AND COULD LEAD TO CRIMINAL PENALTIES.

CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE IS A VIOLATION OF THESE RULES AND OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR MAY DISQUALIFY, AND SPONSOR AND THE MLB ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW FROM, ANY INDIVIDUAL RESPONSIBLE FOR THE ATTEMPT.
