When Club offers a Season Ticket Holder access to an Account representative, the continuation of any such access is subject to the Season Ticket Holder’s (or Season Ticket Holder’s authorized representative’s(’)) engagement with such Account representative in a reasonable, courteous, respectful and honest manner. The failure of Season Ticket Holder (or Season Ticket Holder’s authorized representative(s)) to comply with the requirements of this section, including any form of abuse, threats, insults, mistreatment or hostility, may result, in Club’s discretion, in the suspension of access to a Club representative and will be a cause for termination in accordance with Section 10.

e. This agreement to arbitrate is made pursuant to and in connection with a transaction involving interstate commerce and shall be governed by, and construed and interpreted in accordance with, the Federal Arbitration Act.

To the extent the Club cancels any Ticket or terminates an Account hereunder, the Club’s liability to Season Ticket Holder shall not exceed, as applicable, the value of the Ticket(s) cancelled or the pro-rata portion of the Ticket fees actually paid by Season Ticket Holder for the remaining Tickets in the Account following the termination that have not been previously refunded by the Club to Season Ticket Holder.

b. The failure of the Club to object to or take affirmative action with respect to any conduct of the Season Ticket Holder that is in violation of the provisions of this Policy shall not be construed as a waiver of that violation or of any future violations of the provisions of this Policy.

c. The Club reserves the right to amend or supplement the terms and conditions contained in this Policy by providing written notice to Season Ticket Holder or posting such revisions or amendments to the terms and conditions on www.cardinals.com when adopted by the Club.

The Season Ticket Holder hereby waives trial by jury in any litigation arising out of or in any way connected with this Policy or any breach thereof.
